The Department of Consumer Affairs announced the new rule yesterday, along with numerous safety and permit requirements that also entail getting approvals from the Buildings Department and the Fire Department. Fueled by natural gas, not propane, the heating elements will be mounted on 93-inch poles and radiate heat downward. The number of heaters used will depend on the size of the cafe. They would be removed at night by employes who have qualified for "certificates of fitness" from the FDNY. Robert Bookman, a spokesman for the New York Nightlife Association, said the sidewalk cafes that choose to install the heaters probably will not stay open in the colder winter months from December through March. Among the attractions of sidewalk cafes is that smoking sections are permitted. That's not expected to be altered by the use of gas heaters. Yahoo!
