I do not get any lokdep warnings. I get error due to SPINLOCK_DEBUG, which is rather different. The problem *is* reproducible on SMP kernel without SPINLOCK_DEBUG (or without lockdep for that matter). And e.g. Mandriva ships SMP kernel as default now also for laptops The problem is not reproducible on UP kernel without SPINLOCK_DEBUG simply because otherwise locks are not compiled at all.
