Basically this raises the question, Isn't it the music that is
actually off limits? ASCAP, BMI etc.. But, the video without the audio
should be legal.

Yeah they're converting it to Flash Video at a pretty low bit rate.
I've experimented with Flash video and I know it doesn't have to
look that bad. I think they do it like that to save on bitrate.
One advantage that flash has is that it's a pretty universal format.
