I see no problem here. jquery is _used by_ ola, in very much the same way that libc and libstdc++ are used by it as well. The source to jquery is therefore not part of the source to ola, and I see no need to either ship its source, or remove it from the package. I agree that would be necessary in case jquery were non-free software.
