emacs23 and I don't think emacs is an issue.

Ok. Making some progress, here.
With the new hwdb update it looks as if the hotkey does respond, but,
not like one would expect :-) The touchpad hotkey now behaves like it
did in the past before we put the keyboard-force-release rules in place.

After talking with Nick and Lars we think that this might get fixed in
the transition of the messaging menu to unity menu model, which is
expected to land pretty soon. We're going to let that land, and then
revisit this bug.
