According to one source I found it doesn't matter if the nest has eggs or not. It only matters if the bird is actively using the nest, tending. I probably would have decided to delay if I had known it but evidently the landscaper says it is a law that you can't destrub a native birds nest that is active. I have no diea if that was a federal or state law.
