i just have one more thing to say about the whole copyright/sampling issue:
the copyright you have is not something that you are forced to use!
the fact that in reggea it was common place that you used to 'steal' other
peoples rhythms, or even complete tracks, and make your own version of those
tunes shows [beside the fact that in jamaica they didn't have a good working
copyright system] that some people don't mind other people using their work.
and even today there are loads of hip hop albums where all the used samples
are credited, so those artists don't mind the fact that their work is
're-used' either.
but there are also artists that have a very strong bond with their work, and
want to have complete control over the way that it is presented [kraftwerk
and drexciya come to mind] and i remember reading on our very own beloved
313-list, someone explaining why he did not put mp3 files of his music on
the net; because it would not do his music justice. if you feel this
strongly about your work, the prospect of everyone being able to do with it
whatever they seem fit, might prevent that artist from releasing his work to
the public!
so abandoning copyright all together has a down side, whereas the current
system only asks from the person that's using the sample to get permission
from the original artist. that don't seem like a whole lot of work to me!
remember your using something someone else has put some time into, so why
should you not just take a little time getting approval? yes, it's
frustrating to take a sample somwhere make a nice new record from it, to
find out that you're not allowed to use the sample. then again, you should
have thought of that before you started your work. i'd say that once you get
permission to use the sample it shouldn't matter what you do with it [play
it backwards triple the speed, and put some greek guy swearing on top of it
and you might have even thought of a whole new genre of dance music, think
of the humidity in all the clubs when everyone's trying to 'sing' along.]
loads of people have no problems whatsoever with people using a small piece
of their work, but i think that to protect the few that do mind, there has
to by somthing, and the current copyright system don't seem that bad to me.
or you have to find a way to protect just those that really, really want to
be in total control, but imho that's a lot harder than asking for
permission.
