Patrice, virtualbox-ose is in the universe repository. I would like to confirm this bug. In Ubuntu 8.10 (Intrepid), kvm seems to be loaded at startup if you have the proper CPU extensions. This blocks me from being able to start up any virtualbox machine. virtualbox and kvm need to play nicely

This is the error that virtualbox-ose outputs when the kvm module is loaded. VirtualBox can't operate in VMX root mode. Please disable the KVM kernel extension, recompile your kernel and reboot. VBox status code: -4011 (VERR_VMX_IN_VMX_ROOT_MODE). Result Code: NS_ERROR_FAILURE (0x80004005)
