Banks are still making mortgage loans, but lending criteria has 
become more rigid, and appraised values are in decline. Since so many 
properties under contract are problematic and time consuming "short 
sale" transactions... often times the contract sale price is 
determined to be MORE than the subject property's fair market 
value ... and as such, the Purchaser's mortgage lender rescinds 
approval which requires the parties to go back to the negotiating 
table taking more time as the values continue to drop. Its a 
bureaucratic red tape boondoggle.

BPOs are also used by mortgage pool investors performing due 
diligence. They'll use a local broker to perform BPOs on property 
secured by mortgages to help form an opinion on the portfolio's 
underlying Loan to Value.

Although loan servicers (entity who collects month payments), on 
ocassion, may order BPOs on performing loans... in my opinion, it 
doesn't happen very often.

Twenty-five years ago I received my appraisal training from John D.
Lazurus. That name won't mean too much to the younger folks...

He spoke about waterfront properties, suitcases filled with cash...tax
stamps and recording fees.

market analysis) would be provided, free of charge, to a potential

A BPO, or Brokers Price Opinion, doesn't carry the weight of a 
certified appraisal, or the price tag... A BPO can be just as accurate 
as a full appraisal, or, riddled with inaccuracies intentional or 
otherwise.


There are cursory drive-by BPOs, or more involved, interior BPOs.

Typically, when a mortgage loan is delinquent, in deefault, or at risk 
of foreclosure, a BPO performed by a local real estate broker, or 
broker's agent, is used by a mortgage loan servicer who needs to 
confirm a property's occupancy status, and general market value.

During the course of a mortgage loan's delinquency and foreclosure, 
drive-by BPOs with photo snap might be conducted monthly...

I dropped $250 at Old Man Raffertys and each time I eat there I vow not 
to eat there again.  Everyone else enjoyed their meal, though.

After dinner, our friends were ready to leave, so we escorted them to 
their car... and went back to Cookman. We so enjoy it... its a shame 
more people don't come out.

Millville, NJ has "Third Friday" and it, too, is terrific, just a 
longer ride. It is more artsy oriented, more working studios, and
more storefronts... with huge loft areas.  There must have been 20 
different musical acts... all styles.  Awhile back, I was invited by a 
bookstore/cafe for a book signing event (Fight Foreclosure!) and have 
been asked back this month. 

If I drive all the way down there for 3rd Friday, I certainly don't 
want to be stuck signing books...

[AsburyPark] A black eye

I've been encouraging my friends to set aside their preconceptions 
about Asbury Park, and experience First Saturday with limited 
success.  To force participation, I offered to treat my friends to 
dinner this past Saturday.  "You'll love it!  The merchants are all 
open late, the sidewalks are alive, we'll usually spot Kevin Quinn 
playing music, and there is a police presence..."

Well, we met in The Arcade on Cookman at about 6PM. We would stroll 
around and then dine at Raffertys. I lead the way.  No sooner had we 
taken 20 steps out of The Arcade, I glanced back to see my "party" had 
been approached and then detained by two women (late teens early 
twenties) who were adamant about their wanting 50 cent from each of us.
 

Unfortunately, THAT will be the experience repeated to our friends' 
friends.

When I was on FOX Business TV they sent a limo for me. The limo driver 
eyed the various Peace symbols adorning my home and garden... and 
casually mentioned I was not the typical FOX guest. I explained I was 
invited to discuss the nation's foreclosure problem and showed him a 
copy of my book, Fight Foreclosure! How to cope with a mortgage you 
can't pay, Negotiate with your bank, and Save your home!

We talked a bit, and as soon as we got onto the turnpike, he reached
into his glove box and pulled out an envelope, and then handed it to
me. Inside was a foreclosure summons. I gave him the copy my book.

I had a three minute segment which seemed like 30 seconds.

Raffertys, and dinner at Brick Wall. Brought coffee to the Kevin Quinn
Trio who braved the cold to play some original music, and some covers.

Visited with Tony and Michelle of the Arcade's Under The Sun.

We left as it began to snow. Anybody known how long Quinn played on
after that?  Talk about the hardest working musician on the Jersey 
Shore!

[AsburyPark] I deserve to lose my home!

Perhaps one third of the people I counsel who want to save their home 
from foreclosure are fighting an uphill, and oftentimes losing 
battle.  When they want to fight. I help, but try to temper their 
expectations, and have them prepare for and accept the eventuality of 
relocation.

Then, there are situations in which I have a reasonable expectation 
the homeowner can Fight Foreclosure! and keep the home.

Recently, I spoke with a woman, a casual acquaintance whose home is 
in the early stages of foreclosure. I asked her to bring whatever 
documents she had pertaining to the loan's origination and mortgage 
foreclosure.

Tearfully claiming she doesn't want to lose her home, she confessed 
a "friend/confidant" has convinced her saving the home is impossible 
and her friend (who happens to own a short sale company) is very 
close to negotiating a preforeclosure short sale

"What choice do I have?" she asked, visibly upset and choking back 
tears..

If the deal is approved, this woman will have to vacate the property 
and find alternative/affordable housing.  In my state, the 
foreclosure process can take about a year or more.  If she did 
nothing, she would still have 8 or 9 months in the house before 
having to leave.  

For all I know, there will soon be a national or state moratorium on 
residential foreclosure adding months to the process. 

"Where will you go?" I asked her.

"I don't know."

"Doesn't it make sense to try to Fight Foreclosure! and try to keep 
the house?"  (I run a non profit housing preservation advocacy, and 
in 2008 authored Fight Foreclosure! How to Cope with a mortgage you 
can't pay, Negotiate with your bank, and Save your home)

"He said he tried but the lender refuses to modify my loan... I don't 
have the money to bring the loan current.   The house isn't worth 
what I owe.  I screwed up." she stated.

"Have you talked to an attorney?" 

"No." 

"What have you done?"

"I gave the papers to my friend (who happens to own a short sale 
company and deals with people in foreclosure for a living) who is 
helping me." 

MY 20+ YEAR ADVOCACY INCLUDED INVESTIGATING ALLEGATIONS OF PREDATORY 
LENDING PRACTICES, UNTOWARD REALTY TRANSACTIONS, AND MORTGAGE LOAN 
SERVICING ABUSE FOR THE MORTGAGE BANKERS ASSOCIATION OF AMERICA'S 
CUSTOMER SERVICE DEPARTMENT. 

 A cursory review of her loan documents indicated predatory 
characteristics, and I suggested we investigate the loan for 
compliance to Truth in Lending (TILA), RESPA, HOEPA, etc.   If the 
loan were determined to be predatory, or made in violation to 
applicable state or federal lending law it would give her some 
leverage in seeking a loan modification...  She agreed to ask her 
lender to provide her loan origination file to me.

Based upon my experience, I concluded she had a chance at keeping her 
home via a cramdown loan modification.  A chance. 

Missing from the folder she brought were the basic transaction 
documents needed for the "short sale" of her home:  a listing 
agreement, contract of sale, buyer's prequalification, and the 
preliminary HUD1. 

"I don't recall signing a contract of sale..." she said, "But "he" 
has all the paperwork."  I'll have him FAX the paperwork to you.

Instead, I got a call from her "friend and confidant" who told me her 
situation was hopeless, and he was very close to getting a short sale 
approval and didn't want me to screw things up

"What's the rush?" I asked him.

"She is in foreclosure.  The lender has refused a loan mod.  This is 
her only option."

"Well, I think the loan may be predatory, and as such, she has a 
chance to keep her home."

"Nonsense.  Her loan is from an excellent mortgage company!"

"Well, I looked at the settlement statement, and I disagree. The 
loan, in my opinion, was unconscionable.   Furthermore, as you must 
know, a loan in the early stages of foreclosure won't get the same 
attention and workout consideration from the lender as will a loan 
closer to Sheriffs' Sale which in this case is at least 8 or 9 months 
away... maybe more." 

"I think you screwed things up.  I hope you didn't screw things up."  
he told me.

---  (OH, BY THE WAY.  I ALSO WROTE, AN ETHICAL APPROACH TO SHORT 
SALES IN 2006). 

 I ask for, and he promised to FAX to me  the listing agreement, 
contract of sale, PHUD1, etc. He didn't.

 Instead, I got a polite email from the woman who asked me to "back-
off" because her friend would "ask again" for the lender to modify 
the loan.

I wasn't afforded the opportunity to review the nuts and bolts of 
this transaction, in fact, I was denied the opportunity which raised 
suspicions.   I have nothing invested except a little bit of time, 
and my compassion for anyone who is at risk of losing their home to 
foreclosure...

But I do have some unanswered questions.  Primarily, Why the rush?  I 
also question the likely predatory nature of the mortgage in 
foreclosure, and who originated the questionable mortgage loan.

may be made from recycled stuff and can always be recycled again."

My neighbor bought metal trash cans thinking they would last forever.

They lasted three weeks.

The trash collectors have a habit of banging the cans against the truck 
in an effort to 'unpack' the contents. Plastic cans retain their shapre 
while the metal cans do not.  These failed along the seams.

I've got two plastic sears trash cans from 1963.

There is a difference between an economic system, and a polictal 
ideal.
Our corporate controlled regime is in a global competition for 
markets. Democracy has nothing to do with it.

labeled "Communism or Socialism" but truth be told, neither has 
existed, anywhere.  The failed systems labeled as S or C more closely 
resembled capitalism than any theoretical utopian society.

Lay bare the facts, ignore labels, compare, and see for yourself.  If 
you are intellectually honest, you'll deduce we are heading further 
and further away from the ideals of socialism... and closer and 
closer to fascism.

You can validate this yourself.  Check your title report from when you 
purchased the premises. It's possible that foreclosure action pre-dated 
your experience with the premises.  You'll see the property was subject 
to foreclosure, Sheriff's Sale, and owned by a small corporation.

Did you purchase the property at Sheriff's Sale, from the lender as an 
REO, from an investor who had just purchased the property, or from the 
foreclosed owner whose last name began with "L" and had several 
syllables. 

Whether or not the owner of the building physically stood behind the 
counter or leased the building to a shopkeeper is immaterial.

Years ago, before Kevin Brown purchased the building from which he was 
asked to vacate, a previous owner faced with foreclosure on that 
building contacted me for assistance.  I seem to recall he operated a 
retail auto parts business. To guestimate the building's value, I was 
afforded a glimpse into the building's past  positioned on the 
second floor was a prizefighters' boxing ring complete with ringside 
seating.

That owner lost the property directly or indirectly to foreclosure.

Perhaps the new owners should burn the structure... then burn the ashes 
twice.

Though the duopoly and its media would like us to think there are
major differences between the candidates, and the importance of
our "selection" is a matter of life or death, a black or white

be "elected" if their allegiances to our corporate masters and their

Obama and McCain have been presented to us as worthy candidates by
the competing capitalist owners of industry who have spent millions
upon millions of dollars on their horse... but will still win 
irrespective of which candidate may sit in the White House.

If they always win, who loses?

We, The People will always lose to the corporate class no matter which
candidate wins.  The "game" is rigged. 

Only when We The People look behind the smoke screen and mirrors will
we realize we CAN use our democratic system to entrust and elect 
candidates who will represent our collective interests...

A good beginning would be to have a major third party in the mix.  In 
that way, real issues would be exposed and discussed instead of 
denounced as irrelevant.   For true democracy... we need to end the 
duopoly.  Otherwise, we keep electing tweddle dumb or tweedle dee.

Another issue I have is with some transaction closing attorneys who 
robotically close loans which may have predatory characteristics, or 
sign HUD1 settlement statements in violation to TILA Reg Z.  

I wonder how many lawyers have signed waivers from their clients such 
that the true nature of the loan was discussed, but the clients 
proceeded to borrow the money anyway despite disclosures.  Not too 
many, I'll bet.

[AsburyPark] event planning

Millville, NJ has a business and arts district which remains open late 
every third Friday of the month...  The event is heavily publicized by 
local papers, and in every shoppe and gallery's window.

The event draws what have been described as huge crowds including 
locals, visitors, and college kids from Glassboro (now Rowan) and 
Stockton.  A concerted effort to revitalize the town's business and 
arts district.

I went to the Shoppes in the Arcade's 1 year celebration two weeks ago.

Does AP have any regularly scheduled events like that?

The long serving, and well intending workers face the physical
challenge of getting up at 4AM, and not returning home until 8:30 PM
with only an hour long break. They have to deal with new machines
which really aren't that complicated, but challenging to them, none-the-
less.

I've worked a few elections myself, a floater going where I'm needed.
I'm 53. The day is hard on me. At one polling place, one of the
workers was in his 90's. The average worker was well past 70.


My 21 year old daughter has worked several local elections and feels
alienated by the 'mature' workers who, after spending 17 hours on their
feet, aren't particularly sure-footed or clear headed... and aren't
that receptive to the ideas of some young kid (who happened to graduate
college early and will attend lawschool in the fall) which is why
avoidable mistakes are commonplace, or the process is overly tedious.

"I've read the manual.  I've done this before. I could shut down the 
machines... all of them ... in less than 10 minutes.  But these folks 
are inclined to read and reread the manual and have a consensus before 
doing anything.  That's fine, but counterproductive."

I once gave Steve a ride to Trenton to attend an "Affordable Homes For
New Jersey" rally held at the Statehouse.  It was an eye widening, head

I recall a few years back a successful movie theater owner/manager was 
approached (I don't know who approached him) to renovate an 
underperforming/derelict theater in AP to restore it to its original 
stature.

The catch?  He would have to build, open and manage a movie theater in 
Niagra Falls, NY.

Netflix, Blockbuster, etc. has challenged the industry.

For lack of a better word, "The Government" is pressuring (sorta like 
a non-binding resolution) the loan servicing industry to freeze 
foreclosure proceedings and then to modify loans at risk of 
foreclosure to keep owner-occupants in their homes.  They're talking 
about freezing ARM rates at the 'teaser' levels from one to five 
years.  Keeping families in their homes is ideal, and I hope damage 
caused by the 'subprime cherynoble' can be reversed or at least 
arrested.  

The complexities and cross securitization of mortgage debt will be 
anything but easy to unravel which was brought to light by an Ohio 
Circuit Court's recent ruling, essentially tossing out 14 foreclosure 
lawsuits because the 'lender?" could not legally establish its 
standing and right to foreclose.

To paraphrase the judge's ruling, "The right to collect payment from 
a mortgage loan doesn't necessarily give that party the right to 
foreclose.  The Plaintiff (who brought the foreclosure action) must 
prove it has ownership of the mortgage and has the contractual right 
to foreclose."

If loan servicers unilaterally froze interest rates, or restructured 
loan terms, this action would cause a domino-like reaction adversely 
impacting certain guarantees made to the investors who hold the 
mortgages, or who have financial interest in securities 
collateralized by mortgages.  Contractual guarantees unilaterally 
altered or rescinded result in lawsuits. 

In my opinion, unless and until "The Government" can unravel the 
clusterf__k and appease the global investment community who stand to 
lose untold profits if interest rates are frozen,  its 'pressure' on 
loan servicers will meet deaf ears.

This is an unedited version of a letter sent to TriCityNews in 
response to criticism of the appropriateness of Springsteen's 
participation in politics... I guess because he isn't one of "We, The 
People" and has no business using music to voice his concerns, or to 
raise our level of consciences.  

 

Kudos to Tommy DeSeno for his incite-ful article - Losing Springsteen 
to Haute Monde Politics - in the recent Tri City News (The Educated 
Issue, no less!).  I loved how he articulated Bruce Springsteen's 
attempt to politicize American rock and roll:   "Why do you want to 
change, Bruce? In your interview with 60 Minutes, you announced a 
change from singing about people's personal struggles to Washington 
DC politics."   

Everyone knows that people's personal struggles have nothing to do 
with DC politics.   

Mr. DeSeno further pointed out:  "Even his songs regarding war 
weren't political. They were about the soldier."  

Duh!  There is absolutely no relationship between war and soldiers 
fighting halfway around the world in lands where they don't speak or 
understand the language, culture, or history, with their fingers on 
the trigger of a Colt XM 177 cold, exhausted, (undoubtedly poor) and 
ready to shoot at a moment's notice – all in a (promoted) effort to 
protect our freedoms here at home.

I mean how can someone with only a high school diploma, and who comes 
from a small, blue-collar, working class American town – whose 
classmates were deployed to "fight the yellow man" in Southeast Asia 
in the prime of their lives - know anything about "the big issues"?  
Stuff like that never shapes your life.  Instead, it takes a Yale 
University and Harvard Business School graduate – from a long line of 
prestigious college alumni and worth millions of dollars - to 
adequately express the intricate and ever-expanding relationship 
between the common man and the common man in fatigues.

Just who does Bruce Springsteen think he is?  He is not fooling 
anyone, least of all Tommy DeSeno:  "(Bruce) when the subject was 
politics, you stammered and stumbled.  It's not your talent."

That's right.  Leave politics to the politicians.  Hey, look at the 
bang up job our "representatives" are doing now (with the common 
man's tax dollars, the common man's sons and daughters, and 
continually picking the common man's pockets).  As an aside, I'd like 
to share my personal decision-making criteria for 
identifying "talent" during campaign season:  Always vote for the 
candidate with the most vibrant shades of red, white, and blue on 
their election signs.  And if they're decorated with stars and 
stripes, it's a slam dunk.
Rest assured, they've got your back covered!

Additionally, I would love to see (court jester) Bill O'Reilly make a 
fool of Bruce over his political virginity.  Imagine the ratings 
phenomenon that would be!  (Note to self:  Invest in Fox stock 
today.)  I can see it now.  Bruce fumbling for words to illustrate 
some poor national guardsman's attempt to make ends meet while 
securing personal lives and loved ones during repeated and endless 
deployment to war zones.  Just let Bruce try and find the (right?) 
words to describe soldiers watching as comrades and civilians are 
blown to smithereens.

What a hoot!  

I hope Bruce takes the (right) hint and forgets all this political 
stuff.  It can get you into a whole mess of trouble.  Consider the 
words of Brazilian Archbishop Helder Camara, a man who spent over 70 
years tending to the impoverished citizens of his nation.  He had the 
audacity to speak out against censorship, torture and killings.  He 
implored the Catholic Church to move beyond charity for the poor by 
tirelessly advocating for fundamental social changes:  "When I fed 
the poor, they called me a saint. When I asked, `Why are they poor?' 
they called me a Communist."

Thank you Mr. DeSeno for pointing out that when the subject was 
music, Bruce was like "Shakespeare."  That is an interesting analogy, 
though – especially considering that this author of Henry VI also 
said:  "The first thing we do, let's kill all the lawyers."

[AsburyPark] Enough. Brown v. alternative lifestyle

To my thinking, this really isn't the appropriate forum for any of this 
and, quite frankly, doesn't serve up the interests of Asbury Park. Who 
cares if Mario is gay?  I don't. I'm not gay and don't much care who is 
or isn't. Who cares if Rev Kev may, repeat, may have exercised 
questionable judgement awhile back.  You want to talk about it?  Fine, 
but this isn't the right forum. Anyone visiting this site and reading 
this crap (I haven't followed more than a few posts) would think that's 
all Asbury Park was about.

When we post here, we are all ambassadors for the City of Asbury Park. 

I spent a couple of hours in America's Cup a couple of days ago, 
working on my next book. I overheard some opinions about parking 
concerns:  meter vs. 2 hour limits

Anyone with an opinion (unless its been discussed to death)?

My wife, daughter, and I dined there (OMR's)last nite after visiting 
the Arcade and Under The Sun. We had a window seat overlooking the 
sidewalk. There was very little foot traffic. Hopefully, in the not too 
distant future, the streets will be alive with passers-by. 

The service was excellent. The food was plated beautifully including 
my 'pub' steak, potato, and beans. The steak was tasty, but tough and 
stringy no matter how thinly it was sliced.  My daughter raved about 
the salmon, my wife enjoyed the tuna.

I was expecting to see the mounted police.  Where are the horses 
boarded when off-duty?

[AsburyPark] What Happened?

My wife and I decided to bike ride yesterday.  Starting off from our
home in Oakhurst, we peddaled east to Ocean Avenue, then north thru Long
Branch along the ocean.  The board walk and adjacent path was filled
with joggers, walkers and bikers. We saw a few people we knew puffing
along the boards.   The new businesses at the north end were hopping,
too.  A wedding reception party was gathering outside McLooons...
although it was simply a beautiful day,  I could not help thinking this
was not the Long Branch I recalled as a child.   We cruised around
MTOTSA.  (I have 7 "End Eminent Domain" tees, all in the laundry...)

Then we aimed our old bikes into the wind  toward Asbury Park.

Outside Convention Hall, we ran into and talked with a Mom we knew whose
husband was struck and killed by a car a couple of weeks ago.  On
parting, she advised us to "look both ways before crossing."   Good bye,
Rob.

We locked our bikes outside the Twisted Tree, and had a cup of corn
chowder before walking through the antique shoppes.  We got a couple of 
scones at the place next door... the pineapple and coconut scone was
worth the trip.  One of the best I've ever tasted.  I  saw things
advertised as "antiques" and recalled them as everyday applicances when
I was growing up.  The sight of a gleaming, plastic motorized Juicer
brought back a floodgate of childhood memories.  Good memories.  I
remembered every August or early September my folks taking me to
Steinbachs, and National Shoes for school clothes.  And everything else
Asbury Park.  Remember Mr. Peanut?

My wife, a CPA, had volunteered for free tax clinic in Asbury, in the NJ
Natural Gas office (which is right next door to "Under the Sun") before
expanding the clinic into the Asbury Library where she, and one or two
other volunteers prepare hundreds of tax returns without charge during
late March and April.

We spent an hour or so  with"Under the Sun" owners Tony and Michelle who
have some beautiful art pieces as tributes to the architectural history
of Asbury Park perfect for hanging in local businesses.  DO YOU HEAR
THAT (Old Man Raffertys) MARK! They can take an antique  era p0stcard or
photograph, and replicate in on a type of silkscreen... although it is
more like a fine, metal screen material  and wrap it in a complimentary
antique frame.  A modern way to remember the past.

Michelle,  an expert in collectibles and a custom jewelry designer, and
her husband Tony, a craftsman (and arguably the best basketball player I
had ever seen) exemplify what's going right with Asbury Park.  I felt at
home and comfortable as  I would in Lambertville, New Hope, or Lahaska. 
Sure, the transformation along the waterfront hasn't been pretty, but
the downtown is, in my opinion, going in the right direction.

Long Branch vs Asbury?  For me, Asbury conjurs up good feelings while
the Long Branch experience left me thinking, "What Happened?"

Of interest, an independent auditor's report (June 07) of Ocean's 
financial statements of various funds and accounts indicate the 
accounting and reporting practices used by Ocean Township is 
something other than US generally accepted accounting principles.

The report to the Mayor states that the financial statements audited 
do not represent, fairly, in conformity with generally accepted 
accounting principles, the financial position of the various 
individual funds of the Township of Ocean.

H.  I'm not suggesting anything untoward, but has anybody looked 
at Ocean's Financial Statement?  It's Greek to me.

Fair with my folks. Remember the amphi-car? I also remember the story 
book village where Sears used to sit. I recall there was a Wild West

I haven't been following this thread, and I may be sticking my nose in
something I shouldn't... but I read this quote, 

"The beachfront redevelopment had its first condo closing last week. 
$825,000.00 unit. That's reality."

I have spent a few years investigating untoward realty transactions
including predatory lending, and mortgage origination and appraisal
fraud... as well as some time working as a managing partner in a
waterfront redevelopment project. I even had a few ocassions to bid 
against MDSass at muni tax lien auctions, and had a E-Confrontation 
with L. Fishman as his company was evicting an elderly woman from a 
home MDSass had purchased via tax lien foreclosure. So, nothing 
surprises me. In fact,my wife calls me a conspiratorial theorist.

Historically, when a housing development is first exposed to its
market, it isn't uncommon for the first few units to be sold at less
than an arms'length transaction... these early sales set values upon
which other units are compared.

Not saying this is happening here... but I wouldn't be too surprised.

I have spent a few years investigating untoward realty transactions 
including predatory lending, and mortgage origination and appraisal 
fraud... as well as some time working as a managing partner in a 
waterfront redevelopment project.  So, nothing surprises me.  In fact, 
my wife calls me a conspiratorial theorist.

Historically, when a housing development is first exposed to its 
market, it isn't uncommon for the first few units to be sold at less 
than an arms'length transaction... these early sales set values upon 
which other units are compared.

Not saying this is happening here... but I wouldn't be too surprised.

I guess up until a few years ago, he lived in Wayside and operated an
entertainment/wrestling school, in addition to a part-time roofing 
contracting business. He was often seen about town riding his 
motorcycle.  His son played on the Ocean Township football team.

I read recently Scott turned himself into the Florida police on an 
outstanding warrant.  He was said to have body-slammed a girlfriend.
She complained.

He did have a temper.  Years ago I was rehabbing a huge house in Colts 
Neck which was in need of a new roof.  I called a few roofers for 
estimates, thinking it would take a few days for them to prepare and 
submit a written estimate. Long story short, BamBam didn't get the job 
and didn't take it too well.

Tom, I co-founded a 501c3 (Society for the Preservation of Continued 
Homeownership, or SPOCH, for short) whose mission is to help people who

the USA unable to afford the increase in monthly payments; the recently 
enacted changes in the bankruptcy laws will result in more homeowners 
unable to keep their homes; and the deteriorating real estate market 
and quickly evaporating "artificial equity" making already high LTV 
mortgages impossible to refinance... and in many cases, making those 
homes with 125% LTV mortgages impossible to sell.

RevKev, as you know, I work with a non profit charitable and 
educational organization, [501c3] too.  Funding is scarce.  If $1,000 
is being offered by rolemover, I think we should accept that offer.  
Perhaps the board's resident attorney can offer an opinion as to

How better to let the kids know that the adults care about them and 
their opinions (read: respect) than to tell 'em so?  If the kids 
develop a feeling of self worth and self respect... who knows how 
Asbury can benefit?

[AsburyPark] Jim Keady & Inconvenient Truth(s)

Keady's campaign included gathering information and listening to the 
thoughts and concerns of the people of Asbury Park.  Door by door.  
Apparently, those people liked what he stood for enough to get him 
elected.  Keady was elected to represent the interest of the People. 
Keady was not elected to be a cheerleader for redevelopment. 

Is Jim a politician?  Thankfully, not in the traditional mold. Look 
where politics have gotten us? With few exceptions, our elected 
officials are presented to us, and 'rented' by special interests. 

I think more of our elected officials should take a page from the Jim 
Keady handbook.

He might piss off the special interests... and those who shill for the 
special interests, but the voters know their concerns have a voice.

[AsburyPark] In my view....

In my view, the problems that plague Asbury Park are indicative 
of a larger problem.  While discussions about curb height, historic 
preservation, and a convoluted redevelopers agreement are important,so 
too are political discussions because the solution to Asbury's ills as 
well as Society's ills will be political. 

The average Joe doesn't much care about politics, having been 
disenfranchised by the political process... as evidenced by the
pitiful poll turnouts.  So if this isn't the right forum to discuss 
long term solutions... the operative word being 'discuss' how else do 
we engage the general public into much needed dialogue?  Ff the 
discussions are intellectually honest, and serve to educate rather than 
simply facilitate goon-like behavoir, this can be a powerful forum.

Dad's book as a gift for our nephew.. a young baseball player and 
modern Yankee fan.  Of course the nephew didn't appreciate the book or

I've spent 25 years working closely with people when they are dealing 
with extreme life challenges, and I've become a fair judge of 
character.  I've met Jim Keady. He is a good, sincere, intellectually 
honest guy.  He is a forward thinker and sees the bigger picture of how 
things are and how they ought to be. He wants to build a bridge between 
the two. I don't believe him capable of making insensitive remarks.

I also know Asbury Steve. Perhaps you mistakenly confused the two?

Mario, thanks for your kind words.  Truth be told, I can't take full 
credit for my words.  I've had great teachers along the way, and I was

Well, this isn't the most appropriate forum for this, and I do 
apologize in advance to other readers for responding to your 
statement.  I should have simply written a letter to the TCN last 
June.

Your interpretation of Marx is a matter of intellectual honesty.  A 
common misconception shared by many is that the Soviets attempted 
Marx's Communism.  The irrefutable fact is they didn't.  The Soviets 
utilized commodity production, a political government, and a wages 
system  much the same as the capitalism we endure here in our own 
country. 

The Communist Manifesto from which you quoted, AND took the quote out 
of context , was written by a young Marx  who had not yet examined 
and analyzed capitalism to the extent that it was in Das Capital,  
which was his most significant contribution to our understanding of 
how capitalism works, something all of us should know and discuss, 
that is, if we're interested in and committed to living in a real 
democracy.

You wrote, "The following is Marx's most famous quote from the 
CM:  "In this sense, the theory of communism may be summed up in the 
single sentence: abolition of private property"

You eliminated the full, authentic text which qualified Marx's 
qualifier "in this sense..."   In its context, Marx's "bourgeois 
private property" is TODAY's MODERN, PRIVATELY OWNED, CORPORATION... 
the GMs, the GEs, the Halliburtons, and the rest of the corporate 
complex whose dominant owners, (in contrast to the small investors) 
whose market system and values dictate our culture. Those same 
dominant owners of industry control our Congressional seats through 
campaign financing.

Marx never outlined a clear alternative to the current "private" 
ownership (again, meaning corporately owned) of our necessary 
industries.  His real contribution is in pointing out how 
capitalism's institutions do not serve well most citizens... and is 
counter-productive to having a democratic, prosperous, and peaceful 
society.

As of today, we, as in We The People,  have the US Constitution which 
enables us to have a society in which our needed industries are 
socially owned and democratically operated by ourselves for our own 
use... rather than for the profit interests of a distinct capitalist 
class minority.

I'm concerned by the recent strong-armed attacks on our 
constitutional freedoms in the name of 'protecting Americans'.  
Yesterday was heralded and disguised as a benchmark day in the fight 
against terrorism... but it really was a punch in the gut to the US 
Constitution... and a get out of jail free card for the present 
administration.

I digress.  If you want to continue this discussion, I'll be in 
Amherst, MA later this month for a conference on "Marx Revisited"  
But I guess I won't see you there.

I do, however, appreciate your insight into Asbury Park.

The role of master developer, at least in other high profile
NJ redevelopment projects, is that of a choreographer/solicitor. 

The MD (master developer) creates the opportunity and positions itself
in the drivers seat The MD doesn't get the whole pie, but seeks as 
many pieces of the pie as possible... including every source of revenue
not demanded by the sub-developer including signage, vending, 
parking, ancillary business opportunities... all the while seeking to 
reduce costs and/or shift the burden to sub-developers or the community 
itself. 

Their at risk capital is in the form of soft costs... not necessarily 
in the form of stix and bricks.  The fees paid to lawyers, accountants, 
economists, site engineers, architects, surveyors, appraisers, 
political bribery, etc.  I would guestimate the ProForma (the formal 
pitch to the sub-developers) alone cost upwards of $250,000... or maybe 
10 times that amount. I'd bet a lot of MD's soft costs were subsidized 
by grants or low interest loans from the New Jersey Economic 
Redevelopment Agency, Department of Commerce, even the DOT.

I call it a perfect storm.  

#1. The anticipated housing market decline.  Artificial equity is 
evaporating revealing a home's true value with relation to the amount 
of the mortgage(s).  The recent wave of cash out refinancing (equity 
depleting) sometimes up to 90% or more of the home's Fair Market Value 
may result in a large portion of American housing mortgaged to the 
hilt
#2. Adjustable Mortgage Loan RESET.  Those mortgage loans now are 
resetting from artificially low interest rates to somewhat higher rates
making homeownership more expensive... 
#3.Changes in bankruptcy laws will challenge homeownership as many 
debtors can't afford Chapter 13 repayment plans... Chapter 13 has long 
been the last lifeline between foreclosure and preserving 
homeownership.  Now that lifeline isn't in close reach.  Oh, have you 
noticed the minimum monthly credit card payment has increased? 
Coinciding with the new bankruptcy laws, credit card companies decided 
to increase the minimum payment placing further strain on household 
budgets.

I recall going there in my late teens and early 20s.  I drove the 
circuit with a friend who had a brand new, white, 1974 Monte Carlo. I 
couldn't use my car because it would have been stop, jump out, and 
push at every light. CB radios were big then.  I never took a 'lude' 
but I knew what it was, and the people who took them, in retrospect,  
seemed vey happy...  Didn't the former Asbury Park Mayor take a 
lot of ludes?  Or did he just sell them.  I can't recall, but his 
family owned a funeral home.   Does anyone remember John Bass, the 
artist? He used to hang out at the Golddigger.. and later had a 
series on local cable TV painting acrylics a la Bob Ross. I think he 
lost a leg.  Didn't Golddigger have bar hot dogs?  My grandmother, 
after my Grandfather passed away, worked at the Criterian Candy 
store. The first time I went in there was to see her working
I saw here in her white iniform, and she gave me something I had 
never seen or tasted before:  white chocolate.   She would take the 
bus from Criterian a few miles north to where she lived.  The bus was 
a perfectly safe and acceptable form of transportation even for 
little old ladies smelling of boardwalk chocolate.

I think Dan and his staff ought to be congratulated for
creating a successful, local newspaper. I wish it had a 
sports page.  A weekly newspaper is essential to any 
community and TCN is great PR for AP.  
The TCN serves not only the folks in AP, but touches on 
issues that impact Red Bank, and Long Branch, too. 
My wife and I read it just about every week.  I used to read 
Justified Right by DeSeno... but can no longer stomach it.
He might have graduated from law school, but he ain't no
student of history or political science, or at least he wasn't 
a very good student.
