Bug#574544: [afflib] contains files released under a non-free license

2010-04-02 Thread Eriberto
Hey! Are enabled the uploads to Debian? D-d-a list announced problems
in a machine and incoming (http://incoming.debian.org) is out now (and
since that announce). Mika I am asking it because you made an upload
for me (chaosreader_0.94-2) but it doesn't exist in QA page yet (see
http://packages.qa.debian.org/c/chaosreader.html).

Thanks!

Regards,

Eriberto - Brazil

[afflib - new upstream release addressing licensing issue]

Untill then, I'm not sure of what to do and what is the Debian way to
  handle this problem.

I'm marking this bug as pending to show that we're aware of this
issue and it will be fixed with next upload.

Pending in Git:

Bug#574544: [afflib] contains files released under a non-free license

2010-03-20 Thread Christophe Monniez
Here is the answer of the upstream author about this problem:

Those files are public domain, which means that they are distributed
without a license. This is the least restrictive way of distributing
content on the planet. You can do anything you want with that.

You are correct, however. The last sentence is not in the spirit of the
PD. This verbiage is from NIST and it is clearly not legal. We will
remove it from the next release.

So, I will close this bug when packaging the next release (I will skip
the current 3.5.8).

Untill then, I'm not sure of what to do and what is the Debian way to
handle this problem.

Bug#574544: [afflib] contains files released under a non-free license

2010-03-19 Thread Christophe Monniez
Hi Cristian,

I didn't noticed this last sentence.
I will send this to the uptream author and see if he is able to give
more freedom.

If not, the only solution that I see is to remove afflib from Debian.

Bug#574544: [afflib] contains files released under a non-free license

2010-03-19 Thread Tim
I didn't noticed this last sentence.

I find the last sentence pretty comical since the previous sentences
explicitly stated the code was placed into the public domain. Once
you place something into the public domain, you no longer hold
copyright. If you have no copyright, you can't enforce any license
agreements on that copyright. I'm definitely not a lawyer, but that
last sentence seems completely unenforceable.

If not, the only solution that I see is to remove afflib from Debian.

When you contact Simson, you may want to mention the above oxymoron.

thanks,
tim

Bug#574544: [afflib] contains files released under a non-free license

2010-03-18 Thread Cristian Greco
Package: afflib
Severity: serious

Hi,

as stated in debian/copyright:

Files: tools/aff_bom.*
Copyright: (C) 2008 Simson L. Garfinkel sims...@acm.org
License: PD
The software provided here is released by the Naval Postgradaute
School (NPS), an agency of the US Department of the Navy, USA. The
software bears no warranty, either expressed or implied. NPS does
not assume legal liability nor responsibility for a User's use of
the software or the results of such use. Please note that within
the United States, copyright protection, under Section 105 of the
United States Code, Title 17, is not available for any work of the
United States Government and/or for any works created by United
States Government employees. User acknowledges that this software
contains work which was created by NPS employee(s) and is therefore

use, distribute, or incorporate this software provided the User
acknowledges this via an explicit acknowledgment of NPS-related
contributions to the User's work. User also agrees to acknowledge,
via an explicit acknowledgment, that any modifications or
alterations have been made to this software before redistribution.

Latest sentence in this text is clearly non-free as it fails to comply with
dfsg #1 and #3. It also fails the desert island test.

The file tools/afdiskprint.cpp contains a license text which is similar,
modulo the last paragraph.

Thanks,
