Our Attorney Ron Gasiorowski has submitted a final bill for his legal services. We need to raise $5,000 as soon as possible to pay his legal fee. As many of you know, Mr. Gasiorowski successfully argued the appeal before Judge Lawson in Freehold. As a result, Judge Lawson affirmed the Asbury Park Zoning Board's decision to deny Market Street Mission their variances as well as the city's decision to shut the Mission down. Had the Market Street Mission remained open, approximately 1,000 homeless men would have been brought to Asbury Park every year. These men would eventually have been left to fend for themselves on Asbury's streets. This would have been disastrous to the city's safety and quality of life and would have placed substantial financial hardship on our town. I received word last night that Judge Lawson of the Freehold Superior Court rejected the Jersey Shore Rescue Mission's appeal against the decisions of the Asbury Park Zoning Board on ALL counts. I am waiting to get a copy of the Judge's decision. This is tremendous victory for the People of Asbury Park, the Zoning Board of Adjustments, the City and Stand Up For Asbury! The Jersey Shore Rescue Mission is closed. The People of Asbury Park Stood Up to defend our interests and to declare that this city will no longer be a dumping ground for New Jersey's unwanted. Tomorrow Night, Tuesday October 16th at 7:00 p.m., The Asbury Park Zoning Board of Adjustments will meet to decide the matter of the variances issued to the Jersey Shore Rescue Mission. Asbury Park must not become a human dumping ground for New Jersey's unwanted alcoholics, drug addicts, criminals and mentally ill. The JSRM chose Asbury Park for its religious crusade not simply because it is easily reached by train and bus. It chose Asbury Park because it believed that our council and boards would simply role over for them. It chose Asbury Park because it believed that the people of this city would not Stand Up to defend their interests. In recent years, religious institutions have become very powerful. New laws passed by Congress have emboldened them to assert that land use laws that apply to private citizens and businesses somehow do not apply to them. Powerful lobbies and legal groups funded largely by evangelical foundations intentionally intimidate cities by threatening costly legal battles. These groups make facetious legal arguments claiming that denying land use variances is tantamount to denying the free exercise of religion. The City of Asbury Park will no doubt face this hurdle in the future. But for now, the Asbury Park Zoning Board of Adjustments has the legal and moral responsibility to defend the quality of life, security and future prosperity of the citizens of Asbury Park. You are urgently requested to attend this hearing tomorrow night. [AsburyPark] Stand Up For Asbury!
The Asbury Park Zoning Board met last Tuesday to hear public testimony regarding the variances that were issued to the Market Street Mission. Stand Up For Asbury is grateful for the large number of supporters who not only showed up but also testified under oath to the large numbers of homeless men who have taken up residence on the streets of our city since the Mission opened. Stand Up's attorney, Ron Gasiorowski, made a compelling closing statement and reminded the board that the detrimental effects on the community FAR outweigh the Gospel Mission's benefits and that the board has the power to rescind the Mission's variances. The Board will reconvene on either October 16th or October 30th to make its decision. Stand Up For Asbury is confident that we made our case to the board very clear. The board finished up hearings Tuesday night after listening to many members of the public testify in favor of or against the religious rescue shelter, followed by summations by attorneys Ron Gasiorowski for residents opposing the shelter and Brendan Judge for the Jersey Shore Rescue Mission. "When we begin to deny certain people a chance to put their lives back together, then we deny the whole city . . . and it's a sad statement that just because some other city doesn't have it (the shelter) that we shouldn't," said the Rev. Johnie Vause, pastor of Bethel A.M.E. Church in the city. Many of those against the Jersey Shore Rescue Mission say they object both to the mission's lack of programming for most of those who sleep there and that, because of its size, it will attract many new homeless people to Asbury Park instead of focusing on the city's own people in need. "Asbury Park is a city that's healing, is in recovery, and has a homeless population with needs," resident Sean Hollingsworth said. "We don't, at this time, have the wherewithal to reach out to all the needs in New Jersey. That's my concern. I feel the mission might be a wonderful thing but may be not right for Asbury Park. When we get healthy, we can reach out to others." The zoning board initially turned down the proposed shelter in 2005, but then approved it with certain conditions in 2006 after the mission appealed. A group of residents learned of that approval and filed a lawsuit in state Superior Court to stop the mission from opening. Superior Court Judge Alexander Lehrer, who recently retired, ruled in 2006 that the zoning board had not considered the mission's beneficial use. When the new suit came in, Lehrer sent the matter back to the city zoners to determine if detrimental aspects of the shelter outweigh the beneficial use. The mission, meanwhile, has opened and is operating while its fate is being determined. Once the board makes its decision, the matter goes back to Superior Court where a different judge will use the zoners' ruling as part of the new appeal to be decided. Some mission supporters say it is only right for the city to be open to a large homeless shelter to offset, in a way, those poor people being displaced on the redeveloped waterfront. Opponents don't buy that, saying the city has had more than its share of people in need for decades. Besides feeding and providing a place to sleep, Jersey Shore Rescue Mission's focus is to attract individuals into its alcohol and drug recovery program, which can run for six to nine months. Of the 40 beds at the shelter, 10 beds are for those who join the program. Another 27 bes are for homeless men who can stay for only 10 nights and are sent outside during the day. NEW STAND UP FOR ASBURY SIGNS ARE NOW AVAILABLE. EMAIL ME PRIVATELY IF YOU WOULD LIKE ONE PLACED ON YOUR PROPERTY! It is clear to all that the Jersey Shore Rescue Mission is creating a huge problem for Asbury Park. Scores of homeless are setting up camp on the streets and parks of Asbury, attracted by the free meals and temporary shelter provided by the Gospel Mission. These homeless come from all over the State of New Jersey and beyond. They include a large number of drug addicts, alcoholics, mentally ill and those who choose the homeless "lifestyle". The gospel mission is now a referral source for state prisons and public prosecutors. Hospitals including Jersey Shore Medical Center discharge psychiatric patients in the care of the Mission when these patients have no family to take them back. It is hard not to be cynical about the nature of this operation. Attracting homeless to the men's shelter by night and then tossing them out on the street by day concentrates the problem of Jersey's homeless within the confines of Asbury Park. It also creates the impression that there is a need for an enormous homeless shelter in our city. A little bit of advertising, public relations campaigns and hitting up benefactors with deep pockets brings huge amounts of money to the mission every year. In 2006, the Morristown Mission took in revenues of just under 3,000,000. Where is this money going? The men who are taken into the shelter sleep on basic cots in a bunk house type setting. Much of the staff consists of volunteers. The homeless men themselves do a lot of the heavy lifting as part of the so called "new reality of recovery" program. Food and clothing are donated to the mission for distribution. Automobiles and items sold at the thrift shop are also donated. David Scott's salary in Morristown is over 90,000 dollars a year not including benefits. The mission pays no taxes of any kind and owns its properties free and clear. There is so much money coming into the coffers of this gospel mission. Yet those in the shelter get relatively little. Penniless, they are put out on our streets by day to panhandle. They go to the Asbury Park Division of Social services looking for public assistance referrals and bus fare out of town. Aside from the basics, the gospel mission offers these men nothing except the bible. The Jersey Shore Rescue Mission is exploiting the homeless and exploiting the City of Asbury Park. This must stop. Whatever "inherent beneficial use" this mission may have, it is far outweighed by the problems it is creating in this city. No city should be forced to take on the issues of large numbers of homeless people from other parts of the state. And the homeless should not be lured to a gospel mission masquerading as a proper homeless shelter and treatment facility only to be dumped on the streets of a city struggling with its own problems. The zoning board has a responsibility not to allow this religious organization to turn Asbury Park into a regional destination for the homeless and the troubled. Tomorrow, July 10th at 7:00 p.m. the Asbury Park Zoning Board reconvenes to consider the matter of the Jersey Shore Rescue Mission (Market Street Mission). The public will be permitted to question the testimony previously provided by Tony Nuccio, the Asbury Park director of social services. Attorneys for both sides will also make summation arguments, time allowing. The Neptune-Asbury Park Ministerial Alliance is firmly behind this Mission and has done a good job turning out a fringe group of Mission supporters. The alliance's angle is to turn this issue into a wedge in an effort to advance its own agenda. The tactics are completely transparent. Rev. Bradley has taken one of my postings about Library Square Park, attached my name and affiliation to Stand Up For Asbury to it and made it into a flyer. He mailed it to my office accompanied by a letter accusing me of racism, bigotry etc. While no threats were implied, the intent of his letter was to intimidate. I would not be surprised if he plans to distribute the posting at the hearing tomorrow. I would ask that all of you attend this hearing as a gesture of support for the Asbury Park Board of Adjustments and for Stand Up For Asbury. Mission supporters will fling a lot of mud at tomorrow's hearing in an effort to intimidate the zoning board and the members of Stand Up. This hearing will be one of the last and most important. Asbury police chief testifies at rescue mission hearing 40-BED HOMELESS SHELTER Posted by the Asbury Park Press on 05/31/07 BY NANCY SHIELDS COASTAL MONMOUTH BUREAU Post Comment ASBURY PARK Some of the services a gospel rescue mission wants to provide homeless men at a shelter could be good, but the large numbers of men potentially cycling in and out of the city from elsewhere could be tough on police and residents, Police Chief Mark Kinmon said. Kinmon testified Tuesday night as the Zoning Board of Adjustment continued its examination of a proposal by Market Street Mission of Morristown to expand its operations and run a 40-man homeless shelter on Memorial Drive. Of those 40 beds, 10 would be for men taken into the mission's own long-term program for six months to a year; 27 beds would be for men who could not stay more than 10 nights and who would have to go out during the day and get services they need; three beds would be for staff. The zoning board is considering the application for a third time following appeals that landed the matter in state Superior Court. A significant issue for the board is that testimony now indicates that the mission is reaching well beyond the needs of Asbury Park and would draw hundreds up to 972 men a year from throughout the region and state to a city already overburdened providing services for its residents. Testimony over the past several months has left it unclear how the mission would ensure services for the huge numbers of men beyond the 10 or so taken into its rescue program. When asked about the potential impact of up to 972 homeless men on police and city citizens, Kinmon said, "It's safe to expect our calls for service to increase with those kind of numbers. "It would create an extra workload on fire and first aid," Kinmon said. "A lot of times, it has been our experience that we respond . . . and find if they are intoxicated, down and out, we contact first aid and have them taken to Jersey Shore (University) Medical Center." Now, the chief said, Jersey Shore is trying to curb having the intoxicated brought there. Kinmon said homelessness is not a significant problem for police at this time, but the increase in numbers could be. "The issue is the time it would consume when we have very serious issues now gang violence and shootings," the chief said. "To take anything away from these issues is going to be a problem for us." Kinmon said police are the first responders on a call of homelessness but that Anthony Nuccio, the city's director of social services, takes over. Nuccio previously testified and will return at the zoning board's next scheduled hearing at 7 p.m. July 10. The proposed shelter, called the Jersey Shore Rescue Mission, does not allow anyone intoxicated or on drugs to stay there. Kinmon said he has 83 or 84 officers and wants to have 100 by the end of 2007 to meet the needs the city now has. A homeless shelter would require another 10 officers to be hired, and the cost would be prohibitive, he said. The board is attempting to determine the exact number of homeless in the city since testimony in earlier years created a picture in the low hundreds. However, city officials say the actual number of chronic homeless is about 25 to 30. The Rev. Gilbert Caldwell, an associate minister with First United Methodist Church, said he lives in one of the new Barcelona waterfront condos and asked if the shelter could not complement the work being done on the beachfront. "I believe there's value to it, but a situation will be created that will be troublesome, will be burdensome," Kinmon said. Yahoo! The zoning board will reconvene tonight to consider the application for the variances sought by the Market Street Mission. More important testimony will be heard tonight by the board. I encourage all those who oppose this mission to attend this hearing. The stakes for Asbury Park are rising. This evangelical men's shelter is already attracting homeless individuals to Asbury's streets, parks and boardwalk. These people are are not Asbury residents, former or otherwise. It is no coincidence that these individuals have arrived in town now that the Mission begins operations. Safety and quality of life for all Asbury Park residents is being jeopardized. Zoners balk at plan for homeless in Asbury Park Shelter numbers draw concern Posted by the Asbury Park Press on 05/16/07 BY NANCY SHIELDS COASTAL MONMOUTH BUREAU Post Comment ASBURY PARK The hearings were intended to be brief as city zoners once again consider a proposal for a Morristown-based gospel mission to run a 40-bed homeless shelter for men on Memorial Drive. But that goal apparently grew elusive once the Zoning Board of Adjustment heard that the shelter could cycle up to 972 homeless men onto city streets, often from elsewhere in the state. Friday night's hearing dredged up concerns of what happened in the 1970s and 1980s, when state agencies and hospitals, boarding-home operators and politicians filled up Asbury Park's boarding homes with thousands of mentally ill patients. "I can't verify (972) are the numbers," Anthony Nuccio, the city's director of social services, testified Friday. "But if those are actual numbers, it would be staggering to the city. . . . It would negatively impact the quality of life in the city and have a negative effect on the client." The Zoning Board subpoenaed Nuccio after getting conflicting numbers on how many homeless men Asbury Park actually has. Market Street Mission, the applicant that wants to expand its longtime Morristown operation to the Shore, cited a Monmouth County Social Services report in May 2005 that showed 352 homeless people, with 116 of them saying Asbury Park was their most recent residence. Nuccio said the city is tracking a far smaller number of homeless 20 to 25 individuals from Asbury Park and Neptune, who may be in boarding homes and not homeless at one time. In addition, there are transient homeless who are sent to the city by other towns and organizations, often because of the city's reputation over the years as a place for the homeless, Nuccio said. It is that image the city has been working on changing in recent years, and which the residents who filed suit to stop the shelter from opening believe is unfair to their city. Members of Stand Up For Asbury have said the city has a right to be on an equal par with its wealthier neighbors when it comes to the homeless and quality-of-life issues for the city's existing residents. "Are you aware of any boarding houses built in Deal? Spring Lake? Manahawkin? Sea Girt?" Zoning Board President Keith Zyla asked. Nuccio did not name one. Listing Asbury Park's large number of churches, its AIDS Center, its methadone clinic and CheckMate, Zyla asked: "Are you aware of any other municipality that has that amount of services?" "There are none," Nuccio said. "And, Deal could better handle this monetarily (than Asbury)?" Zyla asked. Today's chronic homeless in the city are no longer the mentally ill but more likely to be people with alcohol or drug addiction, Nuccio said. The city has taken a tougher stand in dealing with the homeless in recent years, offering shelter but having clients take steps to get help. Opponents to Market Street Mission's plans cite that of a total of 40 beds, 10 would be used by men accepted into the mission's rehabilitation program, which lasts six to 12 months. Three of the beds would be for staff members, and 27 would be for men needing a place to sleep. The Zoning Board initially turned down the proposal in 2005. Market Street Mission appealed that vote, and Superior Court Judge Alexander Lehrer found that the board had to reconsider the proposal in light of its beneficial use. It was during that reconsideration that the board last year approved the shelter with restrictions that could help the city regulate it. When residents and neighbors learned of that approval, they appealed the board's favorable ruling. Lehrer is overseeing the case. All parties agreed to have the zoners hear additional testimony of a narrow scope executive director David Scott's previous testimony about Market Street being a "blessing" to Morristown. The scope has widened, particularly after zoners heard testimony that the shelter would be regional in nature. Asbury Park zoners to hear more testimony on homeless shelter application Posted by the Asbury Park Press on 05/11/07 ASBURY PARK The Zoning Board of Adjustment will continue consideration of a proposed 40-bed homeless shelter 7 p.m. May 29. Anthony Nuccio, city director of social services, testified Friday night that the shelter proposed for Memorial Drive would have a "staggering" effect on city services. Previous testimony before the board indicated that as many as 972 homeless men could cycle through the city in a year's time. The board had said testimony regarding the application had concluded but because it received conflicting numbers as to the number of homeless men in the city it wants to hear from witnesses on that subject. Police Chief Mark Kinmon will testify at the next hearing. The shelter, which would be operated by Market Street Mission of Morristown, is opposed by people who say they do not feel that Asbury Park must always be the place for homeless people in Monmouth County and the region. The Asbury Park Zoning Board of Adjustments will reconvene on Friday, May 11th at 6:00 p.m. to hear closing arguments by attorneys for Stand Up For Asbury and the Market Street Mission. The board will then deliberate and vote on the different variances that the Mission is seeking. Hopefully all will be concluded then. The good news is, the board is meeting Friday instead of Tuesdays. The attorneys for Stand Up For Asbury and the Market Street Mission should complete their closing arguments tonight. Then the board will have to make a decision. I am deeply offended by their assertions that Stand Up For Asbury cares more about property values than saving lives. However, as I told Kerry over the phone when I asked to attend her press conference, I respect her for taking a stand. Like Stand Up For Asbury, they are learning just how hard it is to gather facts and opinions, to make a judgment call and to stand behind it. Opponents will pick apart and undermine their positions, second guess their plan of action, or even just get in their face and try to intimidate them. Stand Up For Asbury knows this first hand. Their position may be harmful to Asbury Park, but having the courage of their convictions has at least earned my respect. Stand Up For Asbury's attorney presented two great witnesses to supply additional testimony to the board regarding the Shelter's potential impact on the city. Once these hearings are over, the board will have to weigh the court determined "inherently beneficial use" of the shelter against the detrimental impact the shelter will have on our residents and on our city's development. This weighting is the so called SICA test. Hopefully, these hearings will be completed next April. Sadly, Councilman Keady once again was present at this zoning board hearing against the advice of the city attorney. The councilman placed himself squarely among the Mission Supporters, two of whom had to be evicted from council chambers during the proceedings. It is vexing in the extreme to Stand Up For Asbury that this partisan council person uses this oportunity to network among Mission Supporters for political gain. The issue of a shelter in Asbury Park is clearly divisive with strong feelings on many sides. Dear Friends, As per my fears, I just confirmed, without a doubt, that the Leaders, and possibly Members, of Stand Up For Asbury, are using manufactured lies and falsehoods to create fear in the Community against the newly opening Jersey Shore Rescue Mission, which is slated to open September 6th! By extrapolating information from a Brochure which the Mission put out, they took a statement that "There isn't a Mission from Newark to Atlantic City", twisted it and made the result a lie, saying that the Mission will "Recruit" Homeless People for their Mission in Asbury Park from areas stretching from Newark to Atlantic City! NOT true! You guys really HAVE absolutely NO Pride, Morals, Dignity or anything that's equated to being a decent Human Being, do you? The real fact is, confirmed from the Director, that they will NOT be doing any recruiting, or accepting People from 50 Miles away! In fact, the accurate numbers were that there were 119 Homeless in Asbury and another 70 in Neptune when they did a professional survey for their needs. Since that's way above the capacity for shelter which the Mission has, it would be foolish to let anyone out of the area in to sleep! People in a 2 Mile radius will saturate the Mission's capacities easily! As far as "Background Checks", I also just found out that it would be Illegal for the Mission to do that, so they can't .. So just ONE more Lie, or Distortion of the truth by the Low Lifes at SUFA! The Truth is that SUFA is just another group which has been created by extremely Racist People trying to get the Afro-Americans out of town as fast as they CAN, for their own financial gain (Or so they think) Another LIE that they're circulating is that the Mission won't accept Gays Which shows who started SUFA Fact is, Gays WILL be accepted with open arms just as gladly as ANYONE else! Hi Allen, Thanks for your input. Firstly, I would like to point out that we are not suing the Market Street Mission. We are appealing the variances that the zoning board issued to the Mission. The zoning board initially denied the variances that the shelter sought from the city. The Mission then appealed this at the Monmouth County Court. The Judge ruled that the zoning board had not considered the “inherently beneficial use test” in denying the variances to the Mission. The ruling was sent back to the zoning board. At this point the zoning board felt out-gunned and approved the variances without applying the inherently beneficial use test. Stand Up For Asbury is not against homeless shelters or soup kitchens per se. Our contention is that the city already has more than its share. The shelter will bring in homeless men from around the State, not just men from Asbury. The homeless at the shelter will have had no criminal background checks and will include released convicts, pedophiles, drug and alcohol abusers and the mentally ill. These men will be on the Streets of Asbury Park starting at 7 a.m. every morning until the shelter lets them back in at night. I have never heard of a city issuing temporary variances in this type of situation. The shelter has already purchased the property for an enormous sum of money. Once it is allowed to operate, it will be there indefinitely – for better or for worse. The Market Street Mission has operated in Morristown for over 90 years. I also want to point out that councilman John Loffredo has supported our efforts from the beginning and was instrumental in getting a council majority. These two men clearly stand up for Asbury. I would like to publicly thank many of you from this list who have contributed to our legal appeal against the variances issued to the Market Street Mission. I would also like to thank the roughly twenty-five people who showed up at our recent meeting. Unless our appeal is successful, the Market Street Mission will open its Shelter and Soup Kitchen in the heart of our city, on the "Chat & Nibble" Block, at the corner of our most destitute neighborhood - Southwest Asbury Park. Possibly by the end of this year. The mission initially plans to serve meals to 100 people per day. And just as they do at other food pantries & soup kitchens around town, vagrants, alcoholics & addicts will loiter in the area waiting for handouts. They will break bottles, they will panhandle, they will litter. The quality of life in this city will be negatively impacted, especially for our friends and neighbors who live near the central part of town. Prisons around the state will have the Market Street Mission on their referral list for inmates with no where to go. Vagrants from other towns will be directed to Asbury as they have been for years. This is not scare mongering. This is simply what will happen if the mission opens. Please join us in our appeal. Stand Up For Asbury! is holding a meeting to discuss legal appeals to the variances issued to The Market Street Mission, a homeless shelter and soup kitchen to open on the corner of Memorial and Sewall in Asbury Park. Market Street Mission Homeless Shelter Fact Sheet Background: About a year ago, the Market Street Mission made application to the City to conduct an operation at 701 Memorial Drive within the City of Asbury Park to include: 40 beds for overnight sleeping on a daily basis, a soup kitchen, the repository for used cars the servicing and sale of them, and a house of worship. Since the Mission knew that these uses were not permitted in the zone in which the property was located, they sought out a "use variance" from the municipal Zoning Board. This Board is composed of 7 members and it is a separate autonomous body from the Mayor and City Council, and is empowered to take testimony and render decisions like a Court of Law. The Zoning Board considered the matter at 6 public hearings that were held between April of 2005 and November of 2005. Public hearings are to be publicly noticed, and in addition, residents and commercial entities located within 200 feet of the property in question are to get special certified notification. On November 29, 2005, the Zoning Board voted to DENY the application of the Mission. This denial was memorialized and by Resolution and adopted on January 10, 2006. Following this denial, the Mission filed a lawsuit known as an "Action in Lieu of Prerogative Writs" in Superior Court in Freehold (not Trenton) On February 28, 2006, the Court ruled that the Zoning Board's denial of the application was "arbitrary, capricious and unreasonable," and not supported by the record before the Board, and that they failed to address the "inherently beneficial use" standard prescribed under the law. The Court entered an Order REVERSING the Board's denial, and remanded the matter back to the Zoning Board to use the correct "inherently beneficial use" standard. Following the Court's action, the Zoning Board scheduled an additional public hearing to re-consider the application and this was publicly noticed and took place on March 14, 2006. On this date, the Zoning Board voted that evening to reverse its prior decision and grant ALL variances. It was memorialized by Resolution on March 28, 2006. Notice of the Zoning Board's determination was published in the City's official newspaper on May 25, 2006. Note that this matter was NEVER a matter that came before the Mayor and City Council as they have no jurisdiction over this matter by way of this judicial process. Time is of essence as there are time limitations associated with filing appeals. We are currently raising funds to hire a Zoning Attorney to file an appeal. Yahoo! However, there is nothing more the city can do. A judge in Freehold has decided that the City of Asbury Park has no say in this matter. STAND UP FOR ASBURY says that this judge is wrong! Stand Up For Asbury is hiring Zoning / Land Use Attorney Ronald Gasiorowski of Red Bank to review transcripts of the Zoning Board hearings and the ensuing court case to determine how and if an appeal should be filed against the variances issued to the Market Street Mission.
