It was bound to happen, as it's being used for film and music sharing as well as legitimate uses. I can't see it succeeding in Europe, as it is just the agent, and it is the use that can be illegal. It would be like suing the Post Office for carrying messages posted by criminals. In USA, of course, common sense does not prevail.
