Hi friends good evening.
This week U.P public service commission has announced UP Judicial
service exam for recruiting civil judges. There are 76 seats and
various catagories have been given their respective reservation, such
as OBC, ST and SC. But I am surprised to see that there is no
reservation for PH in this judicial service even there is no mention
of PH catagory. It mean they are indirectly saying that PH can not be
recruited? The notification says that candidate's personality and
physique will be taken into consideration, what does it mean? I
remember in Delhi judicial service there was reservation for PH and VI
separetly. Friends is it legal, while Supreme court has already made
clear that in all A and B group posts the reservation will be
provided. Have they not violated the constitutional mandate?
More over in another notification for the recruitment for PCS
executive it has been written in the notification that the reservation
to handicapped will be provided if identified seats are there. Friends
here also I remember the observation of the Supreme court where apex
court observed that if govt is left to provide the reservation in the
condition only if identifiable posts are there than the reservation
can never be excersised. It mean the govt can not negate the mandate
of the reservation by saying that there is no seat identified for the
physically handicapped.
Friends whats your opinion in this matter, should we go to Allahabad
in a petition to challange this notification?
Is judiciary exempted from reservation?
