The Dispute Resolution Agreement is dated April 10, 2006. That is when it was final, but even taking that date, you should be ready to go with construction on the day after Labor Day. WHen I said no stores during the summer, I meant this summer in order to be able to meet the october 2007 deadline, which I think is very difficult to do. Stop picking apart things. What is at issue is that Partners did not, and obviously cannot, live up to the DRA with regard to the 5th Ave pavillion, and I suspect most of the other elements as well.
