Clarification about "REVIEW OF THE OPHTHALMOLOGICAL STANDARDS FOR RECRUITMENT 
AND
PROMOTION OF ONE-EYED & OTHER CANDIDATES"

In reference to Circular No. P&HRD. Sl. No. : 304/2011 - 12

Issued on July 12, 2011 by your esteemed bank, I wish to seek following 
clarifications immediately as the matters dealt with therein are of immense 
importance and need an urgent intervention on your behalf:


 1.  The scope: the above cited circular purports to apply to "One eyed and 
other general candidates". What is the scope of the phrase, "And other" 
mentioned therein. In particular, whether the phrase "And other" would cover 
all other candidates including blind/low vision as defined in Persons with 
Disabilities (Equal opportunities, protection of Rights and full participation) 
Act, 1995, and their recruitment under section 33 of the above mentioned 
statute on 1% vacancies duly reserved for them?
 2.   Import: whether various visual acuities mentioned in the circular lay 
down the required medical standards for recruitment/promotion in SBI generally, 
or they lay down absolute standards even for candidates recruited on 1% 
vacancies reserved under section 33 of Persons with disabilities act, 1995?
 3.  Debarring certain conditions: The circular in Clause H of annexure I 
mentions as under: "To continue as - confirmed retinitis pigmentosa (macular 
degeneration) or any other progressive retinal degeneration would be barred for
recruitment/promotion." It also debars glaucoma absolutely. Now, Ministry of 
social Justice and empowerment, Government of India, has vide its notification 
under section 32 of Persons with disabilities act, 1995, identified many posts 
in banks in officer/clerical/subordinate cadre as suitable for blind and low 
vision candidates. Last such notification was issued in 2007, and the latest is 
scheduled to be issued any time now. As such, this general debarring of persons 
with any progressive eye condition militates against the very spirit of such 
identification and is patently illegal. Please clarify stand of bank on this 
urgently.

 1.  If the above circular and ophthalmological standards laid down by it are 
not to apply to blind/low vision candidates recruited on 1% vacancies under 
Disabilities act, as I hope should be the case, then I urge you to issue an 
urgent clarification to that effect, as otherwise your medical officers would 
disqualify all the genuine blind candidates aspiring to work in SBI after due 
selection by applying fallacious medical standards to even reserved posts.
 2.   Promotion: Please clarify how the circular in question is proposed to be 
reconciled with section 47 of Persons with disabilities act which mandates no 
discrimination in promotion on the ground of disability by any establishment. 
The candidates recruited on the 1% vacancies reserved duly in accordance with 
law are liable to be discriminated against at the time of promotion vide this 
circular.
 3.   Justification: Finally, I wish to know the rationale of the above cited 
circular in wake of the facts that persons with disabilities act mandates 1% 
reservation under section 33 for blind/low vision, empowers government to 
identify posts vide section 32, provides for non discrimination under section 
47, and a large number of blind/low vision persons are successfully working in 
SBI in all cadre including direct recruit officers etc. What is the logic of 
debarring progressive eye conditions when even totally blind persons can work 
on a number of posts in the bank?
 4.  Please clarify above matters failing which I would be compelled to 
initiate legal action against state bank of India for blatantly violating law 
and depriving visually challenged of their due job opportunities.
