I thought copyright only protected the right to distribute copies (modified or not). What you do at home (modify, copy, use) is your own business, as long as you don't distribute the result. AFAIK the "you may use the software" is only there for completeness, not because you wouldn't have the right otherwise. But IANAL and I could very well be wrong... If nobody else is sure about this, we could ask -legal. Regardless of that it's probably a good idea to ask upstream to change the wording. As Joerg says, they obviously mean the software to be free.
