Thanks, Mario, for the additional details on the Black Swan book. 
But you didn't tell me if you agree with Taleb's current prediction. That  
was my question.
  I still  say Charles Morris' book, Trillion Dollar Meltdown, is 
equally prophetic.  If I remember correctly, before I read Morris's book I read 
by means of an  introduction to it that Morris helped develope the software 
used by the  Masters of the Universe to create these structured products. But 
the 
software  was eventually misused by the industry. His book predicts the whole 
 collapse.
 BTW, for those who didn't see it last night, 60  Minutes on CBS reported 
on the fact that these toxic assets by and large had no  direct link to the 
mortgage industry anymore than betting on a football  game derives any security 
from the finances of the 'underlying' team.  So my earlier posts on this have 
been validated.
Now what? 
How's this suggestion for fiscal stimulus: 
Why don't the government wizards remove income limits on how much people  can 
earn in addition to their social security? Yes, Social  Security levels  are 
precarious too, but...  Right now, the Late Boomers, as we're called,  can't 
afford to collect our social security and carry our mortgages  because of the 
outmoded limit placed on what can be earned on top of it. This  would be a less 
intrusive way of securing mortgages, avoiding more  foreclosures and possibly 
even boosting consumer spending.

That's because the Conover case was moved to Somerset County for  
investigation, to avoid a conflict with Monmouth which would've been both  his 
employer 
and his accuser. 
When the grand jury delivered  the indictment, the case had to be 
moved under the Attorney General's  office, because Conover's alleged crime 
wasn't committed in Somerset. Since  the AG's office doesn't distribute press 
releases like the county prosecutors  do, none was distributed on Conover. I 
got 
the information because, after  reading the Monmouth County release about 
Doggett, I actually called the Mon.  Cty prosecutor's office and asked for a 
status 
on Conover's charges. 
 As a result, I was faxed information from Matt Murphy of the 
Somerset County  Prosecutor's office, who was for this purpose made a deputy 
attorney  general. I did see that Bob Jordan of APP did post a story on 
Conover yesterday.  I'd have to go back to see if that one mentioned Doggett 
though. 
I  should've added to my story that Conover is represented by 
Alton Kenney.  Kenney's in Jordan's report, saying that his county car was 
"inoperable,"  so Conover borrowed a private vehicle. And it was gas for 
official 
use that he  pumped into the privately owned car. 
What  bothers me is that whether Conover is convicted or not, no 
one has looked  into his handling of Asbury Park's emergency management. On 
the County  Emergency Coordinator's web site the office bragged that it has a 
100% record --  all municipalities in Monmouth County had current emergency 
plans filed with the  office. When I looked at our plan, which required an 
afternoon of sitting  outside City Manager Terry Reidy's office to gain access 
to the 
plan,  all I found was a stack of loosely piled pages with information on 
some of them  dating back decades, with the names of companies to call some of 
whom went out  of business years ago. Dead people to call. Someone has to look 
into this. How  many shore communities are in a similar situation? I know the 
AP fire chief is  working on getting the report together, but last I asked -- a 
year later -- it  still wasn't ready.

Are you aware that the pool area you're referring to is required by law, by  
our own ordinance, to be a public swim club? 
 There are certain realities involved in providing  for the needs of all 
age groups - as in 'the public' - which have to  be met. My remarks were not 
based on any aversion to luxury. I'd love  to lounge around a nice spot like 
that. But the public pool, public club,  is a hoop the developers must jump 
through in order to gain the right to build  the private, one would hope 
lucrative, swim club up the boardwalk to the  north.
 
At the planning board meeting the principals mis-spoke several times,  
calling the plan a "private" club. The design can be easily seen as a private  
looking club, inadequate for serving a large public, especially since it  is 
for 
the purpose of satisfying this obstacle and getting on with the  private club 
that they hope will seal the deal for the sale of the remaining  condos -- 
adjacent to the site of the future private beach club.
This makes sense if you think of it from the perspective of Asbury  Partners' 
interests in this retail LLC, which it has established with  Madison 
Marquette. The Partners can't get their percentage (I've heard 5% down  from 
7%) of 
the sales of the condos or the per unit pay back on their  infrastructure 
outlay 
- about $20k a unit -- which are guaranteed   through their contracts with 
the developers, until those condos close.  Also, the Partners retain the retail 
interests in the condo developments. I  don't know what deal they made with MM 
for a portion of the retail business on  the boardwalk. But this is also an 
incentive for the Partners to encourage MM's  plans for the pavilions.  So 
there's considerably more pressure to  move ahead with the pavilions than meets 
the eye. It's not just the coming beach  season.

My first exposure to computers was as a section editor for MIS - Management  
Information Systems - Week, a Fairchild pub. We filed on terminals, but used  
TRS-80s, from Radio Shack, when on assignment. We called them "Trash  
Eighties." 
I remember a guy telling me that the military had this major network that  
had only been used for military purposes and some academic stuff, which would 
be 
 going public eventually and would change everyone's life. How true!
But I don't remember it being called USENET. Wasn't it originally something  
else?

I forgot to mention the Wonder Bar and my glee to see that it's coming back  
in my 2 cents posted on Asbury Radio. Like to get your feedback. This is  
basically what I posted:
 
Motolla's Plans Stir  Hope & Questions 
The president and  financial head of Madison Marquette Investments, Gary 
Motolla, must have mined every big name in  the area over the past few months 
to 
put together his star-studded cast for  the boardwalk's revival.  
We don't see any  clunkers among the names we recognized, but are saddened 
not to see  Eddie Gaspar's restaurant in the First Avenue  Pavilion  (formerly 
The Tides) missing from the press release and news  report. Maybe we missed it. 
We'd like to see more  transparency in these announcements and plans. The 
announcement yesterday was  termed a “press conference”, but we didn't get the 
feeling there were a lot of  press questions answered, from the report by Nancy 
Shields in the APP, and we  don't see anything in the Star-Ledger today. 
Channel 12 had a report last night,  which seemed pretty much a replay of the 
press release with some local shots of  the boardwalk. 
What's nagging at us  --  
We agree  wholeheartedly with Mottola that the city can't come back without a 
concerted  effort to stimulate all its facets, including things seemingly as 
diverse as the  downtown business district and our educational system. 
Mottola's  willingness to take on the residential developments, since Charles 
-- tear 
 down that old historic carousel house, it's in my way -- Kushner decided to 
dump  Wesley Lake and run is wise, too. How can you say come and have a great 
time  when those empty windows are gaping at tourists like so many open 
mouths? But  what about the impossible deal Asbury Partners left hanging in the 
air, 
which  amounts to tentacles that remain in the project long after the 
property  deed is signed over? 
We're talking about,  in addition to the per unit development rights of about 
$100k per, the  7% piece on the sale of every unit, and $20,000 per unit for 
the  infrastructure improvement reimbursement, and the Partners’ retention of 
all  commercial rights on the sites. This is the piece of the story that never 
 gets discussed. When we’ve brought it up, we’re quickly hushed  up. 
This is why the  developers have been trying to achieve mission impossible - 
build quality units  with skilled labor with the best materials, and sell at 
market  rates, while giving the Partners their share -- and ride out a 
Recession,  and a credit and real estate Crash. No wonder it caved in. 
In the Press,  Hugh Lamle,  of  MD Sass, a partner in Asbury Partners, hinted 
at needing to help  Dean Geibel of Metro Homes, whose building the  Esperanza 
is now suspended in  animation, a cold reminder on the same piece of land as 
the famous symbol  of the last fiasco. "He got caught in this national 
financing debacle,"  Lamle's quoted saying. Was it the “national debacle” or a 
far 
more local one?  Perhaps the Partners' Mission Impossible Deal?  
He can’t do much about  the national economy but is Lamle willing to change 
this impossible agreement?  Loosen the handcuffs?   
Mottola is quoted  saying he needs to negotiate a subsequent redeveloper 
agreement with the  city for the boardwalk plans and an agreement on the 
Kushner 
properties. Is  this when the tentacles of the existing contracts with Asbury 
Partners will  bare their slimy barbs? Isn't the city itself, mum at yesterday’
s press  conference, also negotiating yet another agreement with the Partners 
-- the  global settlement agreement?   
Was Kushner's decision  to pull out prompted at all by his unwillingness to 
fork over 7% of the sale of  the Wesley  Grove units to Asbury Partners?  
Twenty-two have been sold; we'd like to know if 7% of those sale prices went to 
 
the Partners. It's time the residents and officials of Asbury Park knew the  
details of these deals.  
And, by the way, where  is Cherokee Investments? Last time we looked they 
were 50% of Asbury Partners.  Don't they have a say in this? Our former 
redevelopment attorney Jimmy Aaron said Cherokee put $30 million into the  
Partners’ 
pot. Did they sell their share? If so, who bought it?   
We have a right to be  in the loop, because it is our taxes, our businesses 
and our homes on the  line. 
If we're entering a  new phase with Madison Marquette let’s be sure we're on 
equal  footing. We can't be if only some parties know the details. Otherwise 
the plans  sound wonderful.

I put together some notes on last night's Council Meeting and Pete posted  
them up on AsburyRadio.com last night.  Thanks, Pete!!
I should've added that Werner Baumgartner had a very sober take on what  
worked out to be a passionate argument on whether the police were making enough 
 
effort to communicate with Spanish speaking residents. Werner noted  that last 
night's visitors to the chamber were there because of a terrible  tragedy, the 
murder of an Hispanic man. But proposed the answer is not to  add foreign 
language speakers in reaction to, say, a Russian, Haitian,  German, or other 
victim. "All ethnic groups are important," he said. "And  there's a common 
language they can share" to ensure unity. So Werner was  subtly encouraging all 
to 
share the English language without making that tired,  xenophobic sounding 
battle cry of "English-Only".

I'd like to underscore what Frank has said in his posting re. the APP report 
and Dan in his postings, as well.
 
Also, I just remarked to someone today that I can't figure out why Nancy 
Shields doesn't go into PR. She'd make a great public relations person for the 
city and/or waterfront developers.
 
Thirdly, Werner called to ask that I post something to thank all of those who 
have come forward to express their outrage at this sentence and general 
sympathy for his situation. He is very heartened by the outpourings of support 
and 
offers to help him finish the renovations. 
He was moved to a dorm setting today with about 60-70 beds in a huge room 
with a common area in the middle. And he's got his own PIN number so that he 
doesn't have to borrow a fellow inmate's PIN to make his collect calls. 
And, he is being represented now. Tommy DeSeno has taken his case. Tommy 
plans to file an appeal, then ask the judge for a stay of the sentence -- all 
tomorrow. Let's wish him much success.

Thanks for posting the agendas each month.
And I hate to reward you by laying this on you, but I have to ask what 
exemption permits the closed executive meeting on the waterfront matter? 
The plan has been passed into law and it has been amended twice that I know 
of. Since it is a public document shouldn't these negotiations take place in 
public? This isn't a contract anymore -- it's a municipal plan that may be 
amended.
A such I don't think it meets the definition of exemption for contract 
negotiations.
Could you state your opinion on this?

Just got another call from Werner.
He was taken out of the holding area yesterday (Sat.) at 11 AM and placed 
into Pod A-1 in the Monmouth County Correctional Institute, Freehold, where he 
is 
confined 22 hours a day in a 2-man cell with three people in it. He gets two 
hours out of the cell, one at a time, but the hours are chosen randomly.
One cell-mate must sleep on the concrete floor. Werner alernates between the 
floor and sleeping with a toilet in his face. Werner slept on a concrete floor 
in the holding area, prior to being processed, which included an injection 
for tuberculosis. There was no choice - the nurse said, "you have to take it," 
says Werner. She was reluctant to tell him what it was for.
 
The move to the Pod means Werner has to wait, possibly a week, for his own 
PIN number to make the only calls he's allowed to make - collect. For now he 
must borrow another inmate's PIN to call out. And the calls cannot be made to 
cell phones.
 
Werner says he obtained the refinancing necessary to comply with the repairs 
the city wants him to make on his house. He showed this documentation to 
municipal court Judge Apostolou along with the contract with 3C&G, a Middletown 
contractor, for the first phase of the repairs. He planned to select other 
contractors for subsequent work as things progressed. Ironically, the first 
payment 
on the refi was due yesterday. If he can't get payments made during his 45-day 
incarceration he may go into default on the loan. 
 
Why is Judge Apostolou being so severe? Residents of A.P. know a few property 
owners that have owed far more in code violation fines. A lawyer who works 
regularly in Asbury Park municipal court tells me he's frequently frustrated at 
how Apostolou "lets junkies out of jail all the time. And, this is over a 
porch!" But, this same lawyer says that the court saw that Werner had yet to 
start 
the work, which it saw as "inexcusable".  
Werner explains that it took a long time to secure financing because he has 
no income other than his rents and a $35,000 lien, he knew nothing about, 
surfaced in the process. The court wanted him to pay the lien and contest it 
later. 
But Werner didn't have the money to pay it and held that it was illegitimate 
Was Werner singled out last Friday? Hardly, a source close to the court says 
the judge sent lots and lots of people to jail Friday. Was he having a bad day?
If the jail is overcrowded it may work to Werner's advantage.
When he does get out, Werner better check out that 911 call that started all 
of this. Certainly his reputation was damaged by the false accusation that a 
body was in his basement. There should've been an official apology, since the 
department should've listened to the tape -- and when it did listen after the 
home was inspected, it should've taken a very public step in undoing the damage 
to Werner's privacy and reputation. What excuse can there be for not doing 
that?
For now Werner must beg for a pencil, since inmates aren't allowed to have 
money on them; yet they must buy everything, including something as minor as a 
pencil. 
Nagging questions remain. The judge only had before him the fines and the 
prolonged timeframe with which to pass judgment. However the officials who have 
made a cottage industry out of pursuing Werner - one property owner in a city 
of blighted properties - know if their motives are objective -- or not. Is the 
law being applied equally here?
Everyone in this city - regardless of how they feel about Werner Baumgartner, 
must ask their officials: was the incarceration of Werner Baumgartner an 
equal carriage of justice? Or an attempt to silence any public critiques of the 
city and its developers?

But Frank is right. If the judge had no alternative, why not opt for the an 
ankle bracelet. The correctional facility they sent Werner to actually monitors 
the bracelets. So why not simply use that to send him a message?
In light of this it certainly looks like intimidation to me.

Certainly the descriptions in the Star Ledger of how James used this 
non-industry woman to buy and quickly resell the properties sounded amazingly 
like the 
strategy Shearn described that Faiella used with his wife. 
Doesn't seem to me like James is a big property mogul type. So might wonder 
where that slick strategy came from.
I've been asking the Ledger to come to Asbury to look at this waterfront deal 
for years with no luck.
Other question is if Faiella is accused of being the brains behind the James' 
transactions, will the U.S. attorney open the redevelopment plan back up with 
the benefit of this insight?

Absolutely, the "negotiations" on the "agreement" have to be in the open. The 
deal between the partners and the city was passed into law. How the city can 
exempt talks about amending that law under the contract negotiation clause, 
which they've done before, is beyond me. 
 
If someone would take that case on, I think they'd win. This is the job of 
the established press. They have the attorneys on retainer. But they'd rather 
go 
on about the success of the OPRA laws. OPRA is great. But how can they ignore 
the obvious, which is that once these private meetings result in public 
records, most of the damage is already done. Yes, then we can examine the 
details 
of the disaster later. Hmmm.

I'm amazed by the Press' reaction to this MM deal with Asbury Partners. The 
editorial board interview was a cream puff job. No financials -- again!! The 
only way to be confident of the partnership is to know what they're in for - a 
dime or a dollar. What's the commitment? Is there an out clause? Do we get to 
see this contract - ever? 
And, why should it cost AP anything? 
Can you say Breach of Contract? Does anyone recall the Dispute Resolution 
Agreement? 
Isn't this allowing the Partners to dodge another commitment and more 
deadlines? Tell me where it's not so.  
Another round of negotiating is necessary, says Bruno. Another round of 
private - out of the public eye talk among the principals - who don't include 
you 
or me. This basically allows the City to acquiesce instead of pressing its 
rightful legal position with the Partners. Now the City will be one more entity 
removed from enforcing its rights. Gees, only a lawyer like Faiella could feel 
comfortable plunging into a tangled web like this one. Oh, that's right, 
Faiella is the Partners' lawyer. 
What did the editorial board story say, Lamle is a 50% partner? Lamle? We 
know that Cherokee is a 50% partner. So who's out of the game? Or is the Press 
just playing loose with the facts again? As in oh they declined to discuss the 
financial end of this reportedly $150 million investment. The financials are 
the story!!! 
How does the City enforce its interests in this deal if it's between the 
Partners and MM? 
Sure I'm glad somebody got out there and cleaned up and prettied up the 5th 
Av pavilion and opened businesses there. What's not to like? But this city 
isn't a little girl to be told, "Don't look a gift horse in the face." This is 
just the time when we should be looking that horse straight in the eye. 
As we used to say, we've been down so long anything looks like up. But this 
is just the time to be most wary. 
Just tell me why the city is giving anything up now. We've got a signed deal 
- two signed deals. Why should we make a third? Isn't it allowing the Partners 
to square the deal with MM? If so, the City is giving the Partners the 
equivalent of millions to give to MM in order to buy the Partners’ way out of 
their 
hole with the City.

Think it's important to note that this excerpt from the Times is the LA Times 
and it's about a Calif. beach -- not A.P. I got your point, Mario, but 
someone else may not catch it on a fast read.

Now, ques.: how long does it take for fecal matter to make its way back from 
a point 1700 feet offshore?
I'm wondering, which process didn't the 'matter' undergo? 
Item: Asbury has a secondary treatment plant, which means the stuff is 
treated with primary and secondary processes. Back when dinosaurs roamed the 
earth 
and I took environmental science in college, terciary care was considered the 
way to go, mainly because everyone thought it was time to stop dumping sewage 
in the ocean. So with the millions that we've bonded on that same plant, lots 
of times for improvements to the plant, why don't we have the most current 
technology in there? Maybe the science failed for the terciary stage somewhere 
down the line after the textbooks were written. Anyone know?

On Asbury Radio's concerns of the past year and longer about the lack of an 
emergency response plan for Asbury Park, may we call your attention to the 
realities discussed in today's editorial in the APP. 
Whether you agree with the proposed fund or not, you may want to ask Asbury's 
leaders to show a little more initiative in getting the plan finished. 
"Hurricane modelers predict that a Category 3 hurricane that makes landfall 
in Asbury Park would put Newark Liberty International Airport under water. The 
devastation caused by such a storm would not only wipe vacation homes off the 
shoreline, but destroy block after block of the homes of low- and 
moderate-income families who happen to live long distances from our coastline. 
The 
destruction of Tropical Storm Floyd, which affected towns throughout the state, 
would 
pale by comparison."  From today's commentary in the Asbury Park Press by 
James Lee Witt, former director of Federal Emergency Management Agency under 
Pres. Clinton, and James M. Loy, reatired Coast Guard admiral and former deputy 
secretary of the U.S. Dept of Homeland Security.

commissions on those condo sales? 
I think your summation is probably on the money - pun intended.
As for new police, we have had the cars patrolling Ocean Ave and sitting 
outside the construction sites for a long time. But they were in squad cars. 
Maybe 
we didn't have plain clothes in sufficient numbers - and plain cars. The city 
did the bust and they sure have had plain cars cruising around for quite a 
while. Maybe the prostitutes are getting dumber - walking right up to the 
unmarked car? What could be easier? If they walked into the station? As I said 
the 
other night, let's get the johns arrested or at least plastered on a billboard. 
Do we have any women decoys? Boy, that'd get the message out there that 
Asbury isn't the place to do your hooker shopping.
Then they should do the same with drug buyers.
Then I'll believe that Asbury and this county and state are serious about 
cleaning up Asbury.

future, to ensure they're kept aware of how the project is being built and 
maintained. I'm sure those current and future retirees care how their dollars

could be why he took so long to commit and why he finally decided to takeover 
the rehab piece himself.

Thanks for posting the Faiella articles from the Ledger.
I put something up on AsburyRadio.com this morning, but I'm still learning how 
to manage that website.
Not to blow my horn or anything, but I tried to read the council information 
about Faiella before they ever voted the redevelopment agreement into law, 
which, thanks to Shangazi, I still have on tape. James Aaron, our attorney for 
redevelopment, was quick to respond to me that my comments about Faiella were 
irrelevant to the item under discussion - The Waterfront Redevelopment 
Agreement with Faiella's clients, Asbury Partners.
So the council did have a chance to put the breaks on, between Weldon's 
admission (he was gone before that night) and the Star-Ledger stories I held in 
my hand, referring to his being let go by Sharpe James from his job as deputy 
mayor, and thrown off his Newark Economic Development Corp by his own board of 
directors. I believe I summarized it all as not passing the smell test in 
Newark, or words to that effect.
Maybe I should've been more forceful, dug my heels in and read the whole thing. 
There's something about that gavel pounding that can be very intimidating.

I remember going on the track boats, and once on the paddle boat. My sister 
told me if we stopped pedaling the boat would sink. Scared me to death!!
The track boats were really neat, since the boat was actually under your 
control - steering and speed. I loved that! If you got wedged in there, the 
operator pushed you back in line with a long pole.
I got on the Swan boat - ONCE. I felt very sophisticated and really believe 
that the little girl in Milton's famous photo (with her arm resting on the 
side) is me!!!

On the 110th...
Well, I guess you could say the city had a birthday and shared its cake with 
everyone!! That's nice. 
And the Historical Society's remaining members dressed up really cute. I 
noticed Ruthanne, Doug, Johna, and Robert T.'s costumes - all very nice and 
festive. Trouble was that there wasn't anything else dressed up. Of course the 
rag time band was in their red suspenders and made a really nice addition to 
the affair. Maybe they should've had dancing. Maybe they did after the cake was 
handed out.  We left after our cake. (A few people saw an unavoidable parallel 
to Marie Antoinette's fateful remark. Would that Imus would lose his, oh well, 
we're much too civilized now I guess.)
 
On the other hand, the tables lining the entrance to CH were staffed by sales 
people for Metro Homes. You fill out the contact info and get a nice black bag 
that says 110th and Esperanza on it. So you have a momento and they have a 
potential buyer for the Esperanza. After all, we're told Esperanza underwrote 
the anniversary - right? Although, the UEZ gave money toward it as well, didn't 
it?
Does anyone see the entire 4th ave pavilion as a giant ad? Granted it's more 
attractive than the decrepit, neglected pavilion beneath.
The carousel cake was a bit of a misnomer, since the carousel itself - the roof 
of which was a dead ringer for Asbury's own remaining... - sat on a box, not a 
cake. The cake was actually a whole bunch of sheet cakes on long tables, which 
in total held the 110 candles that were lit by dignitaries, each to his/her own 
candle. I didn't see the man from the Food Network. Were we supposed to meet 
him in person? The chocolate was delicious!
 
After the cake everyone was to move on into the Paramount for the movie about 
the history of Asbury Park, which was produced by a woman from Conn. for NJN 
and neglected to include the only official historian of Asbury Park. That 
historian loomed ghostlike on the perimeter above the bleachers, video cam in 
hand, recording even this manufactured event. 
I'm glad that NJN's "Greetings..." included many interviews with figures from 
the West Side. That was a good thing. But hasn't everyone already seen this 30 
min. film?
Several people - Madonna Carter Jackson, author of Asbury Park: A West Side 
Story - asked about my radio show getting back on the air. That was awfully 
nice, too.

Whatever happened to Asbury Radio?
Well I thought you'd never ask, Allen.
The weekly show was like doing a feature article a week and so took 
considerable time from my revenue producing work. For most of the past 6.5 
years my freelance work suffered and so did my bank account. Just prior to the 
first FCC visit to WYGG, I took an office job. My boss allows me to work four 
weekdays and Saturday, affording me one weekday to do my freelancing. It's 
working out quite well. The same cannot be said for the show, which hasn't 
aired since Nov. 16th.
This letter, below, that I sent to Sen. Menendez on March 20th, will explain 
the current status. I recently got a response from Cong. Frank Pallone to a 
similar fax I sent him, on Feb. 12th.  He said his office had asked the FCC's 
enforcement bureau to look into it. If I don't hear anything by April 8th, I 
should give him another call. This isn't satisfactory since the station's 
temporary permit expires April 7th. Pallone had no response to that information.
I know you've been critical of my show in the past, Allen, but I would hope 
that you and other critics could still appreciate the importance of this threat 
to free speech - and no, I still don't know who is behind this.

Re. FCC Intervention in WYGG 88.1FM
 
Dear Senator Menendez:
 
I have had a radio show, Asbury Radio (previously Restore by the Shore and 
Restore Radio), on WYGG 88.1 FM, which would've been on the air 7 years this 
June. The station is a low-band, minority owned arrangement that broadcasts 
largely in Haitian Creole. (Abner Luima bought and held the license until 
recently.) 
 
In mid-November Steven Desena, a field engineer with the FCC based on Varick 
St., in NY, claimed to be driving by our studios at 601 Bangs Ave., in Asbury 
Park. Mr. Desena gained entrance to the building and examined the antenna 
without WYGG present. DeSena phoned the station manager, Jean Guy Henry, and 
pretended to be a cable installer who needed the transmitter turned down to 
work on the roof. He then summoned Henry  to the roof and brow beat Henry to 
try to get him to turn off the transmitter. Eventually, according to Henry, 
Desena turned off the transmission himself, which I’m told is a violation of 
FCC rules. The station remained off the air from just before Thanksgiving until 
February of 2007.
 
Desena told Henry he’d have to move the station, which he did during January.  
The station was relocated to a house owned by and adjacent to the French 
Haitian church at 414 Asbury Ave. The FCC granted a temporary permit to allow 
the station back up on the air, but that permission expires in early April. The 
management gradually reintroduced programming to the station, with the 
exception of my show. Henry told me in March that he’s afraid that my show is 
the real target of the FCC’s attentions. (Desena visited again at the new 
location on Jan. 28th.) This makes three or four visits to a 100-watt station 
in roughly two months. Despite this, there is no record on the FCC's web pages 
for listing Notices of Apparent Violation.
On a recent visit, Desena reportedly asked specifically about my talk show and, 
granted this is second hand, told Henry that it may be the public’s right to 
talk about this stuff but they (?) don’t like it. 
 
Desena told Henry that all guests have to sign in, have to be listed prior to 
show time as well, with their topics and how long they intend to be on. Is this 
really Federal FCC Regulation? I can clearly see where such rules would have a 
possibly chilling effect on free speech.  
 
My second question is: Can you find out who or what formed the initial catalyst 
for Desena’s visit in November?
 
By the way, it may mean nothing, but my last show to air over WYGG was about 
the awakening potential of voters from Asbury Park’s West Side. Naturally, this 
protracted situation has only given fuel to speculation. Other subjects covered 
on my show have been random violence against Latino workers, Eminent Domain, 
Abolition of the Death Penalty, environmental and tenants' rights, etc.
Again, if you could confirm these FCC requirements; and if you could find out 
the reason for the FCC’s spontaneous visit and termination of the signal, I 
would be most grateful.

I tried to make the same point this morning and got screamed at about how 
this town has stood still for 20 years and at least it's better than nothing, 
and 
yada yada. Doesn't anyone understand that we're saying if the BC could get 
fair value, why shouldn't everyone else? The difference? The BC was free to 
sell 
on the open market. Everyone else has to sell to Asbury Partners. The sellers 
are a captive market. Message to others who don't get it: See  Principles of 
Free Market 101 
I'm glad Ahn got a good price - it's good for Asbury, too. Likewise, when 
sellers get shafted it's not good for Asbury Park.

So the story of the day is restaurant plans for HoJo moving ahead.
After I got through fuming at the fact that most of the maneuvers of late, 
before the council as well, have been to force down the throats of the planning 
board a plan to rehab the lower level of the 5th Ave pavilion in slap-dab 
scenario, I realized the bigger issue. 
At the last planning board meeting I said that I thought the push for the 
quick and dirty rehab was an effort on Asbury Partners to woo MM into signing 
their contract. But it seems now that MM, having given up on the Partners 
fullfilling their contractual obligations to the City, has joined their chorus 
in 
asking the planning board for the same makeshift-style rehab. 
Once again, time is of the essence. Hurry, hurry, no time to deliberate or 
get us to go with what we've agreed to do in the past  - what we're contracted, 
o
bligated to do. Just give us this break now and we'll love you for it later. 
We'll make you happy wait and see. Where have I heard that one?
Back to the article. The Big Issue is that there isn't any restaurant deal 
sealed yet. Thank you Nancy for making that clear. 
It's March in two days. Not only is it impossible to do any decent rehab by 
Memorial Day - well if you were really committed and didn't mind double 
spending to make it happen... Sure, Fishman has spared no expense so far...
But what legitimate restauranteur is going to commit now to breaking their 
necks to install and have staffed and operational a new restaurant, built to 
someone else's directions and specifications, by Memorial Day? How can they 
commit to open in a space they haven't even seen? I'm not talking about a shell 
- a 
workable environment that they don't have to adapt at all! Would anyone on 
this board take such a chance?
So I can only assume that this is not about opening a restaurant. It's about 
letting Asbury Partners do that slipshod job they've always intended to do. 
This is about keeping Asbury Partners from missing their deadline and being 
held 
to their obligation to open a restaurant there by Memorial Day or be in 
default. It's always a big hurry - the budget won't balance unless we sell them 
this now... Remember that one? How about, "Hurry, no you can't ask any more 
questions the planner has to fly back to Florida now."
Well, you know what? We can take our time and find our own restauranteur and 
designer/builder and produce a very nice restaurant ourselves with the space 
we take back from the Partners for default and the fine they have to pay us. 
Planning Board - stick to your guns. Matt Berman - you were so right, don't 
buckle now. Terry Reidy, you said it like it is. The plan didn't make sense. 
Don't rush folks, cause it won't be done to satisfaction anyway. We've waited 
this long for results. We'll wait to get it done right.

HOWEVER, it seems my site's on the blink now, too. If you've noticed, there 
hasn't been any new info up there in all of February. 
I'm trying to reach Pete Walton to see if it's on his end, but I can't get 
ahold of him. Anybody know if he's on vacation? I also thought it might be 
because I have someone working on a reorganization of the site, but she, the 
web 
designer, says the problem with posting isn't related to her work on it.
So it's a little frustrating not having my outlets. But I'm working on it.

Paramount Homes announced the MM deal? And MM didn't? Hmmm. But MM is known 
for its marketing prowess, too. What's their strategy there? 
North Beach is light years away from the area MM is talking about rehabbing. 
I haven't seen any plans for the boardwalk from Deal Lake Dr to Convention 
Hall - a wasteland. Doesn't that stretch have a negative effect - or downward 
pressure - on condo sales at North Beach?
Anyhow, I was encouraged to see Nancy Shields actually report the story the 
following day. Woowah, filing the story the same night you cover it. What a 
concept!
Now on the content, I wasn't all that satisfied. When is the APP going to 
cover the Waterfront like a business story - numbers, forecasts, projected cash 
flows, cost of funds, funding sources, you know business...like the 
multi-billion dollar undertaking we've been told that it amounts to?

So the city has been sending two members of the council to all these 
meetings, after which the subcommittee reports to the council what it has 
observed -- 
and yet the city still doesn't know the terms of the deal...  And neither does 
the public.
Guess we'll just have to wait to see how much information Asbury Partners and 
Madison Marquette decide to give Nancy Shields. I just can't wait for my 
first installment.
Can anyone read the Sunshine Law? And, in response to city attorney Fred 
Raffetto, this would not be the first time a panel of judges has found the city 
guilty of violating the spirit of the Sunshine Law. As far as the use of a 
subcommittee, the State Public Advocate is looking into the legality of those.

documents - we'll probably be amazed at the findings. And, those responsible 
for the 
shredding should be prosecuted for that alone.

I'm not sure what I'd need to do the show over the net with call-ins, 
multiple mics for guests, etc. If you could give me some guideance, I'd 
appreciate 
it. 
Certainly for shows like the ones I did with authors calling in from various 
parts of the country to discuss their books, it would work just fine. But on 
most of those I had a studio full of people to ask questions of the authors, 
which made it more interesting. Still I can see where I could make one on one 
interviews work for now.
But, Mike has said the net really isn't as popular for listening to talk 
radio yet. So I guess I'll have to weigh the set up costs against the rest - 
when 
I get them nailed down.

Thanks for asking about Asbury Radio.
Rather than repeat the whole litany, suffice to say an FCC rep claimed to be 
"just driving by" 601 Bangs and noticed the antenna on the roof - how many 
feet up is that anyway? (we were on the 7th floor) didn't look right. So he 
went 
up there. He returned to the building, under the guise of being a cable guy 
(more strangeness) and pulled the plug on WYGG. It's important to note that 
WYGG 
had been situated at 601 Bangs for more than 6 yrs.
So the FCC guy tells WYGG it has to move, because the building is too high 
for the antenna height afforded by its license as a 100 watt station. The 
station had been operating powered down to 50 watts, to compensate for the 
extra 
height, which I understood to be a compliance measure by the station.
Now in it new location on Asbury Ave, the station's antenna is said to be too 
low. (There's probably a fairy tale or fable to fit this scenario, but none 
comes to mind at the moment.) So they issue the temporary permit to WYGG to 
allow it to resume. BUT the station must now obtain approvals from the city to 
raise the antenna, which Andre Willis says requires zoning board approval. For 
those who don't know or don't remember, Mr. Willis is the same city official 
who swore out a warrant for my arrest for photographing - instead of purchasing 
photocopies - of the blue prints for the Paramount Homes' development, North 
Beach.
Mr. Willis later withdrew his objections and wrote an apology, which I hope 
means that WYGG will be treated without prejudice in this matter.
There is a deadline of April - I believe 7 - by which the antenna must be at 
the height req'd by the FCC. Will the petition to be heard by the board be 
delayed? Remains to be seen. Will the board allow the antenna? Don't know.
As for whether the council played a part in our being thrown off the air for 
two months, I don't believe they'd have had to pull to do so - even if they 
were so inclined, which I really doubt. Mike Hemeon tells me such a request 
would have to be made through someone with pull on a federal level. 
This isn't impossible either. Since Asbury Radio examined numerous issues - 
local, national and international in scope - it's hard to say which of our 
critics could've 'dropped the dime', as they say. Maybe it was a proponent of 
the 
death penalty who didn't like our having a convicted killer talk about what it 
was like to spend 18 years on death row for a murder he didn't commit. Maybe 
it was a local, county or state official who has influence at those levels, 
who didn't like our asking direct questions about how they do or don't do their 
job.
These days when you're examining issues with no restrictions or monetary 
considerations, you invite the devil.
Then again, maybe it was all just a big coincidence.
Meanwhile, we're evaluating restarting Asbury Radio if it will only be for a 
few more weeks.

Why are they using the term "sold" anyway?
With all the real estate people in this town and on this board, I'm amazed no 
one has objected to the misuse of this word. And what about you buyers? 
Haven't you experienced, or know someone who has, losing out on a house deal 
right 
up to the closing. It ain't over til the closing, folks. Wouldn't it be more 
accurate to say there are deposits on ...x # of units? I ask the sage realtors 
and real estate attorneys on this site.

Perhaps if the council wasn't handling these 'contract negotiations' between 
Marquette and the Partners in private sessions through its 'subcommittee' - 
supposedly to avoid violating the Sunshine Law - we wouldn't have to speculate 
about the status of the Partners' negotiations with Marquette.
Why isn't anyone else asking why the secrecy?
The reason our lawmakers made contract negotiations an exemption from the 
open meetings law was so that the governing body could deliberate its strategy 
in 
private - so that the other party to the deal wouldn't know the strategy. Can 
someone apply that reason to this situation, because it evades me. How does 
the city benefit by meeting with the very parties involved in the contract and 
leaving ONLY the public out?
Then, of course, the subcommittee reports back to the full governing council 
- again in executive or private session. It's another clear violation of the 
act.
Nancy, having covered nowhere else but Asbury Park, is apparently at a loss 
for a reference point. She must think this is how legitimate government is 
conducted.  Not. It's time Nancy and the APP filed their own Sunshine complaint.

Tonight at the Council Meeting, I asked for an update on the status of the 
Madison Marquette participation and finally got confirmation that there is no 
contract between Marquette and the Partners.
It can really hurt a town's credibility when the news media takes on a 
booster role.

Where is the seed money for the commercial businesses to succeed on the West 
Side?

 There needs to be a Marshall Plan for the West Side. We didn't build a bunch 
of condos in Germany -- or in Japan for that matter - and just fly home to 
the States. We helped them build companies, showed them winning business 
strategies -- Yankee Ingenuity - and probably made individual business loans, 
too.
Housing is fine. But where do you work? These residents have shown they want 
to own businesses again. It's cruel to just say fine, here's your storefront, 
have a ball.

I asked this question several weeks ago of Asbury Partners and was referred 
to their PR agency, Caryl Communications, who told me they're not representing 
them on this area. Caryl referred me to Winning Strategies, the Partners' new 
PR firm, which also represents Cherokee, now a major player in Asbury Partners.
However, the rep at Winning said there wasn't a contract between Madison and 
the Partners at that time.

Think you're mixing apples and oranges.
Oral histories - which  I guess would be called blogs? - are quaint and can contain reliable information. Historians though, while certainly not infallible, are expected to follow professional guidelines. I don't think we want to make the mistake of not drawing a distinction between the two. Otherwise we'll just have the ministry of disinformation.
As for Fred, why aren't you grateful that someone cares enough to try to maintain a consistent record of this city's proceedings? Is it the - don't confuse me with the facts - syndrome?

A little more on The Partners' new PR firm, which also represents Cherokee Investment Partners and K. Hovnanian. 
From the web site - www.winningstrat.net, which is headed by Jim McQueeny, a veteran on-camera and print journalist. The firm obviously has influence on Capitol Hill.

Speaking of binding contracts;
I was feeling pretty good about those 106 units at North Beach having been through attorney review until I remembered that attorney review just means lawyers have approved the contracts -- it doesn't mean the deals have closed. And until they've closed, it's like the fat lady hasn't sung yet, you know.
I would like to see the construction moving a little faster and hear that the master deed, which will allow the condos to start closing, has been filed.

Actually, I don't think it was BS. There seems to be something going on. It's obvious the council wants to stall on it. Think we need to praise the council when they do something we like. If there are motives we don't know about, should we let that hold us back. Sometimes positive reinforcement is the only tool we have.
Big question now though is who bought the Berkeley Carteret??? I hear that everyone has to be out by Nov. 1.

Allen -
The Black Box gave my script to Ari and Larry to assure them they had nothing to worry about in allowing the group to produce my reading in Asbury Partners' Paramount Theater. It apparently worked, since the Partners pulled in their claws and let the show go on. (In fact, the theater's staff couldn't have been nicer or more accommodating.)
 
However, the Friday before the reading Deputy Mayor Jimmy Bruno and City Manager Terry Reidy told me they'd also obtained copies of the script and read it. Jimmy said he told Larry he shouldn't let me perform the reading in his building. Jimmy said Larry explained his views that it was a matter of artistic freedom and free speech. Jimmy didn't agree.
Would we have had more people at the event?
If Jimmy and Terry were curious enough about the screenplay to obtain their own copies, had they not obtained them they would've had to attend the reading to find out its contents. By their absence from the event and Jimmy's vehement disapproval I believe it's not a stretch that those who court the favor of city hall, employees included, would also want to avoid the event.  
That's my rationale. However, I was very pleased with the remarkably large turnout of people, including those from surrounding communities.

Lynch -
25 years gone by. 
25 years ago, I had sources telling me how Lynch and his cohorts were operating the redevelopment of New Brunswick. One was a N.B. cop. One was an accused arsonist with 30 arrests on his record. I interviewed him in jail.
One more reference to the wonderful job Lynch did in New Brunswick and I'll be ill. Any politico who comments about his successes and how these "proceedings" have marred an otherwise brilliant career should be investigated themselves.
Back then, I wrote a story about the working poor in New Brunswick who were frozen out of their apartments, so that the code official - a political hack - could post the condemned sign on the door. Can't occupy a building with no heat or hot water.
    Tenants would pay their rents only to have the collector take off with the money. Then they'd be evicted for nonpayment.One family was burned out of the apartment they rented in a building owned by the police director's cousin. The magazine article was called "The Other 30-percent", after the quicky poll the city hired Eagleton Institute to do in reaction to my NYT's piece. The NYT's piece is up on the web under, 'Who is Asbury Radio?'. The magazine piece won a journalism award. (The Eagleton poll had showed that 70% thought redevelopment was good for New Brunswick.)
A lot more needed to be written, but my jailhouse source clammed up after a contract was put out on him. I wasn't alone though, he also refused to testify in court, which earned him an extra 6 mos. on his sentence, which he served in Trenton. 
The Hungarian community that gave New Brunswick some of its rich history was largely forced out by the tax concessions Lynch made to his cronies. 
The minorities and low income people were forced out to Franklin. Urban Removal. 
25 years later,  Lynch finally tripped up a la Al Capone. He didn't pay his taxes. That allowed Christie's office to come in and do the job the state and local authorities wouldn't touch and tell the story the press for decades wouldn't report. Does that make anyone in New Jersey feel warm and fuzzy?

DePetro has brought large developers in to meet with the Partners. They offer such one-sided deals that the big players also walk from the table. Maybe more people would voice their opinions on saving the Baronet if they actually saw the theater. A lot of people who never stepped inside have voiced their opinions. 
Here's your chance. It's open all day and late tonight - Saturday 7/15 - and they'll be live music after 8 PM. 
Please pass the word: The Asbury Park City Council votes next Wednesday, July 19, on whether to save or demolish the Baronet, literally the last picture show in Asbury Park, which was once home to 6 theaters. From 1953, the Baronet was owned by Walter Reade, who also had a home in Asbury Park. PLEASE COME OUT TO CITY HALL, MAIN ST AND BANGS, WED. We have a last minute cancellation. The moviemakers for Dykeotomies won't be able to make it.
In their place I'd like to have a discussion on the recent Star-Ledger article about Alfred Faiella, who Newark locals referred to as "The Shadow Mayor", which is available online. I have a link on AsburyRadio's home page. As attorney for Asbury Partners, Faiella has actually composed our ordinances and other official documents. His fax identifier has appeared on many of them - NEDC. Please call in -- 732-775-0821 or 775-6203 and voice your opinions.
Then Maire Martello leads an important discussion on redevelopment on Lawrence Avenue in Ocean Grove. Her guests include Herb Herbst is the president and ceo of the Jersey Shore Arts Center on Main Avenue in Ocean Grove, 
Jamie Nieradka, who with his wife Ann bought their home in OG in 2004 after falling in love with it while visiting there during summer vacation.  They are expecting their first child in June.  He’s a vice president of electronic marketing at Alliance Bernstein in NYC.
 
Dawn Popoff is a ten year resident of Ocean Grove and the wife of Coldwell Banker Real Estate Agent, Michael Popoff.  Her family has been coming to Ocean Grove for five generations.  She is currently a reference librarian at Monmouth U.
 
Kevin Chambers is Maire's former neighbor when she lived on Atlantic Avenue in Ocean Grove and is a historian and former president of the Historical Society of Ocean Grove.  
 

And, Steve Palmer who lives on Webb Avenue in Ocean Grove and was one of the first people notified of the proposed condo project.
Also invited were Neptune Mayor Tom Catley, who did not return the phone call, and Sean Braitling, the land acquisitions rep with Regal Homes, told Maire he was going to be out of town  and didn’t think anyone else at Regal Homes would be available.

You say the master plan is misrepresented. What law covers this? Is there any recourse?

He was one tough editor, but Joe D'Andrea was almost always right.
We'll miss him lots, despite the sharp rebukes.
We're trying to get together a spot on the show this week to allow people to call in and come into the studio to talk about Joe and give tribute to him. Tentative schedule is 8:30 to 9.

This story cried out for a letter to the editor. People are calling up this story all over the world and not getting all the relevant facts. Ex: By saying the property owners interested in preservation want to save a deli, the story is not only inaccurate, it erodes the credibility of the preservationists. BTW, Laura Jewel's husband, Ken, whose "Blue Grass Jam" on 90.5 rocks, fell in love with The Baronet during an impromptu tour on Saturday.
So Asbury Radio wrote the following:

Dear Ms. Edgerley - (NYT Metro Editor)
Reporting on Asbury Park is a nightmare on the best day, so your John Miller did a fine job. But I must point out three things in an otherwise excellent piece:
1 - John's reference to the elements that stopped construction on the Carabetta building, which we call C-8, failed to include the colossal bank failures of the period - the late 1980s. 
2 - In his interview with Council member John Loffredo, who favors condos over preservation of the entertainment facilities here, John did not include the fact that Loffredo is a real estate agent, who represents properties in Asbury Park. 
3 - John grouped the deli with the 1913 Baronet Theater that locals are trying to preserve. The owner of the deli property is not fighting condemnation. In fact, she's trying to sell her property to Metro Homes, developers of the hi rise that will replace C-8. (Whether she gets to sell her property in the open market, or has to surrender it to the redevelopment rights holder, Asbury Partners, who will in turn sell it to a "sub-developer" such as Metro, will reveal much about whether this city is trying to get the best for its citizens, or simply placating the Partners.

I wasn't questioning Lehrer, so maybe your reply wasn't meant for me.
But, I was asking about conflicts with having the same firm handle the distribution of properties in the city (and redevelopment zone) in which it is contracted to supply legal advice. You didn't tell me your opinion on that, did you?
As for the order, the spokesman at the attorney general's office was going to fax or email that to me, prior to his hanging up on me for asking him to explain why it is or isn't a conflict. He made a veiled threat that he could be cooperative or not, depending on whether I pressed my question. Since I've yet to receive the order, I have to assume he made good on the threat. And these are the people charged with upholding the public's rights
As for posing the question to the judge himself, it's fairly accepted practice that reporters don't call judges, and certainly not to question their decisions. Looks like we're going to be spreading this courtesy to all levels of government pretty soon.

That wasn't the solution offered when I was on the board with Stu. We wanted a discount membership that would include Chamber and Merchants Guild membership and for the Chamber to act as an umbrella organization. The merchants need the chamber, because the name and institution have national and even international presence. Gilmour put Stu down for the suggestion, then proposed it himself after Stu was gone. Maybe you were thinking of Gilmour's flavor? I don't know whether he had some different wrinkles.

Those two could start working on joint projects.  That wasn't good enough for the Chamber.  They were insistent that the Guild simply fold up shop and everyone join the Chamber (some merger).

And you Tom? What about your criticism of the agreement? Whatever happened to that?
 
And I wouldn't jump to conclusions about Keady. When he left for Calif. he thought the agreement would be in the form of an amendment - an ordinance.
Didn't you have an opinion about that, too?
