Well, in promotions in group D and C, reservation is available if proportion of direct recruitment does not exceed 75%, but not so in groups A and B. However, participation in promotion process for the disabled is assured and they cannot be debarred from competing along with other candidates, this has been laid down in cases like UOI Vs. Sanjay Jain, Suhas Karnik Vs. UOI etc. Matter is sub judis in Delhi High court about the interpretation of the words "Appoint" in Section 33 of Disabilities act and it has been contended that it may legitimately include promotion as well. In fine, situation is unclear about group A and B, and there is no de facto reservation in them, but one may compete for such posts claiming reasonable accommodation wherever required.
