[AsburyPark] buy high on west side .......sell beachfront cheap
One does not have to be a real estate expert to see how suave the current leaders of Asbury Park are. Last council meeting in October, the public was told the beachfront triangle was sold to Asbury Partners for $490,000 with a minimum fee of a dollar a year for the new mansions to have patios on public green space. The ten multi-- million tri-plexs will have views of the ocean, lake and sewage plant. Reading this article, it seems like Uncle Phil screwed Asbury Park tax payers once again from the grave. Anybody else want to buy or sell land to people in charge of running the city. Thank god the state of New Jersey believes in Asbury Park leadership and keeps giving state aid. My other comment, would less expensive, out of county, lawyers have gotten us the a higher price for the beach front and retrieved the Springwood Ave lots free with eminent domain or time of essence letters for lack of payment in full. Does anybody know why the lots of Springwood Ave became the subject of a long law suit? Was it the past city leaders or the city lawyers who dropped the ball. In any case, at least the Westside will have fresh start, even if the tax payers don't know what going on. ASBURY PARK — The city and the company of the late power broker Philip Konvitz have reached a court agreement for Asbury Park to pay $700,000 to get back 50 vacant Springwood Avenue lots on which Konvitz failed to build on from 1990 until his death at age 95 in 20 05. Superior Court Judge Louis F. Locascio oversaw the settlement between Asbury Shores and the city, which was agreed to late last month and the City Council approved Wednesday night. The city will tap into the $2 million it has received so far for affordable housing and community projects from beachfront developer Asbury Partners, to buy back the land located on approximately three blocks of the Springwood Avenue corridor. "The vote you just witnessed is a historic resolution for this city," said City Manager Terence J. Reidy. "Since July 4, 1970, Springwood Avenue has either been blighted or underdeveloped, and this had a significant social impact on our city," Reidy said, referring to the date of civil disturbances. Councilman Ed Johnson said, "This settlement is living proof that the past is over and we are moving on to the future." There could be a holdup on the sale going through if a third party, Somerset Development Corp. of Lakewood, decides to pursue an appeal of litigation over the Springwood sites that started in 2002. Somerset had contracted to buy the property to build market rate housing. But Asbury Park residents in 2005 objected to the plan and the city developed a new Springwood Avenue Redevelopment Plan under Councilman Johnson for the entire seven or eight block-length of Springwood from Memorial Drive to the Neptune boundary. Robert D. Broege, the attorney for Konvitz's estate and companies, said Somerset has 45 days to make an appeal. Ralph Zucker, Somerset's president, declined20through a spokeswoman to comment. "I do think everyone's happy that it's done," Broege said. "We hope it will do some good for Asbury Park." When negotiations to settle the continuing litigation began in September in Locascio's chambers, it appeared at first that Somerset might make a new deal to pay off Asbury Shores and start building on the land according to the new city plan. But the city responded with certain financial and performance assurances for such an agreement and Somerset walked away. Somerset had sought in 2007 to get Superior Court Judge Lawrence M. Lawson to force the city to transfer Asbury Shore's rights to Somerset. But Lawson ruled against Somerset. It is that decision, after a series of mediation and negotiation attempts, Somerset may still appeal. "We want to get construction going," said Deputy Mayor James Bruno. "Now that we've got the land, it's time to do the plan." Konvitz, a friend of the late Asbury Park Mayor Thomas Smith, started building small two-bedroom town houses on Springwood in 1990. He built 15 of 75 homes priced in the neighborhood of $75,000, but could not sell them. He shut down his efforts and said many years later he had lost more than $300,000. Konvitz was to have paid the city $750,000 for the land, but that never happened. Instead, he was given a credit for infrastructure work to offset the price of the land. He certified in April 1998 that the amount of money he had spent for infrastructure was $139,848. Asbury Shores did start payi ng taxes on the 50 lots after they were transferred to the company in 1999 in anticipation that Konvitz would build. In the 1990s, when Konvitz did not build, the barren landscape of the once-popular Springwood continued to be marked by poverty and drug dealing. Friday was the one-year anniversary of the U.S. Supreme Court's ruling in a Connecticut case — called the Kelo decision after Susette Kelo, who fought efforts to take her home for redevelopment in New London — that affirmed the government's right to take private property for economic development. But in the year that followed, said speakers at protest rallies here and in Asbury Park to mark the date, the nation has become galvanized to stop the use of eminent domain — the government's right to take private property for a public purpose — to benefit other private individuals, such as developers. "One of the great things about this movement is it brings us together to fight a terrible, immoral movement by government," Bill Potter, who runs the New Jersey Coalition Against Eminent Domain Abuse, said at a rally in the Marine Terrace, Ocean Terrace and Seaview Avenue (MTOTSA) area of Long Branch that has become the symbol of the eminent domain controversy here. "You're trying to live the American dream the way it is supposed to be lived," Potter said. More than 100 people showed up at the evening Long Branch rally, carrying signs that read "Enough is Enough," "K. Hovnanian, Leave Us Alone," referring to the regional developer that is tied to the city's redevelopment, and "Stop, Stop, Stop." The event drew people from Trenton, Lodi, Piscataway, Newark, Bound Brook, Asbury Park and Neptune. About 20 people attended the midday Asbury Park rally, including those from Neptune and Long Branch. Asbury Park Councilman James Keady called for a statewide moratorium on eminent domain abuse. He said city officials voted to take property "without just compensation." "It is not for the good of Asbury Park," Keady said. "It is for the good of out-of-town developers who are going to reap millions." Kerry Butch, 41, of Asbury Park, an organizer of the earlier rally, called the use of eminent domain for redevelopment projects "immoral, unjust" and "absolutely wrong." After the rally, Asbury Park Deputy Mayor James Bruno defended the city's redevelopment plan and said the majority of the council is committed to the agreement. "This is for the betterment of the entire city," Bruno said. Many of the city's critics "don't know how it was through the '80s and '90s," Bruno said. "It was a blighted area and we had to do something that would save this city." Friday was also a day when Long Branch Mayor Adam Schneider again offered to negotiate with full-time residents interested in acquiring condominiums in the new oceanfront development that some homeowners say is unfairly displacing them. Schneider said he talked with Gregory S. Russo, vice president of Applied Development Co. of Hoboken. The company and Matzel & Mumford, a subsidiary of K. Hovnanian, make up MM-Beachfront North II LLC, the redeveloper of the second phase of Beachfront North. The condo offer remains on the table, he said. "Absolutely," Schneider said. "We've felt from the beginning of the process — going back a dozen years — people who lived down there, we'd like to keep them on the oceanfront the best we can . . . We'd be willing to sit down and see if we can make that work." Schneider reaffirmed the offer one day after the city prevailed in a bitter court battle with MTOTSA property owners over the right to take their properties. "We will not stop here," William Giordano of MTOTSA said. "We will fight on." For Louis T. Anzalone, the condominium offer holds no appeal. "Tell the mayor I don't want no condo," Anzalone said Friday night. "I don't want to go into a tenement on high." Superior Court Judge Lawrence M. Lawson in his decision Thursday had questioned whether the residents had engaged in "good faith" negotiations after they had accused the city of failing to do the same. Farber Farber differs with senators on corruption AG opposes mandatory prison Posted by the Asbury Park Press on 06/16/06BY TOM BALDWINGANNETT STATE BUREAU TRENTON — Corrupt politicians should not necessarily have to go to jail or lose a pension, the state's top law enforcement officer said Thursday. "I oppose mandatory sentences," including jail time, said state Attorney General Zulima V. Farber at a Senate Judiciary Committee hearing on how to fight public corruption. Farber favors "harsh penalties" at judges' discretion but said she would oppose forfeiture of a pension by a politician or other public employee who had gone bad. Her opposition to mandatory sentences is well known. She said it would be unfair, for example, to deny the pension of a 30-year government veteran who turned corrupt in year 31. But Sen. John Adler, D-Camden, who is chairman of the Senate Judiciary Committee, differed. "Crime is a crime," he said. "There should be forfeiture," not just of pensions but freedoms, Adler said. He said he favored "mandatory jail time for public figures who violate the public trust." This point of difference is expected to sharpen in Farber's tenure. The Legislature has been moving toward tougher penalties and more restrictive laws, at least in terms of public corruption, which is counter to some of Farber's positions. The committee called Farber to testify as political corruption remains a leading concern in New Jersey. Since 2002, about 200 public officials in New Jersey have been indicted by federal and state authorities. "What can we do to make New Jersey less corrupt?" Adler asked Farber. "We can do better coordinating with other agencies of government," she replied. "We are all on the same team here. We are not in competition," Farber said. She added later: "Allegations are just that, allegations. If allegations are not supported by sufficient facts, a person should not be forced to face public scrutiny based on rumor and innuendo." Farber said confidentiality would be a hallmark of her term in office, and "we will aggressively pursue and develop leads." Adler, saying he was speaking as an irked New Jersey taxpayer, later ticked off areas where Farber should act promptly. "She should lay off more people in the Division of Law. It's still bloated," he said. He added later, "I want us to take action against wrongdoing. We hear of these investigations. Months and years go by. We never hear about it. . . . I am startled we have not indicted anybody in the Schools Construction Corp." That is where billions have been unaccounted for in the state's effort to rebuild or replace outdated school buildings, mostly in poorer districts. "Was fraud perpetrated on the taxpayer?" Adler asked. Adler had asked Farber at the outset of the committee hearing to explain what she was doing to clean up New Jersey. She said she was shifting 20 extra lawyers into positions to fight public corruption. And she said she had reshaped her office so that prosecutors have broader mandates. Asbury Park needs a lots of important issues to over turn the judge's decision. The safety of the children, when the dogs are not chasing them away, could be a hot button and lot easier to rally around. I feel a transit village is the best use of Memorial Drive section in AP. Corporate offices could provide many kinds of jobs for AP residents. The mission has made it clear what it is bringing to AP. How many AP charities go out of town to bring in new clients to keep their staff busy while collect government funds and grants, while keeping the rest of Momnouth County safe? Don't give up asking the whole council for help, remember most of you voted for them! It's interesting that two of the three main architects of the Redevelopment Agreement are under investigation. Lets see if Terry Reidy, Laura Jewels, John Lofferdo, Kate Malina and Kevin Sanders will still run up and embrace Faiella at the council meeting any more. Maybe they think the STAR-LEDGER made the stories up. Ms. Nevin told the old council and Mr. Reidy a long time ago about Faiello track record in Newark. All Nevin got was blank looks and a smirking Faiella in the audience. The charismatic and shrewd Faiella knew he had the council and city manager eating out of his hand. Nancy Shield and the Press, as for as anybody knows did nothing to follow up on the story. Will Laura Jewels or Terry Reidy cut Al Faiella from any lists just like they did to some taxpayers at the C-8 Implosion on May 3? Loffredo said at the following council meeting he personally happy that group of taxpayers where cut from the list. Jewels was not forth coming what she said about the cut list of taxpayers in front of 8 men at a C-8 demolition meeting. Will Jimmy Arron head up a defense fund for Faiella soon? Will John Lofferdo feel uncomfortable if Faiella show up at another campaign fund raiser. It interesting that Lofferdo and his running mates accepted and kept Faiello and his wife campaign donations till just a couple of weeks before the end of the last May election? Honest mistake? Lofferdo campaign accepted money from people all over the country according to an article in the press. How come the Partners are not running thousands of dollars of ads in the Coaster this year like last year? Long Branch antagonists react to report on eminent domain Posted by the Asbury Park Press on 05/19/06BY CAROL GORGA WILLIAMSCOASTAL MONMOUTH BUREAU State Public Advocate Ronald K. Chen made friends when he came to Long Branch two weeks ago to tour the redevelopment areas and visit with those affected by eminent domain, the people he met say. But opinions are divided on whether his report, released Thursday, goes far enough in addressing the controversial practice. Mayor Adam Schneider said Chen's recommendations "sound reasonable." But for Frances T. DeLuca, who lives in the Marine Terrace, Ocean Terrace and Seaview Avenue area commonly known as MTOTSA, any document that permits the continuing use of eminent domain, however limited, is problematic. Chen makes two key points in his report. One is: "Unfortunately, in New Jersey, the current laws governing the use of eminent domain for private redevelopment do not adequately protect the rights of tenants and property owners." The other is: "The Department of the Public Advocate believes, however, that redevelopment of truly blighted areas is a legitimate public purpose that serves the greater good by helping revitalize communities and create more opportunities for residents." Defining "blighted" Bill Potter of the statewide Coalition Against Eminent Domain Abuse said Chen, a constitutional lawyer, did much to refocus the debate on constitutional arguments. Those arguments include what leaders meant by a very specific definition of blight in 1947 and in 1949 when the Legislature first attempted to define the term. In the 1992 Housing and Redevelopment Law, blight was changed to "an area in need of redevelopment" and the definition became vague. "If the advocate's position were law today, or was being interpreted by courts that way, we wouldn't see all of this eminent domain abuse in Long Branch or Asbury Park or Lodi," Potter said. He predicted lobbying by developers, the New Jersey League of Municipalities and local officials who don't want the law changed. "I anticipate — what's the _expression_ — a long hot summer," he said. Because of New Jersey's population density, aggressive land preservation and smart-growth policies and with efforts to channel growth into cities and towns that have already been developed, the prosperity of New Jersey's communities "is more reliant on redevelopment than perhaps any state in the nation," Chen writes. But why should current residents have to suffer because of that, asked DeLuca, who supports Chen's call for better public notice when municipalities are attempting to declare an area a redevelopment zone. "This is not done because you want space," DeLuca said. "This is done because the oceanfront is prime real estate . . . If we're running out of land, we should stop building." On fair compensation William Giordano, whose family owns a home in the MTOTSA community, also believes it is wrong to use eminent domain to take the property. But he was gratified to learn Chen's report includes provisions for increasing compensation for homes that are taken. Schneider said Chen's proposals, while varying in some specifics, would not change in substance the way Long Branch approached redevelopment more than 10 years ago. Long Branch was in a unique position because its governing body had the staying power to see it through, which is unlikely to occur nowadays because of the controversy over eminent domain, he said. But except for the last three years, Long Branch's redevelopment has been without controversy, Schneider said. "He's acknowledging, from the sound of it, revitalizing is for a public purpose," Schneider said of Chen. "Once you acknowledge that, most of the arguments that have been made against what we have been doing fail." Assemblyman Michael Panter, D-Monmouth, said he was pleased Chen addressed eminent domain but said his recommendations didn't go far enough. Panter said his bill (A-537) would prohibit the use of eminent domain for redevelopment of all properties that are up to code. Michelle Bobrow, whose seasonal home in Beachfront South could be seized by eminent domain, said she thinks the report is "a good start." "It will level the playing field so that developers and municipal governments can no longer define the agenda," she said. She wants to see the ethics reform that Chen proposed make it through the Assembly Commerce and Economic Development Committee. "If we eliminate pay-to-play in allowing developers to make sweetheart deals with municipalities, I think we'll go a good way to remedying some of the ills of the situation," she said. Bobrow is concerned, however, because some members of the Assembly are mayors who rely on the power of eminent domain in their hometowns. "While they acknowledged a need to change the law, we were told in advance that not everyone would be happy," she said. "If they give us a fighting chance, I'll be happy." SPONSORED LINKS

VOLPEGANNETT STATE BUREAU TRENTON — The state needs to make it more difficult for government to use eminent domain for redevelopment and require fairer compensation for those whose property is taken, state Public Advocate Ronald K. Chen said in a report released Thursday. The report — Chen's first charge as the state's first public advocate in more than a decade — says current eminent domain laws "do not adequately protect the rights of tenants and property owners." The way the law reads now, Chen said, even his Berkeley Heights home could be subject to eminent domain if township officials decided they could get more ratables. "We must ensure the rights of New Jersey families are protected," Chen told the Assembly Commerce and Economic Development Committee, adding that the state's eminent domain regulations need serious reform. The process "must be for redevelopment and must be limited to truly blighted areas," Chen said. "Under current laws, a family can have its property taken but the compensation it receives may not be enough to allow that family to ever own a house in their community again. This is unconscionable." A U.S. Supreme Court ruling last year in a lawsuit against New London, Conn., gave wide latitude to local governments wanting to seize private property to promote economic development. List of recommendations The report, issued in response to that ruling, recommended several legislative changes, including: More specific and objective definitions of the term "blighted." Clearly written notice to residents who may lose their property. An appeal process for residents whose property is deemed blighted. Offering residents the opportunity to rehabilitate their properties themselves. Relocation plans for displaced tenants. Compensating homeowners whose sites are taken by the amount it would cost to buy similar property elsewhere in town. Stricter pay-to-play laws limiting campaign donations by redevelopers. Chen released his report online, then presented it before the Assembly panel, which has been holding hearings this session on whether to change redevelopment laws. Both Sen. Ronald Rice, D-Essex, chairman of the Senate Community and Urban Affairs Committee, and Assemblyman John Burzichelli, D-Gloucester, committee chairman in the lower house, said they are preparing legislation to prevent abuse of eminent domain powers. Gov. Corzine, who was only briefed on the report, said he "probably had a more aggressive position" during the campaign than Chen advocates. He proposed limiting eminent domain to rare and exceptional circumstances. "I think there is hope" Michelle Bobrow, a Maplewood resident who owns a home in Long Branch and is concerned municipal government may take the latter house, was pleased with Chen and lawmakers. "I think there is hope," Bobrow said. "I certainly am optimistic that the process is moving fast enough to save my home and my neighbors' homes." Environmentalists, who want eminent domain restricted, said the report was a good solution to abuses of eminent domain. "The question will be whether the Legislature implements it," said Jeff Tittel, director of the New Jersey chapter of the Sierra Club. Assemblyman Guy Gregg, R-Morris, liked the proposal even though he prefers a public referendum to restrict eminent domain for private purposes. "We should put it on the ballot — extreme cases — and we should define it very tightly," Gregg said. Chen said he would not advocate abolishing eminent domain nor call for a moratorium until reform is enacted. Property owners need protection Posted by the Asbury Park Press on 05/4/06Eminent domain — the taking of private property for public use — is as much about people as it is about property. It's about George Salamone, at 96 probably Neptune City's oldest taxpayer, worried about whether he will have to sell his home of 65 years because it is located in the borough's redevelopment zone. Or Grace Cangemi, whose four-family Long Branch house was lost to eminent domain for the new Pier Village parking garage. Her family is still challenging in court the "just compensation" awarded for the taking. It's also about municipalities luring development to increase the tax base and the town's commercial-residential mix, ostensibly for the economic good of all residents, and condemning properties that stand in the way. The use of eminent domain for economic development when it involves owner-occupied residences and businesses cannot be justified, philosophically or morally. Eminent domain should be primarily limited to its traditional purpose — acquiring property to build highways, bridges, schools, hospitals and other clearly public uses. Swift action is needed in Trenton. Lawmakers should overhaul the state's redevelopment law to ensure that blighted areas are clearly defined and that all parcels, such as the Salamone home, are considered individually when declaring an area in need of redevelopment. And they must ensure that satisfying the constitutional mandate of "just compensation" for people like the Cangemis goes beyond the value of the land at the time of the taking. It must consider the value of the property after it is redeveloped and allow the property owner to recoup the costs of relocating and any legal fees incurred in challenging the taking. Eminent domain abuses and efforts to correct them were the focus of the Press' series "Private Property/Public Gain: The Battle Over Eminent Domain," which ran Sunday through Tuesday. The issue has not escaped Gov. Corzine's attention, who said Tuesday that reforming eminent domain use is a top priority. He has told Public Advocate Ronald K. Chen to recommend reforms quickly, a report that will signal how aggressively Chen will advocate on behalf of the public. New Jersey is among 40 states considering eminent domain reform, so Chen and the legislators have many sources to draw upon. They should take a particularly close look at reforms approved recently in Indiana and Georgia. Indiana flatly prohibits the condemnation of private property for economic development. Georgia has tightly defined "blight" — primarily as a danger to public health or safety — and requires individual parcels, not just a whole area, be designated as "blighted" before being subject to condemnation for private development. Legislators in New Jersey are calling for a moratorium on eminent domain for redevelopment projects. Assemblyman Michael J. Panter, D-Monmouth, says he will introduce a bill for a 24-month halt while lawmakers consider reform. That's too long. A tighter time frame, perhaps a year, would put pressure on the legislators to act on their own or on Chen's recommendations. Corzine's ability to issue a moratorium is limited to "dire emergencies." Eminent domain, however important, doesn't qualify. But the governor can stop state government from exercising eminent domain for private development, which Panter said would send a message indicating how he feels about the practice to the municipalities, where most of the condemnations take place. Corzine should follow up on this suggestion. Property owners like Jo-Ann Kalaka-Adams must have a voice. Her furniture restoration business in Long Branch is threatened by eminent domain. "If someone doesn't want to sell their property, I don't understand why they are being forced to do it," she said. Neither do we. Trenton must put an immediate end to the abuse. Frances T. DeLuca's family has owned homes on the same street since 1918. Their residences are among 36 private properties Long Branch wants to seize -- using its power of eminent domain, taking property for public use - for redevelopment of the area into oceanfront condominiums.As highlighted in the Press' three-day series "Private Property/Public Gain: The Battle Over Eminent Domain," which concluded Tuesday, this property rights campaign is playing out most forcefully in Long Branch. Mayor Adam Schneider calls the use of eminent domain "a tool of last resort." But he says the area where the Anzalones and DeLucas live is blighted, one of the criteria under the state's developer-friendly redevelopment law. So, the city is seeking to condemn the properties of 24 of the 36 homeowners who have not agreed to sell to the developer of Beachfront North Phase II.The homes along Marine Terrace, Ocean Terrace and Seaview Avenue are not blighted. It is an area of small, well-kept houses. It is morally reprehensible for Long Branch to force the people who live there out of their homes. They have stayed with the city through good times and bad. Casting them aside is no way to say "thank you." Schneider should renegotiate the city's contract with the developer and see that the plan is redesigned so that the developer can maximize his profits without interfering with this established neighborhood.Eminent domain should not be applied for economic development at the expense of owner-occupied residences or businesses. It's not fair to residents or merchants -- taxpayers all - who have devoted their lives to the municipality.The battle that pits property rights against economic development is not isolated to Long Branch. It is a national issue. That's far too broad.The New London ruling has put eminent domain on the national agenda, too. New Jersey is among 40 states that are considering or have enacted legislative reforms of eminent domain laws. The House of Representatives has passed a bill restricting federal funds to states or towns that use eminent domain for commercial development.New Jersey's Legislature must act to bring equity to the state's redevelopment law. The definition of blighted land must be clear. And the law must provide standards of "just compensation" to property owners whose homes are already targeted and in those rare occasions when eminent domain is justified.The tool of eminent domain cited by Schneider is really a hammer over the heads of the homeowners. Once their home is targeted, their property value is frozen. All they can do is negotiate with the developer based on the current use of the land. That, too, is unfair. It's unlikely they can find a replacement home for that price and they can't afford to buy one of the million-dollar condos that would rise on their property.For the Anzalones, the $304,000 appraised value of their oceanfront home won't go far. "I could not build a garage for a bicycle for that price," Louis Anzalone said, perhaps exaggerating to make a strong point. For DeLuca, the prospect of condemnation is an assault on the area's history. He was a communicant of Trinity Episcopal Church, Asbury Park. He was a member of the board of directors of The Center, and the Jersey Shore Q-Spot, both Asbury Park. Mr. D'Andrea was born in White Plains, N.Y., and lived in Manhattan before moving to Asbury Park in 2001. His mother, Mary Tracey D'Andrea, died in 1997. Surviving are his father, Joseph J. D'Andrea, Gainesville, Va.; two brothers, Thomas D'Andrea of Jersey City, and Richard D'Andrea of Farmingdale, N.Y.; a sister, Mary Lou Capri of Green Brook; and his lifetime companion, Will Elliott. The Funeral Mass will be offered at 2 p.m. Saturday, May 20, from Trinity Episcopal Church, 503 Asbury Ave. at Grand Avenue, Asbury Park. There will be no visiting hours. A past deacon with the Presbyterian Church on the Hill, Ocean Township, she also was active in the Asbury Park community. Ms. Townsend was predeceased by her brother, Charles Miller Jr., in 2005. [AsburyPark] My deepest Sympathy
Would have written sooner, but dsl is acting up...disonnecting I was sorry to hear about Joe. Even if you did not agree with him, I myself, always took the time to listen what he had to say on this forum. You did not have to be a personal friend of Joe to know how much he loved AP. He always had the time to get the facts straight. I'm glad I told him for years, I appreciated his input to this group and to the city. His many years of gay activism and journalism help propelled AP as a positive place to live in. As far as I knew he always had time and energy to pitch in to make things right. When I had a car accident last summer, even when I told him it was OK to leave, he stay with me till the police arrived. He would remind me of that a few times and I always told him I would have done the same, Joe. Joe showed all of us that even if you disagree, it important to stick to the facts and listen what the other person has to say. I will miss your good points at the council meetings and driving around town. His love for the gay community, of which he was a leader, and of the community-at-large, of which he also was a leader, did not end until he was rushed to the hospital with chest pains late Sunday afternoon. He died soon afterward at the age of 52, apparently of heart failure, touching off a wave of sadness in people who knew or had met him. D'Andrea maintained the city's Web site, was co-owner of the West21 Systems technology company, and was publisher of the gayasburypark.com Web site. "Joe's one of our hometown heroes," said Thomas Gilmour, the city's director of commerce. "Besides the fact that he worked so hard for the city, he was my friend. We had different opinions, but when we left each other, everything was settled." Gilmour was one of several people who said they saw D'Andrea downtown Sunday in the early afternoon the day he died. D'Andrea was a prime mover of AP Action, a political action group founded early in 2005 by members of the gay and lesbian community to educate people about issues and endorse candidates in the city. The group formed a viable voting block, and its endorsements won. He left the AP Action board of directors recently to focus on finding a home for a gay and lesbian community center to be located in the city. "He was still very supportive of us (AP Action) and maintained our Web site," said Rod Siberine, a board member, on Monday. "For me, it's amazing that all of these people who knew him but weren't the best of buddies with him are feeling this overwhelming sense of grief. I can only equate that to how you feel about people who do great things. He was such a positive force for this town. "He had a good sense of humor, and he didn't take himself too seriously," Siberine said. "Anybody who knew him, even if you didn't agree with him, you could never say he didn't have the best interests of Asbury Park at heart." During the past two months, D'Andrea experienced chest pain and told a reporter that he was treated at first for an ulcer, and then subsequently was found to have major blockage of his arteries. He said he was undergoing stent placement procedures and had the last two done on Thursday, said Kevin Russell, a close friend who served with D'Andrea on the board of The Center, which provides many services for people with HIV and AIDS. "He was feeling great until 4 p.m. Sunday when he had a really bad chest pain," Russell said. "He died at the hospital. Will was with him. He was joking with the ambulance drivers." In the Press today under the description of the Asbury plan, it says 6 lots owned by two property owners were acquired by eminent domain. Does anyone know what lots these were and when? I believe according to the plan if land is acquired then it must be developed within a year. You are right..I was told by Rita that somebody in city hall told her place was on the agenda for Wednesday night. And not by the city manager, although why did he not call her? Her and her lawyer response is that she believes that the partners did not follow the correct steps to take her place before the process taking them to eminent domain by the city? Does the partners have a paper work to ask the city to make a motion? I wonder if the city even follows its own guidelines. One of her question is why her place and not all the lots on her block were brought up at the last meeting. Why could she not just sell her land directly to the company that wants to buy the whole block. Why does Larry have to be the middleman. Who are his real partners? Or puppets. She was already told, whom? who has the dibs or already wants to buy the whole block. Does this company not want to rock the boat (lawsuits) with the city or the partners? Did the city or Larry find out she was talking to a developer directly? Are the negotiations in the works for months or just days or hours before the public gets the news? Maybe some on the council, some of the city employees and Larry feel their problems will go away if only the silence the detractors. Why not just give Rita and the other property owners the going rate for land and something reasonable for the time they paid taxes to the city while others did not. That part of my problem with Terry Weldon, the 3 stooges( they must think they are the Musketeers), and the Partners . New condos, 14 stories high with retail, according to the news will be sold for $400,000 - $4,000,000 each. So how valuable is the land that is in private hands? Six years ago under the new plan, the public was told the condo would sell for $250,000.00 - $400,000.00 and owners of empty lot(s) may be worth $90,000 - $150,000 in the redevelopment zone. I would think if condo would now be listed for 10 times the value in six years the land value would be close to that or more. Building costs and fuel did not go up that much in 6 years? Taxpayers in Asbury Park paid $4,867,928. Eight years later, those figures remain the same. Now, with the state facing a budget deficit in excess of $4 billion, the administration of Gov. Corzine has asked the state Supreme Court to approve school tax hikes in eight of the state's poorer school districts. Eight of the state's 31 so-called Abbott Districts are affected. Perth Amboy and Asbury Park among them. But they are alone in challenging the governor. This week, in a brief submitted to the Supreme Court, attorney Richard Shapiro, who represents Perth Amboy and Asbury Park, stated, "The acting commissioner of education has no constitutional or legal authority, in the absence of enabling legislation, to direct local boards of education to increase their local tax levy." The Abbott Districts were created following a ruling by the state Supreme Court in 1981 that requires the state to provide extraordinary funding to poor districts. Twenty-five years after the ruling, the Abbott districts spend an average $3,000 per pupil higher than districts elsewhere in the state. Since 1997 local property taxpayers in the Abbott districts have paid about $2,000 per pupil, a figure that has been frozen. During that same period, taxpayers elsewhere have seen their per-pupil spending increase from $4,792 to $7,126. The court challenge by Perth Amboy and Asbury Park is a response to a brief filed last week by Attorney General Zulima V. Farber asking the court for its approval of the governor's 2007 budget on matters relating to the Abbott districts. The state argued, "The Abbott districts have not been required to exercise the fiscal discipline that the state and other school districts must undergo; instead they have been allowed to balance their budget through the virtually unlimited supplemental funding requests." I don't think Arron was involved with expanding Duany's theories. Most of the above city officials scraped almost every suggestion the planing board recommended. Just plain wrong...the reason the people do not come to meetings is because the old council either choose not to listen or not capable of thinking out side the box. Most people who are regulars do not complain about the remarks from the audiences, but the faces and stares from the council. Most new comers cannot believe what happens in the meetings. Tape the meetings. The city manager knows how to act professional. He never made noise or remarks to inflame the audiences. Even Keady and Johnson hold their cool. Keady and Johnson have excellent people skills. The council still needs to learn the Roberts Rules of Order. I used them. Follow the rules, everybody feels equal,and still be friends after the meetings. Respect goes both ways? What does the council learn at the League of Municipalities Conference? The mayor goes to the Black Mayors Conference. Lofferdo went to the Gay Leaders Conferences. The truth be told the council is better now than ever. They look professional. Less disruptions than ever before. Most of the noise comes when the taxpayers are not getting a fair deal. Stop wasting tax dollars. Joe, to deny that the mayor showed favoritism to the woman who spoke against Rita by applauding her comments is, in fact, to deny the reality of what happened at the meeting. Also, to deny that this was racist on his part is to deny the reality of what he does and has done at previous meetings. Case in point, the meeting where he allowed a woman in a red dress to trash an older woman in working clothes. We have also witnessed many times when certain people were allowed to go beyond the 3 minute limit at the mike and others were told to sit down or be removed from the room. You have a short memory, my friend, or else you just don't want to see what is in front of your nose. My whole point is that as an elected official of the city, he owns it to his constituency to be fair to everyone regardless of his/her ethnic background. As to your remark about my "constituency," need I remind you that I do not hold a public office and therefore am not held to the same standards of behavior as the mayor of our city. And not for nothing, Joe, you really need to watch your use of the word "everyone" as in "everyone in the room laughed." Only three, maybe four people joined the mayor in what he thought (in his ignorance and theirs) to be a "funny" comment. Only 2 where clapping their hands. I don't usually comment on what goes on at a council meeting, but at the last council meeting our mayor showed his hand when a black woman in the audience went to the mike and made a derisive comment alluding to a white woman in the audience and our mayor laughed and applauded her remarks. As an elected official, he should be setting an example for his constituency; not overtly showing favoritism for one ethnic group over another. Had Nancy Shields been in the audience, the incident would have appeared in the Asbury Press. I think in the spirit of what TOM and DAN said, Weldon was asked to return his pension and the $65,000.00 of over payments to the city treasury. The press has run many articles about cutting off pensions to civil servants caught breaking the law. Weldon could afford to buy some redemption. The Partners may want to pony up matching funds since, according to Kate & Jimmy, Weldon was the clever negotiator at the redevelopment contract talks, and perhaps Aaron can run a firehouse fund raiser like the one he ran for Weldon’s defense a few years ago. If the firehouse is still short on funds, the city manager can sell (bond) the air rights over city hall and the streets to help pay for the new firehouse? Then someone from the old boys club will, no doubt, suggest that the firehouse should be dedicated to Weldon. After all it was his political machine that helped get the old council elected (the future starts here). This in turn helped the Partners redefine A P’s future. Is Weldon’s vision still reshaping A P? Naming the building after Weldon is not a bad idea, because the old boys club still don't think he did any thing wrong in A P. This will also help the new beachfront community better remember the man that made their new home possible. ~~ Ocean has 3. Wanamassa with (2) houses - the original plus a nice new one they built - in the center of town, taking out ratables (houses). The new Wanamassa firehouse is great focal point for that community. The building is excellent condition, well kept, and location that represents community pride. Didn't Mr Weldon help secure that building? Mr. Weldon still enjoys lots of support in Ocean Township. I'm not a union member. The fact is most union workers have better work skills than most of the labor force. As for fire dept. and police dept., their unions keep the standards high, for your protection. This small city needs a paid professional fire department. It's the city officials lack of responsibility that the firehouse happens to looks the way it does. AP firehouse is a handsome building. Restoration and upgrading the building would best define community spirit and pride. It's location is fine. You happy now? Man of God "leads on" as times change around him ATLANTIC HIGHLANDS — The trajectory of the Rev. Henry P. Davis Jr.'s life took him from his birthplace in Texas to Mississippi, Montgomery, Ala., and the battlefields of Korea before he found himself as the pastor of St. Paul's Baptist Church. Now a 33-year fixture of the unassuming, 105-year-old church, Davis is quick to emphasize to his congregation the importance of what helped him throughout his life: Education, education and more education. A college graduate at the young age of 19, Davis said he tries to instill a love of learning in every young person who walks through the doors of St. Paul's. And it's not just from the pulpit that Davis has had achance to touch the lives of others. Davis is the president of the Red Bank chapter of the NAACP, chairperson of the Monmouth County Board of Alcohol and Drug Abuse Services, moderator of the Seacoast Missionary Baptist Association of New Jersey, a member of the Monmouth County Youth Services Commission and of the Monmouth County Minority Youth Vicinage Committee. If that seems like an awful lot of balls to keep in the air at once, consider that Davis once managed to work full time teaching electronics at Fort Monmouth, attend classes at New Brunswick Seminary at night, and preach at the church in Atlantic Highlands — all while raising four children. How does he do it? Davis said he always leaves it up to God, and has always found a way. Davis likes to quote Psalm 118:23: "This is the Lord's doing, and it is marvelous in our eyes." "He is probably one of the nicest, most highly qualified individuals I have ever met," said Atlantic Highlands Borough Clerk Dwayne M. Harris. "As a man of God and a minister, he is most entertaining and educational." As the son of a public schoolteacher, Davis blossomed in the classroom. After completing a one-year tour in Korea, and living for a while in Montgomery, Davis decided to take a correspondence course on electronics. This would eventually lead him to move to Fort Monmouth in the early 1960s, where Davis taught electronics for 17 years before retiring in 1987. But there was another, more powerful calling in Davis' life. The minister said he felt drawn to the ministry in 1967, and almost wound up enrolling at the Princeton Seminary in 1968. But he decided to attend the New Brunswick Seminary at night instead, along with his son. Both graduated from the seminary on the same day. Much has changed from the days Davis spent as a youth in Texas. Even when he joined the Air Force in 1950, blacks and whites were kept separate — there was a black Noncommissioned Officers club and all-black squadrons even during the Korean War. "Dallas, for example, was extremely racist back then," Davis said. "You couldn't even shop at a Neiman Marcus at the time." But the times have certainly changed. Now, Davis' own niece is running for public office in Dallas. St. Paul's Baptist Church began from a tiny seed in 1899: A man named Vasser L. Peake came to Atlantic Highlands and started the church with a group of 13 fellow blacks. The church has always been linked to the Quinn Chapel African Methodist Episcopal Church, which is about 150 years old. The black community surrounding the church, however, has diminished over the years, which Davis attributes to the shifting cultural demographics of the Bayshore. "It seems that every time a black family moves out of this area, a white family moves in faster than they can put up a for-sale sign," he said. "There's just an attraction to the area." Harris, who attends Quinn Chapel A.M.E. and has worked with Davis on the Red Bank NAACP, said the shrinking black community in the area poses problems for the future of mostly black churches like St. Paul's. But both Harris and Davis are confident that area churches will continue to thrive. In fact, St. Paul's now draws members from Red Bank and Tinton Falls, Davis said. "It's just the Lord's blessing — a small group of people trying to be faithful to his word," Davis said. Though the congregation may be smaller than other churches, St. Paul's is known as a place that inspires many of its members who get involved at an early age. An example is one boy who began attending services when he was 9 years old, who has since gone on to become a pastor of Good Hope church in Asbury Park. "It's because of him as a person, how he coaches people and treats people and mentors people," Harris said. "He's the kind of type who comes up and says, "This is what we need you to do, and this is how we're going to do it,' and he leads on. I would trust Labor Ready for a lead on someone that can be vouched for. Most of the workers have a raptor with Kevin and his staff. His workers, for the most part spend their money in town and know local tradesmen that can speak English. At some point, hire your new friend directly. The best thing I do, when I buy a house somewhere, is eat at a local places. You meet neighbors who will recommend local tradesmen and workers. Somebody usually knows somebody who is honest and/or good helper. The hardware stores, local food stores, and plumbing places have lots of leads to follow up on. Your local friendly realtor may offer a name of a handy man. You can negotiate the price and task(s) up front before the job starts. Do not use anybody who does not have any references. (you should know somebody who knows both of you) Mistakes are expensive. A closet drunk could get hurt on the job. In Asbury Park, I usually hire neighbors. They become your friends and watch out for you. If Spanish is your second language, do what you want. SCOTT FERGUSONSTAFF WRITER ASBURY PARK — Temporary trailers to house the city's on-duty firefighters should be in place today as construction crews and engineers continue to address structural problems with the turn-of-the-century firehouse. The trailers will arrive two days after the state Office of Public Employees' Occupational Safety and Health forced the city's 42 paid firefighters to evacuate their three-story headquarters on Main Street and Asbury Avenue after a firefighter placed an anonymous call about a 3-inch gap in a second-story floor. On Tuesday, Fire Director John Murray emphasized that the city's emergency services will continue despite the fact that several parts of the building remain off-limits to firefighters. "We wanted to let everyone know that we have taken every avenue available to bring the people back to work here," Murray said at an afternoon press conference at fire headquarters. Despite the sign on the front door that said "Keep Out," Murray said much of the first floor, including the bay areas that house the department's vehicles, remains usable. In addition, the department's communications room has continued to function. The Monmouth County Sheriff's Office, Jersey Central Power & Light Co. and other city agencies have offered their services to help with emergency calls and other communication needs, Murray added. To show its commitment, Murray said, the department "had firefighters sleeping on the floor (Monday night) to make sure the city was covered." The problems with the Fire Department started last Wednesday, when the firefighters' union told Murray about a 3-inch gap on the second floor that was causing the floor to drop. During a tour Tuesday, Murray said it appeared that a staircase leading down from the second floor had been removed at one point, but the gap it left had not been properly repaired, which may have led to a sagging floor. Although Murray said the department and the city's engineer worked throughout the weekend on the problem, Monday's anonymous call to the state forced firefighters out of their headquarters by that afternoon. Since the city's firefighters work 24-hour shifts, trailers are to be brought in by today to give the firefighters a place to stay, Battalion Chief Kevin Keddy said. The department will contract with a Jackson company for the trailers. The South Orange Fire Department in Essex County has had similar problems, and the idea for the trailers came from firefighters there, Keddy added. By Tuesday, the second floor had been shored up with metal poles. Doru Tomas, a senior engineer with French and Parrello, a Wall engineering firm, said the building had a number of structural problems, but it would be some time before all of the defects could be found and examined. In the meantime, the Fire Department's business continued. On Tuesday, Inspector Garrett M. Wanting a new firehouse is nothing new. Others where knock down in the past or closed down. Five years ago, the city officials and occupants of the building did nothing to stop the bricks from falling off the corner of the building. It was to show the world that the old building was falling apart brick by brick. For 4 months, at council meetings, I talk about the firehouse shabby appearance . Even the sidewalk was unsafe to walk on both sides of the firehouse. When the bricks were finally cemented back in place, Weiner said they did the repair job historically wrong at a council meeting. At the same time Terry Weldon was helping one of his buddies' assembly lots on Langford St. between 1st & 2nd Ave. A house on 1st Ave was knocked down without a permit by the buddy. That how the story broke. Terry's plan was to have his pal own the new firehouse and lease it back to the city someday. He was the city manager. The rest is history. The press did a small story about the need for a new firehouse. Five years later the city officials and the same council did nothing to fix up the most handsome firehouse on RT 71. Brady Beach restored their firehouse 2 years ago. Tom, do the taxpayers vote on a new firehouse? DIAMONDBUSINESS WRITER To Donna Harrison, a computer consultant from Asbury Park, her company's benefits program means much more than health insurance or a secure retirement: It tells her whether her employer truly embraces her. So when SunGard Data Systems bought her previous company three years ago and offered benefits to her and her partner, Kathy Ragauckas, a retired Monmouth County worker, it erased any hesitation she might have had in the corporate takeover. "It makes all the difference knowing you're working for a company that respects your lifestyle, your orientation and the people at home that help you do the job you need to do," said Harrison, 44. Ocean County freeholders recently engaged in an intense debate over offering domestic-partner benefits, and a growing number of private-sector companies are offering such benefits for their gay and lesbian employees. Company officials say the decision to extend benefits beyond traditional married couples boils down to their desire to attract talented workers regardless of their private lives. But experts say gays and lesbians have yet to participate without hesitation. "Employees who are gay and lesbian are often reluctant to reveal that to their employers," said Stephen Hyland, an attorney who specializes in estates, trusts and domestic partnership issues for Hill Wallack in Princeton. "Therefore, they choose not to obtain these benefits because, basically, they don't want to come out." The idea of offering benefits to domestic partners attracted the spotlight recently in Ocean County, where Laurel Hester, a law enforcement officer stricken with cancer, lobbied freeholders to allow her to leave her pension benefits to her domestic partner, just as heterosexual workers can leave their benefits to their spouses when they die. The freeholders at first resisted before changing their minds in the face of public pressure. Hester died shortly after. The private sector more frequently is extending the benefits it offers married employees — such as health insurance — to gay employees who certify they are in a committed relationship. A survey by the Society for Human Resource Management, an Alexandria, Va.-based trade group, found 32 percent of employers offered domestic partner benefits in 2005, up from just 16 percent in 2001. The sharp increase has come even though companies have tried to rein in the skyrocketing cost of benefits, ranging from health insurance to pensions. "You're obviously going to be at a disadvantage if you are going to recruit workers that might not look at a company that doesn't offer benefits like that," said Jen Jorgensen, a spokeswoman for the human resources group. Some New Jersey companies, such as Lucent Technologies Inc. have offered same-sex benefits for nearly a decade, while others expanded their benefits more recently. Newark-based Prudential Financial Inc. began offering domestic partner benefits in 2000 to help it stay competitive with other financial services companies and attract a diverse group of workers, said Ellen Borak, vice president of health and welfare benefits. She said gay and lesbian employees, like all employees, sign up for benefits online. They certify that they have lived with their partner for at least six months and are in a committed, serious relationship in which they are financially dependent on each other. The benefit has increased the company's health insurance costs by 2 percent, Borak said. But she said it also has sent a message to workers and customers alike that Prudential is an inclusive company. "I think it goes a long way to show what kind of company Prudential is: very diverse and attune to the diverse needs of the diverse work force," Borak said. "I've never heard of any business segment coming back saying we lost an account because Prudential is offering domestic partner benefits, but I have heard that it helps." Hyland said gay and lesbians still face hurdles, even when their employer offers same-sex benefits. For example, not all are comfortable disclosing their sexual orientation to their employers, so they don't participate. Additionally, employers can lawfully have a two-tiered system in which they pay the health-insurance premium of a spouse, but not a domestic partner. There are also different tax consequences. My guess, even an investigation will not produce any results. The building burned very fast, a large part collapsed before 6:20 PM, turning 4 floors into 1 floor of burning wood. Still could see flames at 9 PM from Sewall Ave. The building was used by the fire department for training drills for the last few months. At least the fire hydrants where working, protecting the near-by buildings. Hundreds of spectators. Lots of fire trucks parked by the firehouse and lots of firemen in the firehouse at 8:45 PM. Still lots of truck and men at the fire at 10:00 PM, this very cold night. At 10:00 PM you can hear the helicopter from one of the major news channels. Now, the fact is that the asbestos, if any, will not have to hand removed, it went up with the smoke. In a few hours? Last year, the hotel next to ANYBODY's had to have the asbestos removed by hand, cost the Partners lots of money, many delays and D E P inspections. Maybe a large fine. Between the hotel and theater, the asbestos trailers where parked in front of ANYBODY'S on Cookman Ave, for months. During the early summer, the Ambassador on 3rd had similar asbestos problems delays during it's demolition. Something that someone filled out the demolition reports wrong, stating there was no asbestos in the huge commercial building. The police and state became involved. For somebody who only had a few weeks to write the story, he said what Nancy could never say in 4 years. She objectivity was busy using the word "critics" when people spoke up at the meetings about the missed deadlines in the redevelopment plan. Even the Press's Editorials Talk about missed opportunities and another summer with the beachfront looking run down while Cookman Ave and the rest of the city is picking up. The Beachfront is the is why most people came to AP for the last 130 years. To I don't think the story was totally negative. Depitro lied in it, he didn't win anything last month, Metro defunked what Depitro said about negotiations with the Partners, that story could of been a lot worse. The reporter got a few things wrong. I'm not impressed. Could you explain why you think Depitro lied, he did win something(s) in court and still appealing other things in court that will actually help other land owners in the redevelopment zone. Are you spending any of your money in lawsuits to protect your property rights. Could you explain why Glen Fishman could not connect with the the reporter. He connected well enough with Malina, Lofferdo, Saunders, Bruno, Weldon, and Aaron. Do you think Dean Geibel was actually encouraged by the way in which Partners dealt with him about the C-8 site. You have not heard of any stories of other people doing business with the Partners in AP. I wonder what Dean will say about the Partners in a few months, in the next year, and what law suits will come between them in the next few years. In an interview, Asbury Partners' principals, Glen Fishman and Hugh Lamle, declined to discuss their dealings with subdevelopers like Mr. DePetro. Mr. Lamle, however, suggested that some of the criticism comes from those who sought to pay bargain-basement prices for development on prime real estate. On the issue of the boardwalk buildings that they are supposed to develop under the plan, the two said they had conducted marketing studies, but they would not disclose the results. They said only that there was "great interest" among developers for the properties. The builder of the Esperanza complex, Dean Geibel, president of Metro Homes, said he was satisfied that Asbury Partners had dealt fairly with him. He said that development fees and infrastructure fees, which affect the selling price of units, are commonly the subject of negotiations in such deals. He also said that he had agreed to deed over some of the commercial space in his planned buildings to Asbury Partners and that it was justified by the redevelopers' need to "control the type of retail and tone" of the area. "It is the way for them to make sure that the beachfront area is what they want," he said. "I was actually encouraged by the way in which they dealt with this part." [AsburyPark] City Officials needs your Guidance
I stopped by AP City Hall today after what was talked about last night at the council meeting. 1. Why would the city officials even consider selling of some of it's park land. Does the state have any safe guards about selling or trading green space off without pubic bidding. What about the century old Brady restrictions. Who really cares about R D R, not the best redeveloper in town. 2. Is anybody aware the city manager wants to buy 6 SUV's at $23,000,00 each @ a total of $138,000.00. From a dealer in the Morristown area. The Fire dept gets 2, police get 2, and the city engineer and building inspector each get one. Would you agreed SUV's are gas guzzlers and usually are the most expensive to repair than an average full size car. Was Morristown the cheapest and closest place to purchase vehicles. Personally, I would shop statewide, then hunt for a dealer close by to match the contract. (The city manager has 2 sectaries and a public relation person. It's no rumor that some city hall employees are complaining about the staff that got better pay raises than others this year. Who is busy on the computer, looking for a new home. I said, tell the city manager.) Could some new SUV's be substituted with dealer's showroom demo's. What happen to the Gas Company used vehicles sold/gave the city a for a $1.00 each. So for it's only a purchase order. Maybe it is the best deal? Should taxpayers vote on it? 3. Should a small parcel of land on Memorial Drive, by the train station, be sold to the Highest bidder before the transit village report is presented to the city? Something about a clear title problem, that works for AP this time. 4. Should the talks between the Partners and the city officials be blocked from the public. ( could not download the AP article about the meeting last night. ) 5. A lot of reporters where at the council meeting last night. The city pubic relations lady could not fall over one of the reporters fast enough. I mean stalk. Phony smiles. Is her gig worth $60.000.00? Remember Gail O'Reilly gig? For the first time,last night, it looks like the ice between Loffredo & Keady could be melting. Maybe the election scares will finally fade away. A good thing. That's Metro's modus operandi. They are trying the same thing here. They went ahead and spent money before they had approvals and when you balk, they say that it's not fair. Some on the Council and this City think Metro is the white knight. While I like their building, I say slam the door on them unless they pay for the amendment. Having been to every Planing Board meeting that pertained to the Metro Homes project, the public was assured by the investors and their lawyers that Metro understood the financial risks they were taking. I believe they said the where going by the P L A N. No guarantees to rebuild a new C-8 if the steel frame was not safe. Plain and simple. No argument, no misunderstanding, its about steel above ground or in the ground. No guarantees from the Partners that Metro would even own C-8 if things went wrong or right, because of other paper work. Terry Reidy repeated the whole discussion in summery before the P B voted to let Metro start the design process, so that the whole room would understand what was about to happen. The pre-approval did not mean it was a slam done deal, only as to more things along, so Metro could start drawing while the structure inspection of C-8 site was completed by engineers. Was the pubic lead to believe that the inspection reports would take months. I believe the Press at some of the meeting. Pictures in the paper. All this according to the P L A N. Then the report funked the footings and then city officials start making excuses. Pulled the official P L A N off the web site. Who knows how many lawyers, architects, engineers, and planners where at each of the meetings representing the city, the Partners, and Metro Homes looked at that Plan. What P L A N were they given to represent their respective clients. Nobody ever said C-8 could be rebuilt if it came down. Metro was entering this part of picture at it own risk. Reidy, Metro, and the lawyers said so. Lofferdo, who is on the Planning Board offer up a different summery of the P B meetings at a council meeting. At Council public portion, he was call to task. At the same council meeting Reidy said nothing about his own speech at the Planing Board meeting. Are there tapes or notes of the Planing Board meetings available? Did many towns in the county have the property tax rate increases for the last six years like AP? How many freeholder voters will understand the need for tax abatements for condos with ocean view? Skip and Tommy I almost forgot what yahoo group I was on after reading both if your posts. I like you both, but stop belittling yourself. It really gives more information for Larry friends to mock the good work you both do. I was told Nancy and TCN read the postings. You should be thinking of truthful answers when the reporters ask in depth questions. Personally I would say a egoistic council could not wait to please Terry Weldon and city attorneys, who gave away the city. And be thankful the two newer council members can think outside the box for themselves, like the both of you. I enjoy reading your postings.. Just remember it was the N Y Times, not the TCN , Press, or the Coaster that brought car loads of investor and homeowners in the summer of 2000. Nearly a million copies of that N Y Times August 2000 article. I was told by the AP tax office in 2002 that nearly 600 AP deeds where transferred in 2001. My guess was only 175 deeds were transferred in 2000. That was before the city beachfront was given to M D Sass for pennies on the dollar. Borough Manager Terence Wall hopes developers like Rubinstein are lured to the project by the potential of building on virgin beachfront land that offers picturesque views of Raritan Bay and the New York skyline. "Basically, if it's blighted, it's a concept area . . . and a potential redevelopment area," Wall said. Czerniecki at its meeting Tuesday night. Czerniecki, 38, will be paid $97,500 annually. He is currently a consulting planner with Environmental Resolutions Inc. of Mount Laurel, but was manager of Eastampton, Burlington County, from 1999 to 2005. Eastampton consists of less than 6 square miles and has a population of 6,200. Czerniecki, who will assume his duties in Howell on Feb. 27, will be in charge of a township of 62 square miles with a population of 51,000. "I look forward to this opportunity to serve and work with the governing body and the residents of Howell Township," Czerniecki said. Eastampton's current manager, J. Scott Carew, said in a telephone interview Wednesday that Czerniecki has "great experience and has the full package to be successful in his new job." Carew succeeded Czerniecki, but they collaborated on Eastampton projects with Czerniecki in his subsequent job as a planner, Carew said. "Tom's loyalty to the well-being of the township and the direction we're heading was impressive considering he had moved on professionally," Carew said. "He still lives here and I'm sure if there's any free time away from Howell, he'll still be helping us out as a township resident. He and the town started a town center project we're continuing to work on." Czerniecki is replacing Bruce Davis, who held the dual role of manager and township clerk. Davis will remain clerk. Mayor Joseph DiBella said about 100 people applied for the job and 60 candidates were evaluated. The search was navigated by Cranford-based Jersey Professional Management, which has also been compiling an efficiency review of the township government under an $85,000 contract. The council interviewed several candidates, with some — including former mayor and police chief Harvey F. Morrell Jr. — being invited back for second interviews. Morrell, currently Allentown's public safety director, subsequently withdrew his application, officials said. Davis, 55, has been a township employee for 26 years. Council members said their decision to reduce Davis' responsibilities to clerk was based on a desire to separate the manager's and clerk's jobs. Davis' salary as clerk is $86,000 annually and he was paid an additional $52,000 as manager. Davis was acting manager for a year after Jacqueline Ascione was fired in 2001, then he was given the title permanently in 2002. Under the township's government charter, Howell has a five-member council, including a directly elected mayor, but the township manager is responsible for the municipality's daily operations. "Under our form of government, the manager is the CEO of a $40 million business," said DiBella, referring to the township's annual budget. "That's why we took the time that we did to find the right candidate." Czerniecki said, "The mayor and council undertook a thoughtful and rigorous selection process that has set a very professional and positive tone for the manager's office." CARMODYASSISTANT BUSINESS EDITOR FREEHOLD TOWNSHIP — The first thing shoppers at the new Wal-Mart and Sam's Club stores on Route 537 might notice is what the stores look like. Or rather, what they don't look like. There's no red, white and blue exterior, sitting blunt and squarish on the landscape just like the thousands of other Wal-Marts and Sam's Clubs that dot the globe. Instead, there's a subdued red-brick facade, along with a low-slung roofline punctuated by dormer windows and hanging over a colonnaded walkway. That's because Freehold Township, which was founded in 1693, has a 4-year-old ordinance requiring that new commercial businesses be designed with a historical look in mind. "Every Wal-Mart is a cookie cutter," said Thomas Antus, the Freehold Township administrator. "We told them if you want to build this, this is what you have to do." Wal-Mart and its warehouse club chain Sam's Club are not the only retailers to face the rule. Walgreen's and the Mount's Corner shopping center at the corner of Route 537 and Wemrock Road have a similar Colonial look to them. Retailers looking to build stores in town need to have the township's historic preservation commission review the proposed design. The commission then makes a recommendation to the Planning Board, Antus said. Wal-Mart, which spent 2 1/2 years developing and building its new stores, initially resisted, Antus said, but in the end it agreed to the architectural requirements. "The Township Committee was not bending on this," he said. Towns often compete with one another to attract businesses. Not only do they offer employment and shopping opportunities to residents, but they also pay property taxes without demanding much in the way of local services, unlike housing projects, which usually result in crowds of new schoolchildren to be educated. In most suburban towns, commercial and industrial properties make up about 9 percent to 12 percent of the property tax base, Antus said. In Freehold Township, home of the Freehold Raceway Mall, it's 25 percent, he said. Rhoda Washington, spokeswoman for Wal-Mart Stores Inc., said the company has made such architectural concessions to other towns in the past and was willing to do the same here. "It's part of our overall strategy to make sure we're part of the community," she said. No opening date has been set for the stores, which are in a new shopping center dubbed Freehold Marketplace. But Washington said she expects the stores to open by the end of this month or early March. The Wal-Mart is 150,000 square feet in size, while the Sam's Club is 153,000 square feet, bigger than the existing 104,000-square-foot store near the Freehold Raceway Mall. Combined, the two stores will employ about 300 to 350 people, Washington said. "The current (Sam's Club) is overshopped," she said. It is not clear yet what business might take over the space Sam's Club occupies now. Officials for the landlord, the Westmont Co., were unavailable for comment.
