[AsburyPark] flatbed trailers...

D'Amico of the Monmouth County Prosecutor's Office drops in for a
Quesday event on May 2nd. We've also invited the Prosecutor himself,

It's really a stupid idea -- yes stupid -- for Rita, Jim Keady and even Ed 
Johnson -- or anyone else for that matter -- to ask about bills on the bill 
list at the council meeting where they are to be voted on. There is no way that 
the finance department can have all the back-up documents for any question that 
might come up on the list. It should not be a surprise to anyone that there are 
no specific answers at the Council meeting.

Do these presumably well-intentioned citizens (Council included) deserve a 
detailed explanation of bills? Ab-so-f-ing-lutely!

Here's what I do, and what anyone can do. Sometime around 3pm on the Friday 
before the Wednesday Council meeting, the bill list is printed in the finance 
department. It becomes a public document and anyone can visit City Hall and 
have a look at it or get a copy of it. I've been told you can even get a copy 
off the city's web site later that same day. (You can get a copy on Monday or 
Tuesday or Wednesday or next week if you want to.)  Take it home... review it 
to your heart's content. Then contact the finance department -- in person, by 
phone or by e-mail -- and ask for the detailed back-up information about any 
and all bills you have a question about. I've never heard from a single person 
yet who said that they couldn't get detailed information on any and all bills 
when they inquired at the finance department.

OK... so let's say you still have a question or complaint about a particular 
chair that's on the bill list and you don't like the answer you got at the 
finance department... THEN you bring it to the attention of the Council at the 
Council meeting and complain. Complain about what you learned about the cell 
phone charges or the web site hosting charges for that matter. Do something 
about.

But if all one does is come to the Council meeting expecting a detailed answer 
on a specific bill on the bill list -- and you know from years of not getting 
detailed information at the Council meeting -- then I have to conclude that one 
is just asking about bills to be a grand-stander.  Or in the case of the people 
who come out once every four years and then retreat back into their hiding 
places, a candidate for City Council.

There are plenty of places to go for lunch downtown in AP. Red Fusion, Taka, 
Sister Sue's, Be Green and Carmine's all serve lunch. There's a choice between 
fat or healthy, alcohol or not, and a range of prices too. So what's the 
problem? Simple. Parking. Givne 1/2 hour or 45 minutes for lunch people are 
always going to Clancy's where they know for certain they will get a parking 
space... it may be all the way down at Burger King end of the lot, but they 
will find a space to park in a parking lot that seems safer than any parking 
space one can find in Asbury Park. Lunch time visitors can not afford 15 
minutes of hunting for a parking space.

Some will say "there's parking on Lake." Others will say there's parking in the 
500 block of Cookman. Guess what... visitors to the town don't care to 
experiment. It's human nature. Show them where the parking is. Make it appear 
safe (heck it doesn't even have to BE safe) and make sure that time after time 
there is plenty of parking and they will come.

Old Man Raffertys will die for lunch too regardless of how good they are if the 
parking issues are not resolved.

I agree. Let's tax all those government parks we have in Asbury.  That way we 
can loose the "Park" in "Asbury Park" while we're at it. Imaging the savings in 
toner and ink when we cut 40% of the name.

Seriously... we "got rid of" a lot of government owned property when we sold 
the waterfront buildings and land to a private entity. (I don't think that was 
the right thing to do.) All that's left is City Hall, the transportation 
center, the fire house, pubic maintenance yard and waste water treatment plant.

How much more... or should that be how much less... can we have?

Recording the IP address and time stamp with posts is something that is trivial 
to do. However it offers very little guarantee that one can identify the poster 
of libel.

Here's the problem. Most organizations (or homes for that matter) have one IP 
address for their connection. It may always be the same IP address or it may 
changes each time the connection is established. None the less, the IP address 
can be traced and the account holder of the account traced. BUT... and it's a 
big one. All the computers connected to that network at home or in the office 
come in on the same IP address.

So for example... in my house there are three computers connected to the 
internet. If something libelous were posted from the IP addresses assigned to 
my internet connection you would only know that the post came from my house. 
You wouldn't have a specific individual to sue. And you couldn't even make 
assumptions about who was in my house at the time the post was made.

It gets worse when we consider the work environment. Let's say a business 
employs 10 salespeople and it has a support staff of 25 additional people. 
Something libelous gets posted from one of those 35 computers. When traced 
back, the IP address points to that business. Who are you going to sue? Could 
you impound all 35 computers? And who's to say the libelous posting didn't come 
from a visitor that was allowed to plug into the companies internet connection 
while he/she was there for a meeting?

Yeah... you can record the IP address, but it doesn't help you prosecute your 
libel claim. (Unless you're MOG and you have to sign in at the library to use 
the computer then the prosecutor of a libel, defamation or bias crime or 
claim would have the name and address of the offender and could proceed with 
any remedy at law.)

BTW...just because a judge says you /can/ do the appraisals this way doesn't 
mean you /have/ to do them that way. 

It is the city council that has the power to set the price and it is the city 
council that does the condemnation. 

If any member of the council had property in the redevelopment zone, you can be 
sure that the plan for condemning everything and the formula for setting the 
price would be different.

I support this council and I urge them to adjust their outlook on how 
condemnation is carried out and do the right thing.

Although I don't know for fact certain that the numbers in the article are 
correct... they certainly have the ring of truth from what I've heard about 
other transactions. The "Moliver principle" is one of the dirty secrets of the 
eminent domain process for the waterfront in Asbury Park. By saying that all 
increases in homes' values is a result of the waterfront redevelopment and can 
therefore be discarded is bull shit.

Asbury Park (03-06-2006) - A source in the Board of Education administrative 
offices has reported that Susan Maynard faxed a letter to the office late this 
afternoon requesting that her nominating petition for this April's School Board 
election be withdrawn. 

Maynard, a current school board member was one of seven candidates - including 
current School Board President Robert DiSanto - who were running for three full 
three-year terms on the nine member school board. Maynard had filed her 
nominating petition last Monday less than five minutes before the deadline. 

Last year Maynard's husband James Maynard, along with Mamie Moore, filed and 
won a law suit against the school board striking down one provision of the 
board policy on public participation at school board meetings. The lawsuit was 
the culmination of James Maynards' years-long attempt to get someone to listen 
to his claims that DiSanto was unfit to be the school board president after 
being appointed President two years ago when the board could not reach its own 
decision on who would be elected president. Later DiSanto was elected president 
by a near-unanimous vote of his fellow board members. 

Susan Maynard has often been involved in shouting matches with members of the 
public particularly when the issue at hand is DiSanto or gay or lesbian issues. 
At one meeting Maynard stormed out of a board meeting when she became too upset 
with comments from a member of the public.

Dennis, no one questioned Jerry's use of "white woman" and "black woman" and 
his posts that effectively called the mayor a racist. (OK.. Tom Deseno said a 
little something.) But the majority of everyone on this board -- including 
people who were there and even some people who weren't there -- let Jerry's 
comments slide unquestioned and took his report of events as fact.

Let's see you -- and Dan -- give Jerry the same advice you've each given me.

Cost was the issue two years ago when the project was presented, introduced, 
approved and built. The time to raise questions on the expenditure was then. 
Now the city will gear up to open the recreation area for the second year -- or 
is it the third? How many bites at the "it cost too much" apple does Jerry's 
white woman get? 

No, the issue today is not cost. rather the issue is the clear disconnect and 
outright hostility that was displayed by some people in the audience. Jerry's 
white woman said anyone can use the beach therefore the recreation area -- 
which by the way is a lot more than just "four hoses in the ground" --  isn't 
needed. She implies that everyone in the city should walk to their recreation 
-- a distance that could be up to one mile. I ask you, who among us is willing 
to walk a mile for anything? Jerry's white woman makes no consideration for the 
fact that to many in our community the cost to enter the beach is  money they 
don't have.

Did you even read Jerry's original post on this matter? He is the one 
suggesting that people have constituencies that they should be blindly aligned 
with or set examples for, He is the one who distinguished between the two women 
he writes about as white or black. You were there... you saw it for yourself. 
They fought the battle of the Westside Recreation park two years ago. They 
lost. (It should never have been a battle anyway. The idea that anyone in the 
city would be against  the small gesture to recreation that that park is is 
ludicrous.) 

The park was built, the money was spent. Now when the CFO brings forward an 
ordinance to close out the paperwork on the transaction, they want to fight the 
fight all over again. It's no wonder the entire room erupted in laughter when 
the "white woman" was exposed for the bigot she really is. 

It's very curious that even Jerry, when he's not driving Miss Daisy, will not 
refer to her by name in his posts opting instead to give her the moniker of a 
"white woman." I guess even he fears that she'll sue him for mere mention of 
her name in an on-line message board. Fear not, Jerry, she won't sue you. The 
nameless "white woman" still needs you to drive her around for nightly 
inventory. But be careful the next time she says she already has a ride she 
may have lined up your replacement.

Nancy was there. You'd know that if you were paying attention instead of 
carrying on your own meeting with "that white woman" you adore. Everyone in the 
room laughed except for you and your mini-meeting friends. Perhaps if "that 
white woman" hadn't carried on under her breath in a voice loud enough for 
everyone to hear, no one would have felt a need to respond to "that white 
woman." And BTW, the black woman you are referring to did not allude to 
anything she made a statement of fact quite emphatically.

Only someone like you would characterize this interaction as racial.

Now as for setting an example for one's constituency... when are you going to

Why must everything be a conspiracy theory event to you? Can you give no credit

I heard the same story. I know about 8,000 sq ft of land that's just been 
cleared. Seriously... this is a terrible thing if true. We don't have the money 
to temporarily house the fire trucks and fire fighters let alone acquire 
property and build a new fire house. Hopefully something can be done to get 
that building back to being able to be occupied.

tonight's Planning Board meeting. They are all in the WRZ. How come the  
Planning Board thinks B&Bs are a good idea in the WRZ?

Most people do not have a clue about the specifics of the plan
and will be shocked by the following:


Full property line buildout with 8 story buildings creating
Kingsley Alley.
Miniature sidewalks - for a new Urbanism plan that is supposed to
promote pedestrian movement, you better get used to walking single
file.
No parking for beachgoers
No parking for concert goers
Narrowing of all streets (the Ocean Grove effect)
Destruction of everything that gives the waterfront its character
with the exception of the boardwalk  properties, the berkeley
hotel and paradise

A friend of mine said it best when the plan was being voted on.
If any member of the City Council had property east of
Heck/Bergh/Grand they would not have voted to condemn all by eminent
domain.

One things for certain about this fire. It's not a good idea to rip up a major 
roadway and leave it unusable for months. Had Cookman Avenue been passable the 
Fire Department would have been able to get some water on the rear of the 
building. 

One thing that does not come out in most of the photos is that water from the 
ladder truck that was on the eastern side of the building rarely reached the 
fire. The water was shooting against the wind and even with all the skill the 
firefighters had and with all the water pressure they had they could just not 
battle Mother Nature.

[AsburyPark] Belmont and Atlantic Fire

A huge fire and the Belmont and Atlantic Hotels raged out of control for over 
an hour this afternoon as fire companies from no fewer than six neighboring 
fire departments tried to put out the blaze. The buildings are owned by Asbury 
Partners and were believed to be unoccupied at the time of the blaze. They are 
slated for demolition.

Could be... there was actually a moment when large chunks of the burning 
building were floating down and reaching the ground. Some even made it across 
the street to Anybody's and started a small fire in front the place. It would 
not be out of the question for that to happen again and for the Wesley Lake 
project to catch on fire. If I didn't have so many photos in my camera from a 
brithday party yesterday you'd see photos by now.

When I left there, about 15 minutes ago the fire was going as strong as ever... 
It's not over yet. Had to leave though... I'm still shivering from the cold.

Isn't it possible that there are other issues that "the partners" and the city 
meet on that have nothing to do with the renegotiation of the waterfront plan 
or the negotiations around the rehabilitation of the waterfront buildings?

I know that there have been regularly scheduled infrastructure meetings and 
that each year for the past couple of years there have been marathon meetings 
around this time of year to figure out who is responsible for getting the 
beachfront up and running (i.e., how many bathroom trailers and where will they 
be put.)

There are lots of issues that have been rumored about recently... everything 
from why the infrastructure is late... to when is C-8 going to implode. I'll 
bet there's issues that we don't even know exist, yet I'll bet they get 
discussed in marathon meetings all the time.

If I were a betting man, I'd bet that if there was a meeting on Wednesday, it 
had nothing to do with the city's attempt to renegotiate the rehab of the 
waterfront buildings.

It's funny he would say that...

Jim Aaron has no contract with Asbury Partners. (He better not!) He only has a 
contract with the city. His invoices are presented to the city and it is the 
city that must approve and pay them. The city is the entity that has an 
arrangement with Asbury Partners to reimburse it (the city) for these expenses. 
The city maintains an escrow account in which Asbury Partners is required to 
keep sufficient funds from which the city can withdraw to pay Mr. Aaron. It may 
be that either Asbury Partners is slow to replenish the funds, or it may be 
that the city is slow to ask for replenishment. In either case, if the funds 
are not in the escrow account, the city can't make the disbursement(s).

Same thing happens for payments to professionals of the Zoning and Planning 
board as well as payments for UEZ expenses. If the entity that is responsible 
for bringing the funds to the city for disbursement is lagging, the 
disbursement can't be made.

BTW... the bill list is not a list of bills that will be "paid." It is a list 
of bills that have been presented to the city requesting payment and for which 
the CFO and City Manager have audited and found to be correct. Assuming that 
the Council approves each payment on the list, it will only be paid when/if  
"the City Treasury shall permit." In other words, in Mr. Aaron's case, the 
invoice might be approved tonight because it is on the "bill list" but it won't 
be paid until sufficient funds are in the appropriate escrow account.

Oak's blowing smoke... The bills he is referring to are less than $51K and they 
represent payments for both the Waterfront and General Attorney accounts. 
(i.e., not just "Mr. Aaron") With all the lawsuits the city has to defend

It's already a nice place to go for your lunch. There are at least six places 
to get lunch downtown every single day*. Be Green, Wish You Were Here, Aunt 
Bee's and Taka... Lunch can be had for under $10 in any of those places every 
day. Carmines and Red Fusion also serve lunch every day. I'm not sure of their

to be closed on Monday. If you want lunch on Monday, you still have a tons of

That's why e-mail that might be misinterpreted should carry a disclaimer.

Without the disclaimer, one can only read the words for what they are. 
Besides... the message from Maureen ended up in my "inbox"  before I also read 
it on the Asbury Park yahoo group. Since I had been in communication with both 
Maureen and Pete Walton over the quality of the audio (both over-the-internet 
and later-on-line) this looked like a personal reply. What should I have 
thought? While she never indicated that the complaints -- and I'd characterize 
my communications as recommendations and not complaints -- were not valid, she 
in as much said they were by her use of the word "perceived".

I have to question your objectivity here Maureen. If you think that the 
complaints (some from me) about the sound quality of the archived shows being 
"rotten" (your words) are merely perceived then you need to get your hearing 
checked. I've listened to the new archive of the Feb 2 program and the 
difference between it and the previously posted one is like the difference 
between night and day. There is no perception that the quality was rotten. It 
was rotten. On the previous version, the voices were virtually unintelligible 
and, for the most part, Councilman Johnson was not even audible at all. In the 
new version, everything is as crisp and as clear as it can be for this type of 
audio streaming.

(I have both files if anyone wants to hear the difference)

I thank you for doing whatever it is you did to make the quality better. But at 
the same time, you need to just own up to the fact that the archived audio 
sucked and not blame your listeners for their "perceptions."  And I apologize 
if my attempts at prodding you to raise the bar on your own program were 
thought to be "unprecedented whining and gnashing of teeth" ... that won't 
happen again.

Will the BlueBishop, who was quick to distance himself from MOG's religious 
views likewise distance himself from President Bush's inference that same-sex 
relationships are immoral institutions that must be shielded from children and 
equating them with the lobbying scandals that have plagued his Republican Party 
in recent weeks?

For the State of the Union address:
"Many Americans, especially parents, still have deep concerns about the 
direction of our culture, and the health of our most basic institutions. They 
are concerned about unethical conduct by public officials, and discouraged by 
activist courts that try to redefine marriage," said President Bush, ethically 
tying marriage equality for same-sex couples to kick-back scandals that have 
led to the indictment of Republican House Leader Tom Delay and a senior White 
House official.

"I am encouraged by the progress the President has made in appointing judges 
'who are servants of the law' and who refuse 'to legislate from the bench,' 
marriage is a concern that cannot be left to the prerogative of the courts," 
said Family Research Council President Tony Perkins in reaction to the address.

Immediately after President Bush compared the recognition of same-sex marriage 
to Republican ethics scandals, Republican National Committee Chairman Ken 
Mehlman emailed Republican supporters in response. Mehlman urged past 
contributors to the Republican National Committee to sign a petition supporting 
the points President Bush made in his address, and to contact Congress to 
convey that support. The request was followed by a solicitation for "soft 
money" funds for the committee.

Hardiplank is one of the preferred materials for some of the folks I know who 
are rehabbing their homes. They frequently do not use it however, because it is 
so expensive. If indeed Westminister is using Hardiplank then the "quick buck, 
hit and run" theory seems not valid.

Jim Nappi, a local Asbury Park attorney, opens the first
Quesdays program to an overflow crowd.


Asbury Park - Over 60 people, some from as far away as Scotch
Plains and Newark, packed Asbury Park's TAKA Japanese Restaurant on
the evening of Tuesday, January 24, 2006, for the inaugural Quesdays
program sponsored by the jersey shore Q spot.

The jersey shore Q spot is a program of the Jersey Shore
Community Center Project (the Project), a New Jersey nonprofit
corporation established to foster the health, well being and pride of
individuals, groups and families within Monmouth and Ocean Counties'
gay, lesbian, bisexual and transgender (GLBT) communities. "The
Quesdays program is our regular series of workshops, seminars and
panel discussions meant to engage, educate and inform the GLBT
community about various topics that are of particular interest to us,"
said Joe D'Andrea, the program's organizer and the secretary of the
Project's Board of Trustees.

On Tuesday evening Stephen J. Hyland, an attorney from Princeton,
and Tamlyn Wilbourne, a financial planner from Red Bank, discussed
legal and financial planning issues for GLBT couples and domestic
partners. "By four o'clock Tuesday afternoon 20 people had
pre-registered on our website," said D'Andrea. "We were very
happily surprised when over 60 people showed up."

"And the attendees were both men and women representing
couples from every age bracket," added Jim Nappi, Asbury Park
attorney and Project vice chair who moderated the program.
"Responses like this convince us that our work to establish
the Q spot is well worth the effort."

Refreshments were generously donated by TAKA, Be Green and Asbury
Park Roastery, all of Asbury Park, and Knockout Graphics, also of
Asbury Park, provided graphics and printing services.

D'Andrea indicated that future programs include a February 7th
presentation by local psychiatrist and author, Martin Kantor, who will
discuss his recent book, Together Forever: The Gay Man's Guide to
Lifelong Love, and a March 14th update on HIV Prevention and Outreach
that will be moderated by Project chair and nurse practitioner,
MaryAnn Vitiello, and include presentations by local HIV counselors,
Dennis Rivera, Frank Englebert and Kelvin Roman. "We're hoping to
eventually offer three Quesdays programs a month," said
D'Andrea.

Probably the same place lots of other people got it. The Court, as you know, 
will often (always?) circulate electronic versions of their decisions to the 
parties involved in the case, as well as to the press, prior to posting on its 
web site. Considering the number of plaintiffs and defendants in this case, I'm 
surprised there aren't thousands of copies posted all over the internet by now.

The "quo" is the promise to procure contracts. No contracts have to be 
exchanged for a crime to have been committed. Much the same way that agreeing

That sounds like Assistant City Manager James Famularo's explanation for why 
his backyard deck was 20' larger then what he had a building permit for. 
Famularo told the Zoning Board -- and I'm paraphrasing -- that he ordered a 10' 
deck. Paid the contractor for a 10' deck. But when he came home from work one 
day he had a 30' deck installed. In Asbury Park such things happen with amazing 
regularity. So it's not impossible for a new driveway to appear either. But if 
such a thing happend it would be a miracle and not a crime.

Keep your friends close and your enemies closer is an expression that comes to 
mind. Besides, you're not giving any credence to anything Asbury Partner's 
"sanctions" are you? You don't give them that much credit on a good day. Why 
give them the power to pass judgement on who they hire and don't hire. Remember 
it was Asbury Partners who hired as their Promoter  a gentleman who, it was 
reported, was found guilty of embezzlement and had outstanding fines from the 
SEC. Skip knows more about this then I do.

A former Asbury Park councilman and the owner of an Asbury Park
restaurant were indicted on federal charges Tuesday that they
conspired to accept bribes from a contractor who was cooperating with
the FBI.

John J. Hamilton, 55, and Vincent "Vinny'' Baker, 61, were
charged with conspiring and attempting to accept bribes from a
cooperating government witness. Hamilton also was indicted on witness
tampering charges.

Hamilton, along with 10 other Monmouth County officials, were arrested
in a far-reaching FBI sting earlier this year.

Baker, the owner of Jennie's Soul Food restaurant in Asbury Park, was
arrested Tuesday and was scheduled to make an initial appearance in

Sorry Dan... it's another "only in Asbury Park" situation. The issue of

Enforcement Commission's website for "The Future Is Here." I did see filings 
for the individual 2009 municipal candidates: Bruno, Johnson, Loffredo and 
Sanders. Two other people -- who independently looked at the ELEC website from 
their own computers on Saturday -- confirmed that there was no entry for "The 
Future Is Here." That's why on Saturday morning I said: "There does not appear 
to be a filing for a committee named "The Future is Here" and that would appear 
to be a violation of NJ election law."

Since things aren't always what they appear to be, I took a look again this 
morning. Guess what... Now there is a filing for "The Future Is Here" on the 
ELEC website with a filing date on 10/17/2005.

I have been contacted by Jim Bruno on the issue of whether or not a candidate 
committee can spend campaign money on defeating a ballot question and he tells 
me that according to "the Election Office" the Future Is Here is "well within 
our right to spend our money" on the referendum. I have not verified this for

Look carefully my friend. This batch of red signs, as well as a
letter mailed to residents, are paid for "The Future IS
Here" -- note the slight variation in the name of the committee.
A review of NJ -ELEC website shows that the Bruno, Loffredo, Sanders
and Johnson committee "The Future Started Here" closed out
their 2005 campaign fund on July 15 and transferred $13,866.17 to
"new account". If you look further on that site, you'll see
that Bruno, Loffredo, Sanders and Johnson have already registered
as candidates for the 2009 municipal election. There does not
appear to be a filing for a committee named "The Future is Here"
and that would appear to be a violation of NJ election law. It would
also appear to be a violation of NJ Law for a candidate or candidate's
joint committee to spend money to promote or defeat a ballot question.
NJ statutes clearly delineate six acceptable categories of
expenditures that are allowed for candidates or candidate committees.
Aiding the passage or defeat of a ballot question is not one of
them.

Another apparent violation of election law. Sort of tells you
something about the people who are working so hard at the last minute

I'll bet the answers go something like this:

Eminent Domain: All four will be against it if a person's primary

Housing: Here's the one category of your limited categories where

Now if you really want to see a debate, you can ask them about
the one issue that they disagree on:  equal rights for everyone
including gays and lesbians. You can ask Kean and Coredemus how it can
be that they claim to have strong support in the gay and lesbian
community when they didn't even vote in favor of the state's domestic
partnership registration act. (Kean abstained and Coredemus voted no.)
Doherty and Reilly are advocates for equal rights for all citizens and
have made specific outreach to the gay and lesbian community including
a fund raiser this very afternoon at Club Paradise. Republicans Kean
and Coredemus' idea of reaching out to the gay community is having Tom
De Seno calling me on the phone.

Here's another question... Since Doherty and Reilly have
committed to opening their legislative office in Asbury Park once they
are elected, you can ask Kean and Coredemus if they will do the same.
Better yet... you can ask Kean why he moved his legislative office
out of Asbury Park in the first place.

I can't help but notice that rather then deal with the question at hand -- why 
the 11th district republican candidates expect to seek the support of gays and 
lesbians when they did not vote in favor of DP benefits and to this day have 
not explained why -- you'd rather concentrate on the questioner.

Funny that it's frequently you who accuse others of avoiding the question at 
hand.
