This is a welcome decision. However, the impact would have been greater had
the Hon'ble Court ordered a blanked ban on the entire recruitment. Ban on
mere 3% would do injustice to the persons with disabilities only, since
many may become overage and State would be in no hurry for it is no skin
off their nose.

Hope better sense prevails on the Babu's sitting over judgement in such a
simple matter.

Congratulations on taking this up successfully. In light of the interim
order the State has no option but to adhere to the legal mandate, though
they might delay it and such a move must be fought tooth and nail.

School level. The Hon'ble Court has granted stay in the Writ Petition No.
108 of 2011 till the Government of Gujarat issues notification as per

this Section and the subsequent notification by the Ministry of Social
Justice & Empowerment, Government of India, blind persons are entitled to
be appointed as Teachers at the Upper Primary School level.

You are welcome to circulate this judgment widely for creating public
awareness regarding this stand of the Hon'ble High Court

Judgement

           (Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR
BHATTACHARYA)



Inspite of repeated extensions granted by this Court, the State respondent has, till today, not issued any notification in terms of proviso
to Section 33 of the Persons with Disabilities [Equal Opportunities,
Protection of Right and Full Participation] Act, 1995.

           At this stage, Ms. Shruti Pathak, learned AGP, appearing on
behalf of the State respondent prays for further time till one week after
the Summer Vacation. In view of our earlier order indicating that time was
granted as a last chance, we refuse such prayer.

           In such circumstances, we pass interim order restraining the
State respondent not to fill up 3% of the total vacant posts of Vidhya
Sahayak for the year 2011 and subsequent years so long as any notification
in terms of the above provision is not issued.

           Let the matter appear two months after Summer Vacation.
