Andhra Pradesh High Court in Sri Ch.S. Rajeswara Rao vs. Government of
Andhra Pradesh W.P.No. 5486/2011, referred Section 47 of the Persons
with Disabilities (Equal Opportunities, Protection of Rights and Full
Participation) Act, 1995 (now Rights of Persons with Disabilities Act,
2016) [“Disabilities Act“], on September 14, 2022 ,observed that under
the Disabilities Act, it is the statutory duty of the employer not to
throw the employee out of service but to provide the alternative
employment to some other post with the same pay scale and service
benefits and if there was no such post available the supernumerary
posts should have been created.
