No. An inactive player, or a non-player, is categorically unqualified
to judge. For that matter, a non-first-class player is categorically
unqualified, so HP2 can't judge regardless of activity. If the Default
Justice is unqualified then there is no obligation to assign em, but
even if there were an obligation it wouldn't actually be possible.
More precisely: if the Default Justice is unqualified, then all panels
containing em are also unqualified to judge (Rule 911), so the "unless"
portion of the Default Justice clause kicks in.
