I'm having trouble understanding your problem because you seem to misuse some terminology.
Specifically, category is a taxonomy made up of categories, which are terms. Likewise, a custom taxonomy such as "fruit" has terms such as "apple" and "pear". We're trying as hard to sever the default taxonomies (category, post_tag) from core and make them work more like any other registered taxonomy. (Partially achieved in 3.0.) If you're possibly referring to the Uncategorized category, I think there's a ticket somewhere to actually remove that, as it is largely seen as a limitation, but one issue is that themes depend on it (such that they assume on exists).
