Public bug reported: On an UEFI System, shim should always be used as a first stage loader, no matter if secure boot is enabled or not.
This would allow the user to enable or disable SecureBoot on demand and would still lead to a bootable system. Current situation: Wenn you install ubuntu 12.10 on a system where SecureBoot is disabled and enable it afterwards, it would not boot, complaining about an unsigned loader.
