Now let's look at these out of Sunshine items:
I. Litigation - I take it that the other party to the litigation will 
not be present at this meeting, unless it's a personnel matter; i.e. 
you're trying to head off litigation. Otherwise, the public should 
not be the only party involved who is not present.
A. Metropolitan Hotel - since when is "scattered sites issues" an 
exemption under the sunshine law? Unless, the city is considering 
purchasing the property, in which case the sellers cannot be present.
B. Property Acquisition: ok, comes under sunshine law exemption, 
whereby the city intends to buy property and doesn't want to inflate 
the price by showing its interest. So the seller or his 
representative better not be there, since the intent of the law is to 
hide the city's interest as a purchaser.
UEZ Board Appointment Recommendations: Are these staff jobs? If not, 
open the doors.
A. Steinbach parking agreement - if the city's renegotiating this, 
the public has the right to represent its interests, which are 
considerable. Again, if Steinbach or designee is present, the public 
should be as well.
B. Ejection Pump Issue - why is this exempt?
C. Waterfront Height -BBP Analysis - and the exemption is??? The 
Waterfront Redevelopment Agreement was passed into law. Amendments to 
laws must be discussed before the public - not presented once the 
matter has already been decided, in order to legally vote them into 
law.
I would be very interested to hear Mr. Fred Raffetto's responses to 
these questions, if you would be so kind as to pass this email along 
to our city attorney Mr. Keady.
