Just because I'm missing the usual vigorous verbal interplay, I thought
I'd throw out a question I already know the answer to.  Knowing the
answer sometimes isn't enough though; at this point I'm more interested
in the details and exposition of the answer than the answer itself.

The basic question is this: can I publish a product that uses a
Vitality/Wound system?  

I know the simple answer is, "No".  Therefore I will rephrase it thus:
Has anyone managed to develop a VP/WP system that is functionally
compatible with the base d20 or d20 Modern SRDs and has been released as
OGC and is not in violation of WoTC's copyrights; and, if not, does
anyone have any feedback on whether or not such a system could be
designed?

To follow up on that, would using language such as "If you use Vitality
& Wounds in your campaign, adjust character stats by X, monster stats by
Y, and weapon damage by Z" constitute a violation?

This actually has become a point of discussion with myself and my
collaborators, and I think it's time to heed the voices of experience.
