After Media, NGOs, Nepal government now targets laborers


After imposing restrictions on media and non-governmental organisations, 
the State is now planning to impose similar control over the laborers. 
Preparations are reportedly well under way for the amendment of the 
existing Labor Act and the new rule may come any time in the form of yet 
another ordinance following Feb 1 takeover.

The amended act is most likely to give maximum flexibility to the 
employer in ascertaining the mode of recruitment (on temporary or 
daily-wage basis) and there will possibly be no provision of permanent 
status to workers, say the trade union sources.

The amendment is also likely to free the employers from having to give 
any facilities to the workers except minimum wages and indirectly 
recruit them through contractors, along with the right to transfer them 
anywhere, and for any type of work.

The government began discussions with the trade unions in this 
connection on September 29.

"The trade union representatives walked out of the final meeting held on 
November 13 with a note of dissent," said Bishnu Rimal, Vice President 
of the General Federation of Nepalese Trade Unions. He said the 
government is also likely to bar the labor organisations to appeal if 
not satisfied with the final decision on the case currently under 
consideration at the Labor Court.

Laborers said such amendment in the act would breach the past agreement 
between the work providers and unions, which has the provisions like 
introducing law that ascertains minimum wage and guaranteeing the 
fundamental rights declared by International Labor Organisation.
The representatives of the World Bank are due to arrive in Kathmandu on 
Thursday to look into the amended version of the act, which the 
government is preparing to promulgate shortly.

The World Bank and International Labor Organisation have been stressing 
on treatment of workers as per the international labor acts.
