I know the simple answer is, "No". Therefore I will rephrase it thus:
Has anyone managed to develop a VP/WP system that is functionally
compatible with the base d20 or d20 Modern SRDs and has been released as
OGC and is not in violation of WoTC's copyrights; and, if not, does
anyone have any feedback on whether or not such a system could be
designed?

I believe that Brad Thompson did such a system.
Also, you could replace "wound points" with "Constitution Points" and let Hit points stay hit points, and it'd be easy enough to adapt it. (Plus it'd make psionic combat a bit nastier.) Seems a bit more elegant way to do the whole "hit points don't draw blood" thing, IMO.

To follow up on that, would using language such as "If you use Vitality
& Wounds in your campaign, adjust character stats by X, monster stats by
Y, and weapon damage by Z" constitute a violation?

Maybe. Maybe you could just re-do it the same way that the expereince chart can be changed--label the variants, but don't tell people what to do with them.

This actually has become a point of discussion with myself and my
collaborators, and I think it's time to heed the voices of experience.

What! You have collaborators? Aw, man. Maybe I should just get a "permanently poor" tattoo on my forehead or something...
