Despite our wish that it were otherwise, none of this
OGL stuff makes any difference to a significant amount
of end users. Thus, there is no actual market force
compelling openness or clarity. 

Frankly, the evidence is that 9 out of 10 users dont
know what d20 is let alone the OGL. And those that do,
have no clue whether an OGC designation is clear or
not. So by the time you get down to people who know
what d20 is, then of those who know what the OGL is,
then of those who know what OGC is, then of those who
know what is or is not a proper or clear OGC
designation, then of those who care you are down to
such a tiny group that it is irrelevant.

I know you see people here and on ENWorld saying "I
wont buy it if it isnt OGC" but that is, unfortunatly,
a vocal but entirely irrelevant minority.

What that means is publishers must essentially police
themselves, since there is no real market force
driving compliance or openness.
