*Appointment of Chairperson, National Trust for the Welfare of Persons with
Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities *
National Trust for the Welfare of Persons with Autism, Cerebral Palsy,
Mental Retardation and Multiple Disabilities is a statutory body constituted
under Section 3(1) of the National Trust for the Welfare of Persons with
Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act,
1999 (hereafter, "the Act"). The Trust has 22 Members and is chaired by
Chairperson.
*2. Objects of the Trust as given in Section 10 of the Act are: *
a) To enable and empower persons with disability to live as
independently and as fully as possible within and as close to the community
to which they belong;
b) To strengthen facilities to provide support to persons with
disability to live within their own families;
c) To extend support to registered organisations to provide need
based services during period of crisis in the family of persons with
disability;
d) To deal with problems of persons with disability, who do not
have family support;
e) To promote measures for the care and protection with persons
with disability in the event of death of their parents or guardians;
f) To evolve procedure for the appointment of guardians and
trustees for persons with disability requiring such protection;
g) To facilitate the realisation of equal opportunities,
protection of rights and full participation of persons with disability; and
h) To do any other act, which is incidental to the aforesaid
objects.
*3. Powers and duties of the Chairperson, National Trust, as per Rule 6 of
National Trust Rules, 2000, are: *
1) The Chairperson shall be responsible for calling
and presiding over all the meetings of the Board;
2) The Chairperson shall move the Board to take into
consideration his views in regard to any matter, which is required to be
considered by it, or any matter required by the Central Government to be
considered by the Board;
3) The Chairperson shall be responsible for the proper
functioning of the Trust including local level committees and ensure
implementation of the policies and programmes of the Trust;
4) The Chairperson may give directions to Chief Executive
Officer for implementation of the decisions taken by the Board.
4. As per Section 32 of the Act, all members, Chief Executive Officer, other
officers and employees of the Trust shall be deemed, when acting or
purporting to act in pursuance of any provisions of this Act, to be public
servant within the meaning of section 21 of the Indian Penal Code.
*5. Term of Appointment as per Section 4 of the Act: *Three years, from the
date of appointment or until his/ her successor is duly appointed, whichever
is longer, provided that no person shall hold office as Chairperson after
he/ she has attained the age of 65 years.
*6. Conditions of Service of the Chairperson: - *Under Rule 4 and 5 of the
National Trust Rules, 2000, the salary of the Chairperson shall be
equivalent to the Basic Pay of a Secretary to a Government of India.
Dearness allowances, city compensatory allowance and traveling allowance
will be paid, as per rules, applicable to a Secretary to Government of
India.
Provided that where the Chairperson is a retired person from the Central
Government or a State Government or Union Territory Administration or
semi-Government body or Public Sector Undertaking or a recognised research
institution or other autonomous or statutory body, the salary payable
together with the pension or pensionary value of the terminable benefits or
both received by him shall not exceed the basic pay of a Secretary to the
Government of India.
*7. Age limit*: Not exceeding 62 years as on 1.1.2009.
*8*. *Eligibility: *
*8.1 *As per Section 3 (4) (a) of the Act the Chairperson, to be appointed
by Central Govt., shall be from amongst persons having expertise and
experience in the field of autism, cerebral palsy, mental retardation and
multiple disabilities.
*8.2 *Educational Qualifications and Experience: -
*(i) Educational Qualifications*:
The minimum educational qualification shall be graduation from a recognised
university with a postgraduate degree/ diploma in one or more of the
relevant disabilities namely autism, cerebral palsy, mental retardation and
multiple disabilities. Publication of research papers in reputed
professional journals shall be considered as an additional qualification.
*(ii) Experience*: At least 15 years experience in disability sector, of
which at least 10 years should be in one or more sectors in the field of
autism, cerebral palsy, mental retardation and multiple disabilities, at a
senior executive level, in a national level organisation.
