A case which obtained a conveyance allowance for a disabled man

Sudarshan Kumar was employed in the Office of the Deputy Commisioner, 
Hoshiarpur when he was forced to undergo surgery in 1994 to remove one of his 
kidneys. In 1996, the Punjab Government issued a directive stating that removal 
of one kidney constitutes a 60% disability for employment and other purposes.
 
Case Details and Status 
In 2002, Mr. Kumar obtained a 60% disability certificate from the state medical 
board and promptly showed it to his employer, asking for a conveyance stipend. 
Despite this clear evidence, his employer refused. Mr. Kumar consulted with 
HRLN-Chandigarh and filed a petition before the Chief Commissioner for 
Disabilities, Punjab to receive his due conveyance allowance. The respondents 
tried to claim that since the conveyance allowance was established in 1982, 
before the Disability Act, it was not enforceable under the Act. In an order 
dated 5.3.2008, the Chief Commissioner rejected this argument and granted Mr. 
Kumar the conveyance allowance in stipulated amount of Rs. 250/month.

Docket:  Surinder Pal vs. Director of Public Instruction 
Court of the Chief Commissioner for Persons with Disabilities, Punjab 2007

A case which obtained a job as a lecturer for a disabled man 
________________________________________
       
Surinder Pal is a physics teacher by trade who was trying to get a job as a 
lecturer Punjab, responding to an advertisement that 20 of the 658 slots would 
be reserved for persons with disabilities…
 
Case Details and Status 
Mr. Pal has a locomotor disability. The 20 slots were to be divided equally 
among males and females. When Mr. Pal’s application was being considered 18 had 
been filled by 10 females and 8 males. Mr. Pal was 3rd on the merit list for 
the two slots, and therefore was rejected, despite the fact that he was the 
highest male on the list. 

He consulted with HRLN-Chandigarh and filed a petition in before the Chief 
Commissioner for Persons with Disabilities, Punjab. After hearing arguments and 
issuing preliminary orders to get the uncooperative respondents to comply with 
requests for information, the Commissioner issued a final order on 18.9.2007, 
ordering that Mr. Pal be given his post immediately.

Docket:  Sukhdev Singh vs. HPVNL, Panchkula 
Court of Chief Commissioner for Disabilities, Hary

A case which obtained back pay for a disabled employee whose just promotion was 
unfairly delayed 
________________________________________


       
Sukhdev Singh was employed as a cane weaver in the Panchkula HPVNL since 1986. 
After he had been working for five years, he expected to be considered for a 
promotion as per the organization’s policy…
 
Case Details and Status 
When he wasn’t, he filed a petition before the Punjab and Haryana High Court. 
In 2005, the High Court ruled that he must be promoted. The order was complied 
with and Mr. Singh was promoted to clerk in 2005. Since the promotion should 
have occurred much earlier, Mr. Singh asked for some compensation for the 
almost 10 year period during which he was denied the benefit of his promotion. 

To obtain his due compensation, Mr. Singh consulted with HRLN-Chandigarh and a 
petition was brought before the Chief Commissioner for Disabilities, Haryana. 
After hearing arguments, the Commissioner ordered that Mr. Singh be given back 
pay and other withheld benefits from the date on which he should have been 
promoted.
