Actually, taking another look at the glayer code, I now remember that 
zoom can be caused by things other than "pinch" which are not patented. 
So I changed the patch to just not test for multitouch zoom when that 
config value is set to false.

Btw, I don't know if easily changed config values are enough for not 
infringing patents. Many projects compile out code for these reasons. I 
guess in this case it's ok, because if there'll be a patent it'll be 
about the usability and not the implementation ("algorithm"), but 
consulting a lawyer, in my point of view, is still a good idea.
