[AsburyPark] BREAKING NEWS: Court Affirms Religious Zoning Law - JSRM will win appeal

2007-10-18 Thread Lighthouse Mission
BREAKING NEWS: Court Affirms Religious Zoning Law
by James D. Besser
Washington Correspondent

A federal appeals court in New York has upheld a law protecting
religious institutions from undue interference by local zoning
authorities in a case involving an Orthodox day school.

The controversy, which has raged since 2001, involves the Westchester
Day School's plans for a $12 million expansion and complaints by
neighborhood residents that the expansion will worsen the area's
traffic woes.

The three-judge panel, supporting a lower court decision, ruled that
Westchester authorities improperly denied a permit application by
the school.

The case is widely seen as an important test of the 2000 Religious
Land Use and Institutionalized Persons Act (RLUIPA). That law was
passed in response to complaints by Orthodox groups and other
religious communities that local authorities too often discriminate
against religious schools and houses of worship in zoning rulings.

The law also protects the religious rights of inmates in state and
local prisons.

The village of Mamaroneck has not indicated if it will appeal the
decision. If it does, the stage could be set for the first major
Supreme Court test of the land use provisions of the 2000 law.

Orthodox Jewish groups hailed the ruling.

"This is a very important decision not just for the Orthodox
community, but for religious institutions in the Tri-State area and
around the country," said Nathan Diament, public affairs director for
the Orthodox Union. "We're pleased that the RLUIPA statute, which we
worked so hard to pass, is being interpreted by the courts in the way
we intended."

2007-09-21 Thread Lighthouse Mission
Gabrielleobre, thank you for you frank and informative comment.

So may I conclude that you would like for the Jersey Shore rescue
Mission to remain in Asbury Park?

Would you be opposed to the Lighthouse Mission, now in Long Branch,
being forced to relocate, if they loose the litigation between them
and the developer, would you be for, against or no position?

Thank you

Justified Right

Kevin just finished the bible study. He is here now and tells me you
do not live in Asbury Park. Is this true?

I am trying to collect data and it would be helpful to me, if only
Asbury Park home owners make their feelings known.

I am not for or against the Jersey Shore Rescue Mission, nor am I for
or against the Lighthouse Mission relocating to Asbury Park. I have
a short time to gather data for a report I am preparing.

Thanks for your help.

Hello Gary Wien. I agree that there are many areas in New Jersey as
well as our country that need services for people in need. Those
services would even be best, when they are not funded by tax payers
dollars.

How long have you been living in Asbury Park, and is it your opinion
that The Jersey Shore Rescue Mission should close in Asbury Park?

Are you also opposed to the Lighthouse Mission relocating to Asbury
Park, under the threat of eminent domain from lower Broadway in Long
Branch?

Thank you for your responses.

Actually, the choice is not mine or yours, but I do understand where
you are. You have made your feeling well known. I need to hear from
more than a few people on this. So let other people have an
opportunity. I know you are against "holy rollers" I also know you are
against anymore churches, and non profits. As a resident of Asbury

Justified Right,

I do not appreciate you making (me) your problem.
I agree, there is a problem. I checked with Kevin before I posted
this, so I am certain it's true from his perspective.

There seems to be roughly 5 people at most who post on this yahoo
group that do not get along with Kevin.

It also appears your condemnation of Kevin is based on his support of
the Jersey Shore Rescue Mission.

I am going to buffer this situation as best as humanly possible. We
made a decision to speak for the mission in addition to Kevin
speaking for himself.

Have a nice week end.
