Greetings!
Thank  you to the residents of Asbury Park for your perseverance and ability to 
reach  out and assist each other during last week’s Blizzard. Together, we 
faced 
many  challenges and experienced several frustrations. However, the spirit of  
cooperation and concern for each other was nothing less than  remarkable.
I  would also like to thank the residents who attended last evening’s Council  
Meeting. They shared their experiences, concerns, frustrations and ideas for  
improving our city’s emergency response operations. There are indeed many  
lessons to be learned and improvements to be made. Their proactive involvement  
was very helpful and their ideas will most certainly be incorporated as we move 
 
forward.
The  following activities are currently underway: 
1)  We are continuing our snow  plowing and removal efforts along major 
streets and avenues. This includes  widening as well as actually removing the 
snow. We ask your patience and  assistance as this may require street closures 
and redirecting  traffic;
2)  Reviewing and implementing  lessons learned from the previous Blizzard. 
There are some immediate actions  which have been taken and some long term 
solutions that we are working on  implementing. We are updating our 
comprehensive plan (with suggested  improvements) which will be communicated to 
residents very soon;
3)  Preparing for the upcoming storm  on Friday/Saturday. The weather 
service has predicted a new winter storm which  will arrive in our area on 
Friday. We have been working on repairs to our  plowing vehicles, restocking 
supplies, and preparing crews for activation. The  city will continue to 
provide 
updated information through CODE RED ALERTS, City  Website, Email, Facebook & 
local Media outlets. Please refer to the contact  information below to access 
these information avenues.
This  week trash pick-up has returned to the regular schedule. Recycling will 
be  
picked-up today and tomorrow and will return to regular schedule next week.  
This week, both have been occurring  later in the day as our DPW crews are 
working on both snow operations and  trash/recycling pick-up. 

This  past week, residents played an important role in information sharing 
throughout  the community. I ask for your assistance again, with sharing this 
information  with your neighbors and e-groups. Improving communications was at 
the top of  everyone’s list and we need your help to ensure that everyone has 
access to the  information resources listed below.

Warning, I am about to get wonky.  I've tried to define my mortgagese,
but if anyone has a question please let me know.

A BPO or drive by appraisal is used primarily for refinances with a
high loan to value (i.e. a $100K loan on a $300K property) or when
there is a fairly recent appraisal in a stable or rising market.  They
can also be used in foreclosure situations to allow the owner to do a
short sale (sell for less than they owe because the property value has
decreased and the owner is behind on the mortgage).

Purchase appraisals in my experience are always done by an appraiser,
but I have only worked for and with banks.  Maybe some mortgage
companies do drive by's?  Sorry to honorable mortgage companies, but a
lot of them are shifty as they don't have much skin in the game.  

You're right about condos as a community though.  Appraisers use
comparable sales of like properties to determine value.  My house on
1st Ave was comped with other single family houses on the northwest
side of AP.  It was a rehab loan so it was comped with other
distressed properties first then given a projected repaired value by
comping it with other nice homes in the same area.  There is wiggle
room here too, but most appraisers I have worked with are on the up
and up.  Again, having worked for and with banks.  There is a
preferred appraiser for Asbury Park.  I can't remember the company,
but they were local and very good at assigning true value.  BNY wanted
to lend in AP.  Lenders do work to make loans where they want or need to.

Anyhow, You can't appraise a single family home comparing it to a
condo or a multi and vice versa.

I'm not sure how North Beach is operating their sales and financing. 
They could have a variance to let them sell individually or sales
could be mostly cash or they might have a portfolio lender who is
willing to take on the risk.  I don't see any ads for financing on
their site.  So I can only guess.  

It is easy enough to find out though.  Go to their sales office and
ask them about financing.

-I am not quibbling on the definition of reality.  It is the way that
things actually exist.  The reason I said I was writing as a counselor
is because human beings see reality through perception.  That isn't an
argument.  It simply is something that needs to be seen when dealing
with human behavior.  Arguing with someone who is optimistic about the
same reality that another is pessimistic about is not going to change
their view.  We all see through the prism of our own perception.  

It is interesting that your definition included reality TV.  Is that
truly reality or is it a manipulated reality?  A great example of
perception's role in reality.

I stand by my own perception that Newbee's very strong opinion of
local AP centered politics and happenings does not fit his or her
self-description. I also personally take the posts of those who put
their real name after their perceptions much more seriously than those
who do not.

I am not an appraiser.  I know that banks appraisals determine value
using a form called the Uniform Residential Appraisal Report (URAR).

URAR has always asked questions about one unit housing trends and you
will see there is a box asking if the house is in a high demand or
over supplied area.  
Condos as a whole can be difficult to mortgage if a large percentage
is not owner occupied.  Fannie, Freddie and FHA require that 51%+ of
the condo units be owner occupied in order to obtain a mortgage.  This
can be a big problem if people buy into a complex, over time it
becomes mostly rentals and cannot be conventionally refinanced.
So, yes empty condo units can have an adverse effect on both value and
ability to mortgage.

Putting on my counseling hat here.  Reality is always subject to
perception.  Reality being the way things actually exist is always
influenced by individual perception.  Perception being a sensory
experience of the world around us.   Perception is based on individual
experience.  We can be in the same reality without the same perception
of that existence.  It makes human beings very interesting.  
Sooo...Everyone is entitled to their perceptions.

The reality is the economy sucks and how you perceive the depth of
that depends on individual experience.  AKA - A recession is when your
neighbor is out of work, a depression is when you're out of work.

BTW, I remain perplexed by Newbee.  S/he knows a lot of minutia for a
visitor who came, had a great time, but wondered when the boardwalk
would be finished.  Newbee, if you really live here and care then just
post.  Your perceptions are much more valid when honestly put forth. 
Otherwise, I just find myself pondering who you really are.

Jack,
I guess I don't see the boardwalk through the same eyes.  I never
expect boardwalks to be grand.  I have lots of very happy boardwalk
memories and none were fancy.  I grew up in Point Pleasant and worked
on that boardwalk.  We rolled down the garage doors over the stands to
lock up at night.  Most people think Point Pleasant is and has always
been a very nice place.  
I have also had similar experiences regarding the Bruce - AP
connection.  I was in Ireland in the summer of 1980 when I told people
where I was from no one had heard of Pt Pl, so I'd move up to AP next.
 I usually got a Bruce Springsteen response or even a do you know
Bruce question.  Ireland is a lot smaller than the US.  They figured
he lived in the next village LOL.  If AP didn't work I had to say I
was near NYC.
I have seen many Bruce fans around the city in the last few years and
they seem very pleased with AP. I've taken a lot of pictures for 
people standing under the Greetings from Asbury Park lights on CH.  It
wasn't always like this.  I remember buying a book back in the late
80's for a Bruce loving boyfriend.  The book described AP as a
desolate place with an empty beach on the 4th of July.  Not anymore.
As for a Bruce display, why does it have to be done by the city?  Any
local business could either borrow or buy Bruce memorabilia and have a
display.  Just a thought.  
Hell if Bruce wants to lend All AHEAD some stuff I'd use it as a
fundraiser for creating and maintaining homeownership in the city. I'm
not sure how, but I'd figure out some way to make money for the cause.
 Bruce have your people call my people.

Jeffrey Haveson from Plan B did a great job on an Oprah webcast last
night.  Jeffrey spoke to Suze Orman from Plan B with Asbury Park
prominently displayed and mentioned several times.  He was concerned
with Suze's recommendation that people not eat out for a month and the
effect that will have on small restaurants.

Behind on your mortgage, no equity, not enough income, etc.  Call Hope 
Now 888-995-HOPE.  One of the counselors they refer you to may have 
more options than I do.

Over 62, you can get a reverse mortgage for repairs and credit won't 
matter.  Equity is needed, but credit is not.  

Sorry, I made such a messy post.  I learned that hitting my arrow keys

HUD doesn't give grants to individuals.  It gives grants to non-profits 
and municipalities.  I know AP has HUD funding for housing.  Hazel 
Samuels runs the department and I believe it is Rosetta that is in 
charge of the program.  
Coastal Habitat for Humanity runs a program that helps people fix up 
their homes.  If you qualify, they will come to your house and do minor 
repairs.  If you are able then you will have to help them.  The city 
uses this program and has applications available in the Dept. of 
Housing.  The program operates in warmer weather.

Most of these programs are for low income homeowners.  People who are 
above the income limit may have to turn to loans.  Loans require equity 
and can be tougher to come by these days.  There are 203K loans from 
FHA which allow you to refinance the property at its after-repaired 
value.  The loan includes funds for the repairs or improvements and it 
requires you to make the repairs in a set amount of time.  You have to 
use a general contractor to make the repairs most of the time.  I 
worked with Jim Ragan at Bank of NY.  He's the 203K guru.  1913

[AsburyPark] Re: Lost 3 Businesses

I stopped by Wish You Were Here the week before Christmas to get my son 
stocking stuffers.  He loves their candy counter especially the candy 
cigarettes.  Cathy has a sign on the counter that the store is for 
sale.  I think is so sad.  She's been there for a long time and she is 
always open.  Not every store on Cookman can share that fact.  I don't 
work downtown anymore or I'd go there more.  The only way to keep 
businesses open is to visit them.  Wish You Were Here isn't expensive.  
They have really unique items and they sell retro candy (the 
aforementioned cigs, Clark's teaberry gum, pop rocks, fun dip, mary 
janes, etc.).  

I remember when Cookman was so dead that I expected to see tumbleweeds 
blowing down the street.  It could happen again.  Anything can happen 
again.

The Office of the Public Defender is for people facing criminal charges who 
cannot afford legal representation. If you feel you fit in that definition then 
call them (732) 308-4320.   You can also try Monmouth Ocean Legal Services 
908-776-7733.  Legal Aid sometimes has sliding scale fees for people who have 
assets.

Mario,
I am also a Linkedin fan and a Facebook one.  I use Linkedin to stay in 
touch with work colleagues.  It helped me get my most recent job by 
keeping me on the radar of people I worked with in NYC when I was at 
the bank.  Facebook has put me back in touch with people I haven't 
talked to in decades not because I didn' want to, but because life got 
busy.  It also keeps me in touch with my ginormous family including the 
ones in Ireland.  Give it a shot.  Even if you aren't looking for work 
it would probably be a good thing for some of your former students to 
find you for job references.

I call them God's waiting room.  Snarky?  Yes.  They are affordable 
though and someone takes care of your property and there's a bus to 
take you to fabulous places like Brick Plaza and Atlantic City.  Some 
are now filled with mostly working people in their 50's and 60's.  
Retiring is hard to do.

BNY picked out a building to rent on Grand, hired an architect to 
draw up plans which included a shower/locker room so visiting offices 
could go to the beach.  

Unfortunately, the building's owner was in my opinion playing games 
with the bank.  I can guess at his motives, but that is all they are -
 guesses.  We were held up for quite some time and we started looking 
for another spot.  By then, Chase bought BNY's retail and mortgage 
division.  If we'd moved right away there might be a Chase branch 
there now.

I am familiar with the Villages.  My parents looked into them.  The 
plan is appealing to some people I guess.  The community development 
side of me hates, hates, hates retirement communities.  I think they 
are in some violation of the Fair Housing Act as they discriminate 
against people with children.  I still think that an affordable 
community is one with a balance of citizens.  

I don't expect any large business to relocate entirely to AP.  You're 
right.  It is too small to house a corporate headquarters.  It could 
hold several satellite offices.  The BNY offices in Manasquan were 
only 2 floors.  We would have had more room in AP and could have had 
a branch on the ground floor.  Renovations were just a part of the 
cost analysis.  They were looking at the long-term tax savings from 
being in the UEZ and hiring locally.  The costs were worth the 
benefits.  BNY was a fairly conservative company, but they were 
forward thinking.  That's probably why they sold retail and mortgage 
before the fiasco. 

I still think the city could lure in more variety of businesses.  
Have you ever been to Newburgh, NY?  That is where BNY moved their 
major lending operations. The office was in a "dead" industrial 
zone.  They'd never leave Wall Street.  One Wall was our executive 
office in the house that Hamilton built.  They were happy to move

Mario,
The article is interesting and could be valid except we are missing a 
very necessary component unless the childless households are also 
retired.  We do not have enough local industry in Asbury Park to 
support all of its residents.  There are very few large scale walk-to 
jobs.  Back in the day, Asbury Park had the phone company and the gas 
company.  We do not have those types of jobs anymore.  

I would love to live and work in the same city.  I would love to stop 
driving except when absolutely necessary.  In order to create that 
type of city, we need to lure larger employers here.  We have the 
buildings.  We have the trains and we could have better buses or an 
in-city transit system.  

For a city to be healthy, it needs to have a balance of incomes.  
There needs to be affordable housing and reliable affordable 
transportation for the lower income workers.  It really does need a 
good school system for the middle and lower income workers because 
otherwise it won't have balance in the distribution of the 
population.

AP has a lot going for it especially location and the small town 
disguised as a city aspect.  It is on a major transit route.  It has 
one industry in tourism and entertainment.  I also has small 
businesses and local professionals like Realtors, lawyers, doctors, 
etc.  It does have the state office building too.  That is definitely 
a half-full glass.  If we want to fill the glass to the top then we 
need to attract larger businesses.  That isn't impossible.  There are 
great tax benefits for a business to open AP facilities.  I looked 
into doing that when I was at Bank of NY.  We were going to relocate 
our Manasquan operations office and our Bradley Beach branch to Grand 
Ave.  We did that in Newburgh, NY and it made sense to do the same 
here.  I don't know too much about schools so I'll leave that up to 
those who do.  I do know communities.  They work best when there is a 
mix.  That is especially true for smaller cities.  I think the glass 
could fill up.

I rent a house I own in AP for $1600 per month plus utilities. It's a 3 
bedroom/2 bath.  I don't think there are very many 2 bedroom, single 
family houses in AP.  If you google "house for rent Asbury Park, NJ" 
you will get more information.

I think that NJ is the only state that has beach badges.  At least, 
I've never encountered badges anywhere else.  The law in NJ says, all 
tidal lands and water from the high water mark seaward is public. Access
may occasionally be restricted based on private ownership, shore 
armoring (bulkheads, groins, seawalls) and public safety issues.

There's an advocacy group called Citizens Right to Access Beaches 
(CRAB) that was founded when Point Beach's only municipally owned 
public access beach was developed into a supposedly upscale private 
community.  I say supposedly because it is so damn ugly.  Anyway, the 
upscale community claimed sole access to the beach and didn't want the 
great unwashed coming through to use "their" beach.  CRAB doesn't seem 
to want free beaches.  They don't want to lose the ability to get to 
the beach at all.  FYI - There's also history here.  Until about 25 
years ago, the Ocean county shore towns of Bay Head and Mantoloking did 
not allow non-residents on their beach.  I grew up within walking 
distance of the Bay Head beach, but I lived in Point Boro.  We weren't 
allowed on their beach during guarded hours.   A NJ supreme court 
decision changed that (Matthews v. Bay Head Improvement Association).  
Anyone can buy a badge in beautiful Bay Head now.  It's a bitch to park 
and you can't get a soda or use a bathroom, but you can go.  Maybe you 
can make friends with someone who owns a house and they'll let you use 
their bathroom.  

So I looked up Matthews v. Bay Head Improvement Association and here is 
the decision.  Apparently Sophie can sit on the dry sand.

In New Jersey the courts have recognized the public trust doctrine to 
give all residents access to the state's public trust land. Recently, 
the courts expanded the public's right to include use of the dry-sand 
beach (Matthew v. Bay Head Improvement Association, 471 A. 2d 355 
(1984)). 

In that case, town residents sued the beach association and beachfront 
property owners asserting that defendants denied public its right of 
access to public trust lands on the beaches in the municipality and its 
right to use private property fronting on the ocean incidental to 
public's right under the public trust doctrine. The court held the 
public must be given both access to and use of privately owned dry sand 
areas as reasonably necessary under the public trust doctrine. The 
court noted that it did not need to rely on legal theories used in 
other jurisdictions such as prescriptive easements or customary law. 
Rather it decided to simply modify the public trust doctrine to reflect 
the reality of the times that people need to use the dry-sand beach to 
enjoy the area below the high water mark. The court stated that "[a]
rchaic judicial responses are not an answer to a modern social problem. 
Rather, we perceive the public trust doctrine not to be "fixed or 
static," but one to "be molded and extended to meet changing conditions 
and needs of the public it was created to benefit. "

In my job, I have to visit counseling agencies in all 5 boroughs.  I 
use Hopstop NYC to find out which trains go from where to where 
www.hopstop.com  You put in the time and place you're leaving from and 
where you want to go.  It gives you the trains and even walking 
directions from the station with a picture.  That helps a lot when 
you're in East Flatbush.

A year ago, construction ground to a halt on luxury oceanfront 
condominiums in Asbury Park that had promised to usher in a revival 
of a city devastated by race riots, political corruption and economic 
woes. 

A harbinger of the national real estate disaster that was to come, 
the Esperanza should have been near completion today, but instead the 
same three stories stand bleakly against the backdrop of a beachfront 
awaiting tourists. 

The poured-concrete foundation hasn't changed since Hoboken-based 
Metro Homes gave the stop-work order a year ago Sunday, but the 
company's president insists he is pressing on with plans for a scaled-
down version of the high rise. He said work could resume by next 
summer. 

"Our project is far from dead," said Metro Homes president Dean 
Geibel. "We're basically creating a whole new building." 

Held hostage for two decades by ups and downs of the housing market, 
the city is trying to buck current economic trends and continues to 
rebuild around the building that takes its name from the Spanish word 
for "hope." 

"Surprisingly enough, we're still bringing business into Asbury 
Park," said Tom Gilmour, director of commerce for the city. "A lot of 
people who wanted to come here got turned off by the high prices and 
are back." 

Gilmour said Asbury Park has had 17 new storefronts, including seven 
new restaurants, open on the boardwalk since May. Another seven 
businesses opened downtown during that same time. 

A year ago, retail space in the city's downtown was slightly less 
than half full. Now it's about 60 percent occupied, he estimated. 
Last year, the boardwalk had a nearly 70 percent vacancy rate. Now 
it's maxed out, Gilmour said. 

Sales of condominiums at two new complexes bookending the oceanfront 
redevelopment zone had stalled after the real estate bubble drove 
prices skyward. Interest in those developments, Wesley Grove and 
North Beach, has resumed now that prices have dipped, Gilmour said. 

Reacting to the slowdown in the real estate market, City Manager 
Terence Reidy said, many developers have proposed converting space 
once designated residential into office. Others are considering 
creating interim parking lots until the market rebounds, he said. 

"The good thing is no one's come to me and said, 'I'm pulling out,'" 
Reidy said. 

That includes Metro Homes. Only three of the 16 stories had been 
built before the developer suspended work on the $100 million 
project. The city last year threatened to go to court to compel the 
developer to keep working but has since softened its stance. 

Talks with Madison Marquette, the developer of the boardwalk and the 
new owner of the Wesley Grove condos, about entering a joint venture 
to resurrect the Esperanza proved fruitless, Geibel said. 

With a new partner -- who Geibel declined to name -- Metro Homes is 
redesigning the project to shave expenses. Instead of having two 
towers separated by an outdoor pool, the building will have one L-
shaped tower wrapped partially around the outdoor pool to the north 
and west. It will get a new name -- something that suggests the 
ocean, Geibel said. 

The new design will mean many of the 224 units have an oceanfront 
view, he said. But some of the amenities, such as an upscale 
restaurant, will be left on the drawing room floor, he said. 

Metro Homes had contracts for 70 of the units, which sold for between 
$400,000 and $2.3 million, before construction stopped. Geibel said 
all the deposits have been returned but some original buyers, 
including singer John Oates, are interested in buying into the new 
building. 

John Lidestri, an importer from Ringwood, used his returned deposit 
to help buy a restored seven-bedroom historic home within walking 
distance from the beach in Asbury Park. In retrospect, this was a 
better deal, because he got a bigger place for the nearly $1 million 
he was prepared to pay for the condo. And his taxes will be cheaper, 
said the 39-year-old father of two. 

"Obviously it would be great for the community to see it come to 
fruition," he said. "It would definitely enhance the image of the 
waterfront rather than to have a stalled construction site there."

Keady also has his own blog and his own Yahoo Group.  The notices that 
he puts on this board he also sends via his own.  It is possible that 
Nancy Shields subscribes to all three.  I got the notification from 
Councilman Keady's yahoo group in my work email before I read about it 
anywhere else.
That said, it doesn't mean that I don't have hopes that you're work is 
being acknowledged.

Thanks Michael!  I owe my knowledge to Ed Johnson.  I remembered his 
being appointed, but the dates were fuzzy.  I googled and discovered 
that Ed has a great web site http://www.edjohnson.org/ that gave the 
dates along with his background.

I really like his "This is what I said" link that gives his opinions 
and actions on different issues.

Ed Johnson was appointed to the council when Kate Melina resigned. That 
was in January 2005 and Ed was elected in the May 2005 election.  I 
would guess that a similar process is going to happen.

Hi Jack,

I like Facebook a lot.  It helps me stay in touch with a lot of 
people and its gotten me back in touch with even more.  I now know 
more about people I went to High School with than I did even in HS.  
I don't know if the groups ever become very active for discussions.  
I see your Greetings from Asbury Park group has a lot of members now 
(including Nils Lofgren and Roy Bittan).  

I think the larger point is that the anonymity that you can allow in 
Yahoo groups breeds behaviors that you don't see with people who know 
one another.  How about we set a regular date for group members to 
socialize in person?  We could do it in a local place, meet for 
drinks say once a month and get to know each other. 

I find email to be the worst form of communication ever made.  It's 
way too easy to "hear" a tone in the writer's voice that is not as it 
was intended.  I moderate two groups for work and I see a lot more 
listening and weighing of opposing opinions when my group members 
know and respect one another than when they are new and feeling 
anonymous.  

So who wants to meet and have a drink?

Werner,
Please note that I used the word "curious" not "offensive".  His 
posts state that he his someone who visited and had a good time yet 
he is deeply concerned about dates and deadlines.  I am going to use 
he because it is the pronoun of unknown in the English language.  I 
use curious in the context of deviating from the usual or expected.  
There's a huge jump from curious to offensive.  His posts do not 
offend me at all.  I just find it all very curious.

There is a Section 8 homeownership voucher program which allows S8 
recipients to use their voucher towards a mortgage rather than rent.  
It has had varying success.  Perth Amboy has done very well with it.  
To date, the Asbury Park Housing Authority doesn't participate in the 
program.  I'd love to see them do that.  Hazel Samuels (AP Director of 
housing and Community Development) has been a strong supporter of the 
program too.  Under S8 homeownership, the buyer does need to meet 
credit requirements.  The homeowner gets the voucher for the first 15 
years of the mortgage and the voucher can be up to 70% of the loan.  
The Housing Authority remains involved and is notified if the homeowner 
misses a payment so that they can intervene.  It's an excellent 
program, but unfortunately it is underutilized and faces a lot of 
prejudices.

has been the hardest hit state in the nation.  Boulder City, NV (pop 
12,567) has 78.  A number very close to Asbury Park's.  

This is very serious stuff and no one is available full-time to help 
the AP residents facing foreclosure.  It kills me to have to work in 
NYC when I keep seeing the AP stats go up.  

Tommy, I doubt you're pro-foreclosure.  God!  I hope no one is pro-
foreclosure.  I am only reporting what I see.  If it were 70 rather 
than 80 I guess it would be better for those 10 families (except 
they're facing some other kind of legal action).

Right now the city of Asbury Park shows 80 lis pendens meaning 80 
homeowners have been served with a notice of foreclosure.  I don't 
think foreclosure is partisan though that is one piece of information 
that we are not yet required to collect on our clients.  Maybe 
someday?  
Foreclosure will hit lower income people first and often hardest 
because of so many reasons, but mostly because it is harder to save and 
to get out from under when you're income is low.  Higher income 
families are by no means immune though.  They often spend based upon 
future earnings and when those future earning disappear they have no 
safety net.  There are 35 lis pendens in Middletown, 15 in Colts Neck 
and 5 in Allenhurst.  Of course, the properties in some of these towns 
range up to over the $1m mark.  

The sad truth is that foreclosure effects everyone.  It lowers property 
values and decimates neighborhoods.  It's a no win situation for 
everyone involved.  While a lot of foreclosures will hit a struggling 
community hard, wealthier communities are in no way immune.  Wall 
Street job losses are already showing in the bedroom communities like 
Middletown and Aberdeen with more short sales and foreclosures.

[AsburyPark] Chase also is holding off on foreclosures

Less money is lost by the lender in a loan modification/short refinance 
than in any other type of loss mitigation option because most of the 
middle men are cut out of the transaction.  

It won't work for everyone, but it is good to know about if you're

Maybe the person in charge of coordinating the city's participation has 
volunteered his/her time in this capacity.  Perhaps there is a 
corporate sponsor or sponsors?  I doubt that this celebration or any 
others that bring the community or parts of the community together will 
break the AP bank.  I own a house there, pay my property taxes and feel 
very comfortable to have a portion of them go towards community 
celebrations.

Why?  Celebration of holidays (secular, national, religious) may bring 
people into the city that otherwise wouldn't have come.  Belmar puts on 
a huge Saint Patrick's day parade.  Toms River has people come from all 
over to their Halloween parade. 
 
According to the NJ Living site:
Each year, in the month of December, the city of Asbury Park presents 
an annual Kwanzaa Celebration honoring the past, present and future of 
ita African American community.  This special event includes 
performance groups and guest speakers.

Sorry, I really don't have time to go through every post and find 
evidence.  If I made a mistake then I apologize.  It may have been a 
perception. I can admit that I find your posts very stubborn and 
frustrating.  I noticed the tendency to paint all I say in a previous 
thread as hypocritical.  If my words are hypocritical then I must be a 
hypocrite.  I told you that off the group and I meant it.  

You like to remind us to stick to policy yet all I ever see is vitriol 
about Obama's life.  McCain lost me when he picked Palin.  Before that 
I wouldn't have voted for him, but I could live with him.

Please give my post another read.  I meant that it was the same old 
use of a prejudice to scare voters.  The prejudicial stereotype being 
that all black people, regardless of age, are working the system.   
The truth being that many POOR people, regardless of race have to 
become quite good at working the system because the system sucks.  
The truth is that there are more white people receiving public 
assistance than blacks or latinos.  It is a economic issue.  If 
you're children are hungry then you will figure out a way to work the 
system and I know a lot of people who will help you to do it too.  

There is no argument from me on the history of racial prejudice.  It 
is very real, it has always existed and it will continue to exist as 
long as people keep espousing it. That is the entire point of my 
post.  Prejudice does exists and it is being used to incite fear by 
if not John Sidney McCain III then by those who are behind him.

Too bad it is full of stretches that would make a Yogi proud.  
He isn't a Muslim.  That's been disproven, but he is an ethnic Muslim 
and as a 9 year old he proclaimed himself a Muslim when he registered 
himself for a private school.  DNA testing for all future 
candidates!  McCain has his roots in the UK.  I bet somewhere in his 
lineage there were Witches!!  Almost all pre-Christian Celts 
practiced some form of Wicca.

Perhaps I am not being clear.  To disagree with his economic policy 
is the correct thing to do in a political race.  To woof on and on

upon preconceived notions of someone's race, ethnicity, gender, 
sexuality, size, etc.  That is prejudice.  It like I asked last week -

the royal consort.  That is an intimate relatonship.  Sitting on a 
board is not very intimate.  I have been on boards where I can barely 
remember the names of many of the other members.  Socialism is 
another big old scary word used to frighten older voters because it 
is often confused with the more extreme fascism.  Are we scared of 
England? Australia? Canada?  No those are our friends and they are to 
different degrees - socialists (shock!).  That doesn't make Obama 
one.  It is just to scare.  I also find it racist because it harkens 
back to the old black people playing the system.  POOR people often 
do become very good at playing the system.  It's wrong to categorize 
all people of any group that way.  Which leads to the final definition
Prejudice - bias: a partiality that prevents objective consideration 
of an issue or situation 

The whole thing reeks of prejudice and I don't say that lightly or 
often.  Wouldn't it be great if everyone admitted our biases and 
examined issues objectively.  I hope that many will on election day.

Jack,
I saw it on TV too.  I also saw the guy with the Curious George doll 
labeled "Obama".  There was also one where someone yelled "kill him" 
during a Palin rally.  I think McCain started to feel his conscious 
bothering him over these things.  Inciting people to feel they can be 
openly hateful is dangerous.  It brings out "crowd psychology" where 
people start to feel like everyone else in the group feels like they do 
and it is okay to act out.  When its about hating a presidential 
candidate that is scary.

Talk about changing the topics?  I started out with a post on equal 
protection under the law.  A view I happen to share with that famous 
left wing nut, Sandra Day O'Connor; ).  

I still take offense at the bathhouse comment.  Everyone knows who 
was having sex in the bathhouses.  Cover it with flowers and it still 
smells.  I am amazed you could love anyone with AIDS in the 80's and 
survive it to defend Reagan.  I didn't say I loved someone to have a 
higher moral authority.  I simply assumed no one who had been through 
the hell of that time would or could write what you wrote.  That was 
giving you the benefit of the doubt.

Let's recall the popularity of Reagan.  What if he had spoken up and 
encouraged, supported, demanded funding for this strange new 
disease?  I think that would have made a huge difference.  No, he 
wasn't a doctor.  He was a President.  He wasn't a physicist either, 
but that didn't stop him from pushing billions into Star Wars.  This 
is from Dutch, by Edmund Morris, p.457-458 
Reagan would remain unconcerned by AIDS at least until the death of 
Rock Hudson in 1985. My research has him finding it a fit subject for 
humor as late as 1986 and five months after that waxing biblical in 
his opinion that "maybe the Lord brought down this plague" 
because "illicit sex is against the Ten Commandments." 
To be fair, he made no moral distinction between homosexuality, 
heterosexuality out of wedlock, or abortion on demand. All three were 
abhorred by God, in his opinion. The best that could be said about 
the first sin was that its consequence was perhaps a caution against 
the other two: 

"I think people were happier and better off when there wasn't the 
tremendous plague of single motherhood cases or abortions, the 
thousands & thousands & thousands that take place regularly now and 
whether it's going to take such a tragic thing as that disease. that 
horrible disease to return us to a sense of values that were very 
much a part of our generation." 

Reagan never said the word AIDS until 1987.  My friend was already 
gone.  Imagine if AZT had been available even a few years sooner?  
Imagine if one of his three Secretary's of Health and Human Services 
had pushed for a cure?  It wasn't until 1986, that Surgeon General C. 
Everett Koop wrote his intial report on AIDS and... Reagan fought him 
on his recommendation of prevention in sex education.  The man was a 
respected pediatrician.  Reagan may not have been a doctor, but that 
didn't stop him from fighting the advice of the one he'd chosen.

Judgmental religiousity is at play then and now. Remember the slogan 
of the ACT UP?  "Silence=Death" Reagan was silent and people did 
die.  For a man who wasn't a doctor, how come it is okay that he 
decided that AIDS would pass like the measles?

I will be back at work tomorrow so probably won't read anymore for 
awhile.  Anyway, I've had my say and we've really left Asbury Park.  
I still don't know what was so upsetting about equal protection under 
the law.  Maybe that's the scariest part of this whole thing.

Tommy, there is an old southern saying that fits you well "He likes 
to pick flyshit out of pepper".  Personalizing?  Yes.  You don't 
burst my bubble.  I have no bubble.  You like to twist people's 
words, but avoid answering a direct question.  I picked gay marriage 
as a topic of conservative fear inducing quotes because you jumped in 
that I was changing a topic by posting about gay marriage.  You said 
liberals did this to avoid other topics.  Okay!  I never did get your 
response to the original quotes about the 2006 proposed amendment.  
They clearly are trying to use fear as a political tool.  For all I 
know, Bush himself is gay.  It doesn't matter.  They are picking on 
the last permissible minority group in order to mobilize their base.  
How is that okay?

You never did say how it is okay.  I suspect that is because you know 
that it isn't and just don't like to ever admit to that.  

Clinton was wrong to sign DOMA.  Clinton was wrong about a lot of 
things.  I don't need or want to wholeheartedly support someone 
because they are members of a party.  I guess that is where we 
differ.

killed was reprehensible.  Bill Clinton has many failings, but his 
foundation is a great promoter and supporter of AIDS prevention.  
I choose to believe you are ignorant on this topic.  If you'd ever 
loved someone with AIDS you'd know what it was like.  HIV didn't only 
get spread in the bathhouses.  AIDS is a disease that is contracted by 
human beings.  It isn't exclusive to gay men.

Obama may not support marriage for gays.  He does support equal 
rights under civil unions.  McCain on the other hand supports 
legislation that takes away the right constitutionally

Obama has said a lot more.  He's appeared in debates on LOGO.  I 
don't want to be unfair to McCain here.  He hasn't overtly opposed 
rights to gays.  I will leave their words to speak for them.  

However, I never asked about the current presidential election.  I 
only asked about Conservatives.

I don't want rights that other people cannot have.  It feels 
unbalanced.  I think of Laurel Hester who fought to her dying breath 
to have her hard earned pension awarded to her partner.  

There is sometimes no excuse for the inexcusable.  

BTW, I admire some aspects of the original almost altruistic 
conservative movement.  Those old small government guys weren't 
trying to discriminate against any one group.  The Republicans of 
yore were the party of Lincoln.  If I lived, 150 years ago I would be 
a Republican.  I couldn't vote, but I'd be a Republican.  The 
original party founders must be looking down with horror at the 
current one.  I don't doubt that quite a few living ones are too.  
I've just read an interview with one - Christopher Buckley, the son 
of William F. Buckley, Jr.  I hope you're more Buckley than Bush.

I am sorry, but Elisabeth Hasselback getting death threats has what 
do with the original question?  A book about Howard Dean and angry 
pundits has what to do with the question?  As a liberal I will defend 
the right of free speech to Elisabeth and those who threaten her life 
are reprehensible.  I agree with my fellow liberal, Whoopi all the 
way.

Changing the subject back, let me use a clear example 
"Our policies should aim to strengthen families, not undermine them. 
And changing the definition of marriage would undermine the family

How?  Are my lesbian friends and their sons less a family than my 
straight friends are?  How does their marriage weaken mine?  Why 
would anyone even think that their marriage would be undermined by 
another family?

There is another solution.  Our country claims to have a separation 
of church and state yet we allow a religious institution the power of 
a legal institution - marriage.  The issue at hand has nothing to do 
with religion.  Marriage brings a whole host of legal protections and 
financial benefits such as:
* Lower taxes through joint deductions (sometimes married couples pay 
higher taxes too, but at least this is an option).
* A child born into a marriage is legally the child of both people.  
If one partner in a lesbian couple gives birth then her partner must 
adopt the baby.  Extra cost, extra time for something to go horriby 
wrong.  Sometimes a child born into a hetero marriage is not the 
child of the male partner right? 
* A single health insurance plan (gays who do receive domestic 
partner benefits are taxed on this perk ala John McCain's plan.  It 
is considered extra pay by the IRS. A spouse is not taxable),  
* Spouses don't pay estate tax. Gays often have to set up intricate 
estate planningto get the same protections that straight couples just 
have.  
*  I saw a post recently about an isurance agent offering life 
insurance to same sex partners.  Good idea, but of course anyone can 
be named the beneficiary on someone's life insurance.  Your gay 
partner will still have to pay taxes on the benefit.  If my husband 
dies, I won't have to pay any taxes.  
* Gifts between spouses are not subject to gift tax. Any gift over 
$12,000 between non-spouses is taxable.
* Marriage may offer financial protections in the case of divorce. 
* Social Security benefits go to the surviving spouse. 
* Property is more easily shared between married partners. Unmarried 
couples who jointly own a house can find themselves in a sticky 
situation if they split up, especially if only one person's name is 
on the title. The other person may have no claim to the property, 
even if he or she has invested significant amounts of money and labor.
* Unmarried partners who share a single bank account are not 
protected in a breakup.  All of the money could go to the person who 
makes the first withdrawal. Married couples - assets gained during 
the marriage are typically considered to be jointly owned. 

Those are just some of the legal protections offered through 
marriage.  NJ Civil Unions are protected under NJ law, but may not be 
recognized if a couple leaves the state.  There are no federal 
benefits from an NJ union.  Americans are supposed to all have equal 
protection under the law.  Apparently, this isn't true.  If you have 
the time or inclination read Sandra Day O'Connor's opinion from the 
striking down of sodomy laws - Lawrence v. Texas.

A solution - Make marriage a religious institution and civil unions a 
legal institution.  All couples, gay or straight, who want legal 
status enter into a civil union.  Any couple who wishes religious 
status can go to the faith-based institution of their choice and have 
a ceremony, sacrament, blessing.  Church and state are separated and 
equal protection under the law is offered.  I doubt this will play in 
Peoria anytime soon, but it is fair and removes the religious factor 
from the argument.

Thanks for the vote of confidence.  I don't live in AP so I can't run 
for council.  I do have a beautiful little house there.  I think of 
AP as my spiritual home and I miss it a lot now that I'm working in 
NYC.  

I do hope to get All AHEAD back up and running this year.  We need to 
hire someone with a lot of drive and energy to get steady funding 
coming in.  I did get a grant to get started again.  If anyone knows 
someone who might fit the bill have them email me their resume.  I 
can teach someone the ins and outs of lending and loss mitigation.  I 
can't teach someone how to have the passion for helping others.  If 
that is you or someone you know - Get in touch.  There's work to be 
done.  A lot of work.

Werner,
There are many resources out there for people that need home repairs.  
A lot are income based.  One that immediately comes to mind is Coastal 
Habitat for Humanity's "A Brush with Kindness".  I don't know if you'd 
qualify, but look into it www.coastalhabitat.org.  Habitat requires you 
to put sweat equity into the project.  Their services are free.

There are many different loans out there.  If you have credit issues, 
you may not qualify for a conventional loan though.  If you have a 
mortgage on the house, I would consider a refinance into a Rehab 
mortgage which would allow you to make all repairs with one loan.  
NJHMFA has one http://www.state.nj.us/dca/hmfa/consu/owners/refin/  So 
does Countrywide.  The VP of that department is Jim Ragan 
[EMAIL PROTECTED]   His office is local.  I think it's off of 
Rt 35 in Wall.  

If you're over 62, you could take a reverse mortgage to pay for the 
repairs.  

NJ Citizen Action has a home improvement counseling service.  I don't 
know how good it is at this point, but they certainly might have 
resources they could share with you www.njcitizenaction.org

That may be true, but according to Monmouth county lis pendens (notices 
of foreclosure) records, 68 properties have been put into foreclosure.  
It takes awhile from foreclosure to bank ownership and a lot can happen 
in between (deed-in-lieu, short sales, loan modification or just plain 
sale).  68 may not seem like a LOT, but do consider the size of AP.  I 
believe it is only 1.25 square miles.  We're averaging more than 5 
foreclosures per month.  That's a lot for such a small area and it's 
unfortunately just the beginning of the crisis.  A small city hurts 
worse in a crisis than a larger one.  I'm not sure how many blocks are 
in AP, but there are fewer than 68 streets.  I see homes everywhere - 5 
blocks from the ocean on Deal Lake drive to Prospect Ave on the 
southwest side of the city.  It's a mess with emotional complications 
and larger tremors for the rest of the community.

[AsburyPark] Some comments on H4H and how the mortgage system crashed the economy

H4H won't work for a lot of homeowners.  It's first great drawback is 
that it is for 1 family houses only.  The other is that they will 
only finance 90% of the loan to value.  It won't work for loans in 
negative amortization (borrower owes more than the house is worth or 
more than the initial loan amount).  There are a lot of people I have 
seen in AP who took interest only mortgages.  They were betting that 
the property would increase in value and interest rates would stay 
low or someone at some mortgage brokerage saw this as the only way to 
qualify them.   There's a lot of room for blame here.

I get the digest for this group so I'm not sure where Maureen asked 
about the mortgages causing the bank crisis.  I'm going to give a 
reader's digest report on that.  It used to be that banks made 
mortgages and held the loans for the full term.  This is called a 
portfolio loan.  Banks still do this with some loans, but most are 
bundled together and quickly sold on the secondary market. This is 
what Fannie Mae and Freddie Mac were all about.  They were the buyer 
of conventional loans.  This kept the banks liquid and the mortgage 
money flowing.  Secondary markets sell stock in the future interests 
of these loans - mortgage backed securities.  Then the proverbial 
sh*t hit the fan.  
*Foreclosures and falling house values devalued mortgage backed 
securities 
*The seconds can't make as much money by selling shares of these 
mortgage futures.  
*No futures, no profit, no money.  
*Investment banking was the first to feel the pain.  
*No investment banking buying securities, no money flowing to the 
secondary market
*no money to the secondary market, no purchases of new loans, 
*no purchases of new loans, no fluidity to make more loans, 
*everything crashes to a halt. 

This is trickle down economics when sh*t trickles down rather than 
cash.   

Deregulation was a huge issue in what happened.  Loans were made that 
never ever should have been and this had nothing to do with CRA.  It 
was all about greed.  See banks aren't the only ones who make 
mortgages.  Mortgage brokers can do this too.  They are not as well 
regulated as banks.  Brokers are middle men.  They lend other 
people's money and get paid for it by the bank and by the customer.  
It was a good gig.  So, everyone became a broker.  AIG, Merrill 
Lynch, Met Life, etc.  Insurance companies, financial management 
companies, investment banks.  You lent other people's money and got 
paid to do it.  The blind squirrel found a stash of nuts.  When 
you're lending other people's money you tend to not be very 
cautious.  This became especially true when the other people (banks) 
weren't holding onto the loans.  They thought they didn't have much 
risk because all of them were looking at trickle down economics when 
the trickling is gold.  

There is plenty of blame to go around.  Homeowners who bought houses 
they could never afford - Loan Officers who used creative financing 
knowing people couldn't afford the loans, but they are commissioned 
and they eat what they kill - Banks who pushed their loan officers to 
push expensive loans over less expensive ones for their own higher 
cut - Mortgage brokers who got a little drunk on the bubble - 
Regulators who kept allowing weirder and weirder loans with less and 
less credit history to be considered kosher for resale - FICO and 
their damned credit scoring system that eliminated human underwriting 
using standards - Fannie Mae and their Desktop Underwriting which 
relied heavily on FICO and allowed too much wiggle room (loan 
officers could play with a loan becoming commissioned underwriters) - 
Investors who bought bundled loans never looking to see if they were 
good or bad loans - The system of lending money where the lender had 
no risk (supposedly) and suspended due diligence.  Plenty to go 
around and not even worth doing.  

Let's just fix it and try to make sure it never will happen again.  
Though I suspect it will.

[AsburyPark] Help for Homeowners FHA loan

Help for Homeowners (H4H)

Eligible Loans

Any type of first mortgage that was originated on or before January 1,
2008.  Borrower must have made at least six (6) payments on the existing
mortgage.  The borrower may be current or delinquent at the time the new
H4H mortgage is originated.

Terms

30 year fixed

Rate

Standard FHA market rate as set by lender

Prepaids/Origination Fees

Standard FHA including 1% cap on origination fees

Mortgage Insurance

Upfront Mortgage Insurance Premium (UFMIP) is 3% and the Annual is 1.5%.
The UFMIP may be financed if the loan does not exceed 90% LTV

Asset Test

Must be borrower's first and only property

Credit Standard

Borrowers who are current or delinquent[1] on their mortgage at the time
of the refinance

Cannot have intentionally defaulted on their mortgage or any other debt
(i.e.  had available funds that could pay the mortgage and other debts
without hardship.  Debts subject to a documented bona fide dispute may
be excluded.)

Must have made a minimum of six (6) full payments during the life of the
existing senior mortgage

Loan-to-Value (LTV)

90%

Eligible Properties

Must be primary and only residence in which the borrower has an
ownership interest.  Only 1-unit properties are eligible, including
condominiums, cooperative units and manufactured housing permanently
affixed to realty.

Existing Liens

All existing lien holders must waive prepayment penalties and late
charges, as well as extinguish all liens against the property.   This
loan must be first lien.  Existing first lien holders are required to
accept the proceeds of the H4H mortgage as payment in full.

Appreciation Sharing Requirement

Borrowers will be required to share both the initial equity created with
the H4H loan, and future appreciation.[2]

Maximum Loan Amount

$550,440, nationwide.

Additional Requirements:

Borrowers existing total monthly mortgage payment exceeds 31% of their
gross monthly income in March of 2008.

Borrower's total monthly mortgage payment on the new H4H loan is less
than the borrower's total monthly mortgage payment on existing loans.



Ratios

31/43. However, if the borrower has successfully completed a 3-month
trial modification, ratios can be expanded not to exceed 38/50.

Income Verification

Borrower's income tax returns for the previous two years.

Non-Occupying Co-signers:

Not allowed.  Any existing non-occupying co-borrower will be required to
quit claim their interest in the property prior to application.

Closing Costs

Standard FHA policy regarding closing costs is applicable, including the
1% cap on origination fees.

Borrowers may pay closing costs from their own assets.

They may be financed into the mortgage provided the 90% LTV limit is not
exceeded.

The servicing lender, originating lender and/or a third party (e.g. a
federal, state or local program).

The originating lender my pay the borrower's closing costs and prepaid
items through premium pricing.

Subordinate Financing

Subordinate financing is not allowed in the first 5 years of the
mortgage except when necessary to ensure maintenance of property
standards.



[1] Borrowers in bankruptcy are not precluded by FHA requirements from
participating in the H4H Program.

[2] To encourage subordinate lien holders to participate in the
negotiation process and release their liens, FHA has the authority to
share with them the government's portion of any future appreciation in
the property's value. At settlement, subordinate lien holders will
receive a certificate that evidences their interest as an obligation
backed by HUD, with payment conditional on the value of HUD's
appreciation share. Please see mortgagee letters 08-29 and 08-30

Eviction looming, man sues over deal

He, others say they feel cheated

Michael Moreno had a decision to make — fast. There were only hours 
to go before his home was to be sold at a sheriff's auction.

The 47-year-old Little Egg Harbor resident could lose the house — a 
three-bedroom, two-story Colonial that he had built in 2002 — and 
face homelessness with his wife and four children.

Or, he could sign a contract — without retaining a lawyer — to sell 
the home to buyer Robert Heath Jr. Heath's Marlboro-based company, 
MGT Group, would offer to sell the home back to Moreno at a later 
date.

The choice seemed simple, then.

But now, Moreno says he was stripped of nearly $70,000 in equity in 
the February 2006 deal, and he faces eviction from the house he 
thought he saved. He also is one of two former homeowners suing Heath 
and related companies in an attempt to undo deals they claim are 
fraudulent.

Their attorney, Kevin Carlin of Hamilton, said the documents on the 
deals list transactions that never happened, a violation of federal 
law.

Carlin also said there are more than 40 similar real estate 
transactions involving Heath in the state. In the lawsuit, Carlin 
argues "the pattern" of activity should qualify as racketeering.

Heath's attorney, Joseph F. Ottino Jr. of Brick, said the agreements 
were simply legal private con-tracts between two parties. Moreno was 
being evicted, Ottino said, because he is not paying rent to live in 
the house, as Heath had agreed.

Heath may have made money on the deals, but there's nothing wrong 
with that, Ottino said.

"That's the nature of the business," Ottino said. "You put out money, 
a capital investment, and you get a return based upon the risk."

Ottino declined to discuss Carlin's charge about false statements on 
the documents. Heath did not return calls for comment.

Moreno said in an interview that he was taken advantage of in a 
moment of extreme weakness.

Moreno said his auto-repair business had run into financial trouble 
after a new landlord informed him he would have to move his shop; the 
landlord had other plans for the property. Moreno said he lost about 
$60,000 before he was able to relocate. Moreno said Heath had called 
him when his home was listed for foreclosure sale. Moreno said he and 
Heath agreed Heath would pay off Moreno's $261,000 mortgage. Moreno 
would prepay Heath $25,000 in rent to remain in the house for a year.

Moreno agreed he would be able to buy the home back after that year 
for $297,000 — the amount of the mortgage Heath would take out on the 
home with Countrywide Financial.

On the day of the sheriff's sale, Moreno rushed to Heath's two-story 
office in Marlboro. There he found Heath, an attorney whom Heath 
explained had an office in the building, and another Heath employee 
who had appraised the home, Moreno said.

But the numbers had changed, Moreno says, and Heath wanted more.

"All of a sudden, I would have to buy the house back for $321,000," 
said Moreno, who says he didn't know then he should have had a lawyer 
to represent him. "I left. I was mad. It wasn't the same deal."

Within seconds, Heath called Moreno's cell phone and asked him to 
return, Moreno said.

"He's saying, "Come back, Michael. This is going to work for you. You 
don't want to lose your home, do you?' " said Moreno, who turned back 
to finish the deal. "(Heath's attorney) was like, "sign here,' "sign 
here.' I was only thinking about saving my house."

Moreno made it to the county Sheriff's Office in Toms River with less 
than an hour to spare before the sale. Moreno said he did not know he 
had a right to postpone the sale.

But now after a year of struggling with Heath over the deal gone 
wrong, Moreno says, "I had a letter on the door saying, "You gotta 
get out.' "

No rent being paid

The prepaid rent ran out around February 2007, and Moreno said he has 
not paid the roughly $2,000-a-month rent since. Nor has he paid 
taxes, as he agreed in the contract.

In the lawsuit, Moreno said he was bilked out of at least $69,000 in 
the deal — the difference between his original $261,000 mortgage and 
the price of $330,000 Heath claimed on a deed that he paid for the 
home.

And Moreno would later learn the attorney he says rushed him through 
the signing, Meryl Polcari, is now Heath's wife. Moreno said Heath 
never disclosed their personal relationship. Polcari couldn't be 
reached for comment.

"I thought he was helping me out; what he did was took me for a 
sucker," said Moreno, who filed his lawsuit in Superior Court in Toms 
River in September. When Moreno re-established his business, he said 
he returned to Heath to repurchase the home. But when he tried to get 
a loan through the businessman, as discussed, Moreno said he was 
rebuffed.

Free might help.  You know my biggest concern is that people will 
leap from the frying pan to the fire.  There are predators out there 
looking to make money off of the misfortunes of others.  The Press 
did a story on an equity skimming scam in southern Ocean County this 
weekend.  Equity skimmers approach homeowners and promise to pay of 
the mortgage or give a sum of money when the property is sold. They 
get people to sign over their deeds and promise them that they can 
live in their house.  They then collect rent from the homeowner while 
letting the loan go to foreclosure.  The deed is different than the 
mortgage note and signing it over doesn't get rid of the debt.  

There are also some phony counseling agencies popping up.  This is 
alarming to me.  These groups calling themselves approach homeowners  
and offer to help them for a fee. Most are services people could do 
themselves for free like working out a new payment plan or approval 
for a pre-foreclosure sale. We saw a lot of this in the past with 
phony credit repair agencies.  

People need to be very careful.  Avoid anyone who advertises "We Buy 
Houses" on signs.  I've seen them up along Asbury Ave.  People need 
to make sure that their helper is legit. I'll post the Press 
article.  Hopefully, it will help people identify predators.   These 
are the things that give me many sleepless nights.  

Thanks for the input.  BTW, I hate debt collection agencies.  They 
abuse the legal limits of their federal regulations to extremes.

You sound like you're a very kind and caring person so PLEASE take this 
not as a criticism of you or what you do, but a general warning.  

If anyone is facing a foreclosure which means falling behind on even 
one mortgage payment then you should pick up the phone right now and 
call your lender then call your local HUD certified housing counseling 
agency to speak to a loss mitigation counselor.  

In Asbury Park, there is only one agency with one counselor.  The 
funding is so bad that they cannot counsel anyone outside of the city.  
The agency is All AHEAD and they're on Mattison Ave 732-807-2523.

Locally, there is AHA in Eatontown 732-389-2958 and Monmouth County 
Freeholders 732-431-6028.  

There are options and some will allow people to keep their homes.  Some 
lenders are tending to be more cooperative than in the past.  For 
information http://www.hud.gov/foreclosure/

People need to know all of their options from a disinterested party.  
HUD funds the counseling programs to do this.  A recent Freddie Mac 
survey showed that in 60% of all foreclosures the homeowner did nothing 
to prevent it.  They didn't speak to their lender, a counselor or a 
lawyer.

[AsburyPark] Yappy Hour & Dog friendliness bring people to AP

Hi Glenn
Thanks for sharing the videos.  The Wag on Inn volunteers are great.  
Every week they are there with the sweetest puppies.  They provide 
all their adoptees with lifetime obedience training.  I really hope 
that anyone out there who is thinking of getting a puppy will go to 
The Dawg Joint on Saturday or the Wonder Bar on Thursday.  Another 
great thing about Yappy Hour is that people can meet dogs of various 
breeds and sizes. It's a good place to learn about dogs before you 
get one too.

I was happy to see that TPTCCTV was at the Oysterfest!  It's great.  
I tell every dog owner I meet about the dog friendliness of AP.  The 
couple from MO that fostered my puppy Annie are going to come and 
visit next summer.  

I know Debbie and Lance love animals and that is probably why they 
started Yappy Hour, but it's sheer marketing genius.  People come 
from all over every week.  I bet there are people there that never 
came to AP before and now will come again and again.  Not only for 
Yappy Hour, but for other stuff too.  

It will be great to see you again.  My son is still telling people 
about petting and feeding D-for.  That is one cool duck.  The guy and 
the dog are pretty great too.

BTW, Bono is a whole different category.  He is a famous rock star, but 
he is also a man who has an international campaign he is trying to move 
forward.  He is a citizen of the Republic of Ireland.  He cannot vote 
in the USA.  He doesn't publicly support or endorse a candidate.  He is 
a born again Christian who feels he must use his fame to help give a 
voice to people who cannot make themselves heard.  He requests to meet 
with leaders of varying ideologies in order to get support for campaign 
to end poverty and the ONE campaign to end AIDS and global poverty.  
Bono has met with Obama all the way back in January 2007.  At that time 
he said he hoped to meet with all the US presidential candidates.

[AsburyPark] Love Dogs, but can't have them...Volunteer at the SPCA

A wonderful thing that people who love dogs can do is to volunteer at 
their local shelter.  I did it in college.  I used to walk the dogs 
whenever I could.  I even got to take them out to the park.  It's so 
important for dogs to check out the world and interact with other dogs 
and people.  It helps them to become more adoptable.  This is really 
important, especially for the big guys.  You will fall in love, but if 
you go in knowing that this isn't going to be your dog it works.  I 
think of it like babies.  I love them, but it's really nice to give 
them to their Moms.

[AsburyPark] Yappy Hour at the Wonder Bar tonight

I love Yappy Hour.  Annie & Lily love Yappy Hour.  Lily knows when it 
is Thursday and waits by the door to go.  You say the words Wonder Bar 
in our house and it is like saying go for a walk.  
When we started going to Yappy Hour in the beginning of the summer 
there was only a handful of people and dogs.   People walking by 
noticed and stopped to ask what was going on.  I told everyone I met 
with a dog about it.  It's fantastic.  Dogs range from teacup chihuahua 
size to my big Great Pyrenees.  I think Lily is the biggest one and 
Tank the chihuahua puppy is the smallest.  The dogs have a blast.  I 
adopted a puppy from the Great Pyrenees Rescue in August.  5 mo old Pyr 
puppies are almost as big as a grown Golden Retriever.  It's very 
important that they get socialized and it's hard to find a place where 
they can play with dogs of every breed.  Yappy Hour was perfect. 
I missed the APP article on Monday.  I have to see if I can find it 
online.  Anyway, tonight is Yappy hour.  I'll be there with my dogs, 
Lily and Annie, My parents and their dog, Chewy the yappy schnauzer and 
my sister-in-law and her wiggly American bulldog, Ozzy.  We usually 
hang out with the Chihuahuas and their people.  Don't miss it because 
soon it will be too cold.  It's a true only in Asbury Park event.  One 
that makes people I talk to at the Pyr rescue amazed.  Annie's foster 
Moms live in Missouri and they plan to come out next summer to see 
Annie and visit the Wonder Bar with their dogs.

even wonkier than me.  
Finally if anything seals the deal it is Obama and Biden's calm in 
the eye of the storm.  Sarah Palin and John McCain seem extremely 
pissed off all of the time.  That is my decision.  I don't plan or 
need to change the minds of anyone set on McCain/Palin.  It won't 
happen anymore than they can change mine.  It's set.  
Some people may want to call me names or challenge my judgment.  Go 
ahead, but do it privately.  Don't fill the mailboxes of everyone on

I majored in history and I hate math.  The formula for mortgage 
qualification is pretty simple though.  We calculate affordability 
based on maximum monthly mortgage payment which lenders call PITI 
(pity) or Principal (amount of loan), Interest, Taxes and Insurance.

gross monthly income
X 40%
less monthly debt
equals qualified PITI

To calculate the maximum mortgage amount you divide the final number 
by .00X.  X=interest rate.

So a gross monthly income of $1000
with monthly consumer debts of $100
Interest rate of 5%

My borrower qualifies for a loan amount of $60,000.  

Reducing the principal would lower the payment much more than 
lowering the rate.  That is what a partial claim does. 

BTW this is the easy method.  Some lenders use more than one 
percentage and calculate debt and housing ratios separately, but for 
the most part one ratio works fine.

Sorry if this is wonky.  I explain it much better in a classroom than 
I can in an online group.

There is a loss mitigation tool for FHA mortgages called a partial 
claim.  Under this option the servicer negotiates with the borrower 
and FHA to advance funds representing the delinquent balance.  
Basically, the servicer of the loan is paid a partial claim using the 
FHA insurance in order to reinstate the loan.  There's always lots of 
rules and conditions on any loss mitigation option.  

Sometimes we can do partial claims using private mortgage insurance, 
but it's much more difficult than an FHA claim which isn't easy 
itself.

Loans can be modified too.  Servicers can recast the loan by taking 
the delinquency and increasing the term of the loan.  There is also 
the option of increasing loan payments for a fixed period of time to 
make up the delinquency.  Obviously, this is for homeowners who could 
originally afford the loan and suffered a temporary financial setback 
which has been corrected.  Not too good for the crazy loans we deal 
with today.

I have used short sales in a predatory loan remediation with HUD's 
cooperation.  We arranged for the short sale of the house to an 
approved non-profit which then resold the house back to the original 
homeowner at the same closing.  It was creative lending and it did 
work for about 25% of the people in the scam.

Usually short sales are of little benefit to the homeowner other than 
they avoid full-blown foreclosure and defiiciency judgments.  Short 
sales and deeds-in-lieu of foreclosure are better than foreclosure, 
but still result in the loss of the house and equity.  

The main problem in today's debacle is that the tools are meant for a 
different set of issues.  In the past when loan servicers were flush 
they usually wouldn't even try to work with the homeowner or their 
counselor.  Now, they need to and hopefully that will increase our 
options.  A short refinance would be a great tool.  It would 
certainly create better market stability.  

The Hope for Homeowners Act went into effect Oct 1.  It does have a 
provision for partial loan forgiveness.  The problem is that lenders 
get to choose if they will or won't participate.  This is why I get 
pissed about a bailout.  If lenders want to be bailed out then they 
must agree to the provisions of the Hope for Homeowners Act.  FHA 
lenders should be required to work with HUD approved counselors or 
lose the ability to write FHA insured loans.  Lenders that don't want 
to can go it on their own, but they cannot expect any federal 
assistance (Tommy that was for you.  I'm not advocating government 
control of free trade.  I'm requesting that those who request 
government assistance comply with government set provisions).

the country except maybe Florida.

Unfortunately, it isn't about preference.  We all prefer adult and 
responsible, but biology creates a desire before those two milestones 
are reached (for some responsible is never reached).  I will teach my

One of my greatest fears is that my son would get a girl with a parent 
like Palin pregnant.  I can only hope he will use condoms like I've 
told him to even though the Sarah Palins of the world would consider 
him way too young.  I feel for the kid who got her pregnant too.  
That's two kids who probably may end up resenting one another a whole 
lot over time.  Abstinence only parents seem to forget wat it was like

I also hear people saying we're taking on debt on TV every day.  I 
think that many people outside of the world of banking don't deal 
with negative equity (if they're lucky).  Here's the difference.  
Negative equity is the difference between the value of an asset and 
the outstanding portion of the loan taken out to pay for the asset, 
when the latter exceeds the former. Negative equity can result from a 
decline in the value of an asset after it is purchased.  So if you 
bought a house in Florida at the height of the market taking out a 
mortgage for $450,000 and that house is now worth only $200,000 then 
you have negative equity.  You cannot refinance the house for what 
you owe, you can't sell it for what you owe, but you still have a 
house (and a debt).  If you can afford to keep making the payments 
then you do and hope that the property value will increase again.  If 
you can't afford it and go into foreclosure then the lender gets the 
devalued property.  You will probably also get a deficiency 
judgment.  

Negative equity is not debt.  It is a secured item which is no longer 
worth the value of the debt it secures.  It could increase in value 
again and even exceed the value of your debt.  The borrower has the 
debt, the lender has secured equity and the entire country will have 
a lot of loans securitized by negative equity. If that equity goes up 
will the country benefit?  That's the biggest question.  I personally 
am tired of seeing executives get millions when they're fired.  

The way I personally see it is that we're already going to do this 
buyout so let's do it smart.  Let's build in a clause so that the 
country can receive the benefit of increased equity (if and when that 
does happen).  Most of these loans are for 30 years and many are 
being paid on time.  Lenders just don't wait or can't wait 30 years 
to get their cash back.  WAMU was taken over by the FDIC yesterday.  
Don't rush to the bank yet.  JP Morgan Chase bought the banking 
division.

You are thinking like a lawyer and I am thinking like an 
underwriter.  I use the word mandatory because many mortgages 
(discounted loans to first-time homebuyers mostly) already require 
mandatory homebuyer education.  The loan will not go to closing 
without a certificate from a certified counseling agency.  It is like 
any other loan closing document and since they change with each loan 
they are not laws.  

Just to clarify things.  People can feel free to sue their counseling 
agency.  Only trouble there is that then we won't have any counseling 
agencies.  We are already losing them due to lack of funding.  Most 
were funded primarily by lenders' foundations.  

So it continues...

The burden of proof is on the creditor.  You can and should dispute 
your credit report with the credit reporting agency.  If the creditor 
doesn't provide proof then the CRA must remove the information.  You 
can also request that the CRA put information on your report (ex:  If 
you have a proof of payment just send a copy to the CRA).

I teach the Fair Credit Reporting Act and all of the other consumer 
protection laws in my homebuyer class.

I am not proposing a law.  I just feel that knowledge would have 
helped many people avoid mistakes.  I think that mandatory education 
which covers all aspects of homeownership, but does not replace legal 
counsel is a good idea.  I am a housing counselor.  I've run 
counseling programs and trained counselors for a long time.  I've 
never been sued because counselors do not tell people what to do.  
They offer them knowledge and give them the tools to make their own 
decision.  Counselors are educated and certified.  I currently train 
housing counselors and their partners (some of whom are legal aid 
lawyers).  I teach counselors that they can only give people an 
understanding of lending practices.  I can't and wouldn't decide for 
them.  Suing your housing counselor for teaching you something you 
didn't or chose not to learn would be like suing your math teacher 
because you bounced a check.  You can't make people choose the best 
options.  I know that.  Some will always go for the quick and easy 
path even if it runs off of a cliff, but many would have chosen 
differently with the advice of a housing counselor.  What is wrong 
with that?

I am prejudiced because I have worked in housing counseling since 1994, 
but I agree.  If everyone had a counselor to work with before they took 
out a mortgage then you would decrease the number of people who ended 
up in crazy mortgages.  You could never completely eradicate it unless 
counselors were required to sign off on the loan choice, but that's a 
bit too much.  How about mandatory first time homebuyer classes?  At 
least educate people that they have options.  Right now, people take 
advice from those who make a commission off of their decision.  Never a 
great situation IMHO.

It is negative equity.  The value is no longer enough to securitize 
the amount of the debt.  Mortgages are secured by real property then 
bundled together and sold as mortgage backed securities.  When 
property values drop then the securities lose value.  NEDAP has a

I didn't even mention in my first post all of the AP residents who 
may face losing their homes.  This applies to both owners and 
tenants.  How many are out there in loans they can no longer pay?  
How many are tenants of landlords who tapped their equity or 
qualified under relaxed underwriting guidelines?  I have no idea.  

I wondered as I listened to the congressional hearings today why they 
aren't bailing out the homeowners?  Wouldn't this secure the equity?  
If only my loss mitigation counselors had better tools and 
options!!!  I don't even need a huge bailout.  All I need is some 
sort of forgivable forbearance for some of the people in over their 
head.  Well maybe once the rich guys start to find paying their 
mortgages impossible?

[AsburyPark] Consequences from Wall Street to Asbury Park

What happened on Wall Street will have consequences for AP and possibly 
the world.  We are AP focused so...
How many AP residents worked for Lehman Bros?  I don't know, but I'd 
venture to guess a few.  How many are mortgage loan officers who 
originated loans securitized by Lehman?  I'd say a lot more.  How many 
are realtors who can no longer sell properties to buyers without a 20% 
downpayment who also have to qualify for a much more stringent 
mortgage?  AP has a lot of realtors.  Now how about the regular average 
person who wanted to buy a house here.  He or she may not be able to.  
How about all of the people who would have bought a nice condo near the 
beach for a weekend house and no longer can?  How does that trickle 
down?  These giant companies didn't just employ investment bankers.  
They employed IT, office managers, administrative assistants, janitors, 
security guards and well you get it.  I am only looking at it from one 
perspective, but consequences have not even begun yet.

I will second you Jack.  I saw the hotel last month and it is 
stunning.  It reminded me of the old school small hotel as opposed to a 
generic chain hotels of today.  I loved the restaurant, bar and pool.  
It is fantastic!

[AsburyPark] Evangelizing

Okay Tommy, I never said I didn't like how they evangelize. Do not 
twist my words to your own.  Evangelizing is often defined as 
spreading the good word of Jesus Christ.  Some define it in other 
ways, but that is the definition that I learned in Catholic CCD so it 
is the one I will use.
The mission practice is more like forced conversion which is a 
practice rejected by the basic tenets of most Christian faiths.  

* The mission attracted men from all over to AP.  
* The mission did not screen for the cause of homelessness
* The mission did not screen for high risk offenders like pedophiles
* The mission did not have any referral programs in place
* The few who were allowed to remain in the mission during the day 
could only do so if they converted to the mission's faith.
* The rest go onto the street every day to fend for themselves.

I have dedicated my entire life to helping people find housing.  I am 
currently working for a very large foreclosure prevention program in 
NYC.  I have worked with faith-based organizations and I will 
continue to partner with them.  I know of none that only truly help 
those who embrace their faith.  I know of no other that puts the 
people out with no referrals for job training, counseling or other 
social services.  There are best practices for running a homeless 
shelter.  It includes rehabilitation of the underlying causes of 
homelessness not forced conversion.  I hope you never need help and 
are forced to choose between your faith and your survival.  I believe 
in helping others.  I also know that when people are down so low that 
often all they still have is their belief.  I would help you even 
though you twisted my words to your liking.  I've never worked for or 
with an organization that would only help those who believed as they 
did.   That is where I take offense with this mission and yes their 
lack of best practice is dangerous.  It is a complex issue.  I invite 
you to look further into it.

I answered because I am tired of hearing you twist my words.  Do not 
quote me as not liking how they evangelize.  I do not like how they 
don't truly offer help. I have a feeling you like to have the last 
word so have at it.  I'll leave you with this.

Give a man a fish and you feed him for a day; teach a man to fish and 
you feed him for a lifetime.  The mission does not fulfill the second 
half of the proverb.

No. I did not call their evangelism offensive.  I was offended that 
the mission was not offering shelter unless homeless men converted to 
their faith.  That is more like the crusades or the Spanish 
inquisition than evangelism.  I think forcing your faith on people is 
wrong.  That is my opinion.  I think not helping people who need help 
unless they join your faith is inexcusable.  

There are many fine programs run by faith based groups that help all 
people who need them.  If that were the case here then the group's 
faith would have never entered my conversation or thoughts.  

If you read my post again then you might see that the turning out of 
those who did not convert without help or referrals lead to a safety 
issue.  This was not a simple issue.  There were many concerns about 
the practices of the mission.  Their faith was not the issue it was 
their practice of truly helping only those who embraced it.

It wasn't a fight against any religion per se.  What I believe Paul 
is referring to is the lack of a real program to treat the addictions 
and/or psychological problems that are often present in some homeless 
populations.  The mission described their "treatment" on their 
earlier web page as requiring the men to sleep on the sanctuary 
floor, accept the faith of the mission (which was non-denominational 
christian).  So if you were a Jew, Buddhist, Catholic, Jainist, 
Baptist, Atheist or anything else you had to accept the mission's 
religious doctrine in order to stay inside the mission.  
To me this is offensive.  I also don't see how it helps.  It is one 
thing for a person to choose a faith and that can help with other 
issues, but on an icy cold winter day many may be forced to convert 
(or pretend to) in order to stay warm.  There is also the issue of no 
other programs for their population.  They would simply turn the ones 
who did not sleep on the sanctuary floor and convert out onto the 
streets to find their way.  
In my opinion, it was that practice that made the mission seem quite 
dangerous to both the residents of the city and the men who they 
would shelter, but not provide additional referrals or assistance to

Pete,
I can understand your point, but isn't the next president also going to 
have an effect on Asbury Park?  
Municipalities like AP receive funding on a national level from federal 
agencies.  Federal grants are notoriously dependent on the whims of the 
administration.  I know AP's downpayment assistance program is funded 
with money from HUD.  AP gets quite a bit of funding from HUD.  The EPA 
has funding for programs like green building and energy efficiency.  
Checkmate, Inc. is the local CAP agency it receives funding to help 
people who cannot pay their heating and electric bills, replace windows 
and create better energy efficiency.  With the price of oil going up 
and up, imagine all the AP seniors who will have to choose heat or 
eat?  
Anyone can look at the myriad of grants available through federal 
agencies at http://www.grants.gov/search/category.do
I say with all due respect, that we are going to be effected by the 
choice of a new administration as long as we live in the USA and 
perhaps even if we don't.

Puhlease don't assume that anyone with a double X chromosone pattern 
will lure Hillary supporters to the other side.  Gender politics 
aside, Hillary's platform was radically different from Sarah 
Palin's.  It was much more like some guy named Obama's.  As a woman, 
I'm insulted.  As a voter, I'm tired of the prejudice. I wouldn't 
vote for a candidate just for their gender or race anymore than I 
would NOT vote for a candidate for their gender or race.  Let's vote 
with our heads for a change.  

A friend tells me that the problems of this country are always rooted 
greed and racism.  I think he has a point, but then isn't greed the 
mother of racism.  Vote for the platform not the packaging.

Hi Maureen,
I'd like to answer this question based only on my own nonprofit, 
affordable housing experience and nothing to do with PHS.  A 
nonprofit with a 501(c)3 tax exempt status must provide a charitable 
mission.  Nonprofits are allowed to make money and many do.  Some 
have credit cards, some sell cars, some have stores.  Nonprofits are 
always scrambling for money.  It's neverending, but they still have 
to provide a charitable mission.  Lobbying nonprofits have a 
different IRS designation 501 (c)4 and are not tax exempt.  

Again, I know nothing about PHS.  I only looked at their site and saw 
they ran many affordable housing units for seniors other than Asbury 
Towers.  They may subsidize these by running a for profit entity that 
has ritzy units. This is similar to the movement in housing 
counseling to start a for profit entity that brokers mortgages in 
order to pay for their charitable missions.  

The only way to really know is to ask PHS.  I may be prejudiced 
towards their needs because of my own work in the affordable housing 
field.  It's an ongoing challenge to simply remain viable and the 
need never stops growing.  So I will admit to my own bias and hope 
that everyone will take this in the spirit which I offer it - just 
information.

[AsburyPark] Re: Marketing the Old with Nostalgic Spin

Good pizza, sausage sandwiches, pork roll and cheese (the NJ state 
sandwich), salt water taffy, candy apples, soft serve ice cream, hot 
waffles with ice cream, orangeade, lemonade, cotton candy, steamers, 
crabs, corn on the cob... I don't think of fine dining when I think of 
boardwalk, but that doesn't mean it isn't a good idea.  I hate to say 
it, but I do think of high prices.  It costs a lot to rent on the 
boardwalk and that is passed on to the customer.  I was at Martell's 
Tiki Bar in Point Pleasant Beach recently and paid $12 for a martini 
same as AP's Beach Bar.  Maybe they could have an after Labor day 
special where they roll back prices like they do for Taste of 
Brooklyn.  I went to a full course meal at the River Cafe a few years 
ago for $19.55 (the year the Dodgers won the penant), but drinks 
weren't included.  Anyway, it was a great promo and a chance for people 
like me to pretend I dined high end all of the time.

Re: [AsburyPark] good place for dinner in AP?

I've been adding AP restaurants to Trip Advisor for awhile now.  More 
comments would be greatly appreciated www.tripadvisor.com.  People 
check the site for local information when they're scheduling a trip.

As for where to eat.  Well even when I have had a bad experience I go 
back for a second try.  Sometimes the chef or waiter or both can be 
having an off day.  I don't have many places in AP where I wouldn't 
recommend.  I was a Ketchup recently and liked that a lot!  

Trip Advisor has a place to put the price of an average meal per person 
which I find very helpful.  Sign on and share your thoughts there.

Please note that lawyers succeed in "delaying" not stopping 
foreclosures.   A perfectly plausible means of delaying a foreclosure 
is filing chapter 13 bankruptcy.  There are many different ways to 
stall the process.  Most lenders will now work with a borrower to 
prevent going to foreclosure, but the borrower has to work too.  I 
think sometimes people are thinking of a predatory loan as opposed to 
creative financing.  There are differences between the two. People 
who have only had a temporary setback have a lot more options to set 
themseves right than those who are unable to pay. Unfortunately, 
sometimes the only way to completely avoid foreclosure is to give up 
your house voluntarily either by selling (for full or approved lesser 
amount) or deed in lieu of foreclosure (sort of like a car repo).  
Here's the options that HUD certified housing counselors are taught

The abuse of stated income mortgage loans has been one of the biggest 
predicators of the current crisis.  Unfortunately, borrowers who 
falsely stated their incomes also usually signed sworn statements.  
Some were convinced to do this by their loan officers.  Some did it 
on their own.  Either way they'd never have qualified with 
conventional underwriting.

I always warn my clients that loan officers eat what they kill as do 
all commissioned salespeople.  That doesn't mean they're bad.  It is 
just their job and as a borrower you need to make your decisions on 
advice from someone who doesn't make a commission on the decision.  
Listen to the loan officers for sure.  They are often very 
knowledgable, but follow up on what they tell you and weigh your 
decisions carefully.  Better still - Go see a housing counselor or 
take a mortgage class to get unprejudiced advice.

space can be bought with green acres not all green acres sites are

Yes as a part of public access, lands purchased using public money are 
supposedly required to have public restrooms and parking 
accomodations.  Some towns like Mantoloking keep non-residents off 
their beaches by not supplying restrooms and creating limited time 
parking or no street parking.

Green Acres - the act is not the same as Open Space although Open Space 
can be Green Acres.  Turtle Back Zoo is a green acres space.  Many 
towns use green acres for sport fields.  Many historical sites are 
green acres.  People often confuse the two acts, but while they may 
both apply to some properties they can also apply individually to 
others.

[AsburyPark] Green Acres

The purpose of Green Acres is "providing parks and outdoor recreation 
facilities, urban wildlife preserves, and quality open spaces in our 
cities, suburbs and other developed communities throughout the State. 
To further this goal, Green Acres provides assistance to local 
governments and nonprofit organizations to develop parks and outdoor 
recreation facilities in their communities."  
Green Acres requires public access as it is funded with public money.  
Public access includes "Provide public restrooms and parking for the 
project site if directed by the department based on the proposed use of 
the project site and the nature of and extent of public demand."

This should be the case with the boardwalk. A boardwalk needs 
bathrooms.
