The summary of this landmark Judgment is given in Paragraph 16.1 of the Judgment which reads as follows "There is nothing on record to show that any action has been taken by the State Government to exempt appointment of Vidhya Sahayaks from the application of the provisions of Section 33 of the Act. Therefore, the decision of the respondents not to consider the Petitioner's for their appointment as Vidhya Sahayaks pursuant to the advertisement issued in the year 2010-11, as referred to hereinabove, is contrary to the provisions of Sections 32,33,34 &36 of the Act, 1995 and also unreasonable, arbitarary, discriminatory and violating of articles 14&16 of the Constitution of India".
