determination of the time of sending. Similarly, avoidable delays
should necessarily be included in the duration of the act of sending.
I would argue that mistakenly sending from an unsubscribed account
(which may have happened in CFJ 1314) counts as unavoidable, while
intentionally doing so (as in this case) counts as avoidable. The
slam-dunk case for 'avoidable' would be if comex had colluded with
Distributor Eris to keep the message under wraps, though I doubt
this is the case (I think Eris is still on RL vacation).
