Implement quota for disabled in IAS, civil services selection: HC

The court also directs the State and Union govts to apply the rule in the 
promotion of officers who  were recruited through the disabled quota

Mumbai : The Bombay High Court on Wednesday directed the State government and 
the Union government to implement the rule of reservation under Section 33 of 
the Person with Disabilities (PWD) Act, made for disabled people in IAS and 
civil services selection.

A division bench, headed by Chief Justice Mohit Shah was hearing a petition 
filed by the National Confederation for Development of Disabled, seeking 
implementation of the rule which provides 3% reservation to disabled people in 
civil service recruitment.
The court also directed that this rule shall be applied in the promotion of the 
disabled officers who were recruited through the disabled quota.
According to the petition, currently in Maharashtra, the ratio of percentage of 
direct IAS to IAS by promotion/selection is 67%: 33%. "Therefore, out of 100 
new posts in the State 67 are filled by persons who have been directly 
recruited in IAS category and 33 posts are filled by the State civil service 
officers. As per the PWD Act, 3%of the posts in the IAS are reserved for such 
class of people. Thus, reservation should be applicable to all the 100 posts. 
However, presently the reservation is only applied to direct recruitment and 
hence by default is applicable only to 67% of the entire posts and not all the 
100 posts as contemplated by the Act," the petition stated.
The petition contended that the quota for PWD has not been filled for the last 
15 years.
According to the Constitution, the authorities are under an obligation to apply 
the provisions of the PWD Act.
Granting relief to the petitioner, the court disposed of the petition.
