You additionally want to be sure that you know who is administering the ORG and where.   They should all be administered where the user is.   It would be a good idea to move all the DL's over to the new system while you wait for completion of the migration.  Administer them in Active Directory as well. If you still have that problem, like Guido said, check the ADC thoroughly for errors, issues, problems, configuration, etc.
 
FYI: I hadn't heard that you had to have a 2003 functional level domain for Exchange 2003 USG's to operate.  Why couldn't it be W2K functional level Active Directory in native mode?  Or mixed 2000/2003 in 2000 functional level?  Seen any documents that say otherwise that you could pass along?

single or multi-domain environement?
if multi-domain, ensure you've correctly synched your 5.5 DLs and mailboxes to AD as universal groups. Requires 2003 domain functional level, if you also use the group to secure PFs - i.e. if you need univeral security groups.
 
if single-domain, you probably have a general sync-issue - check your ADC config thouroughly...

In the middle of an Exchange 2003 upgrade, we still have a few 5.5 servers also.

We had several issues were Users would drop of a Distribution List.

Anyone seen this or now what could be causing this?
