No, the Exchange agent does not use VSS. You are getting the error because you have the exchsrvr directorie(s) included in the file-level portion of your backup. Exclude those directories and check the box that says "Exchange Information Store" or something to that effect. Each backup software package is different and you didn't specify which one you are using.
