3 sent to jail for life for gang-raping blind woman

New Delhi: A blind rape survivor identified her rapists by their
voices, with a city court finding the crime "deeply shocking,
horrifying and appalling". The court thought it was apt to deal with
"stern hands" and sentenced all three men to spend the remainder of
their lives in jail.

 "In this case, a vulnerable, hapless blind woman was gang-raped. A
strong message needs to be conveyed to the society to prevent the
repetition of such offence," said additional sessions Judge Ramesh
Kumar-II.

 The survivor, an orphan from Dehradun, was abducted from New Delhi
railway station by the three men when she was making enquiries about a
Dehradun-bound train. The survivor was studying in Class XII in
Dehradun when the incident took place at the New Delhi railway station
on January 24, 2015.

 In her statement, the survivor said that she was enquiring about a
Dehradun-bound train when the three men came to her and offered food.
They took her away to an isolated place where they raped her in turn.

 The evidence the court found to be crucial was that one of the
accused was apprehended when people heard her cries while the accused
was dragging her. The accused proved to be a prized catch for the
police, who nabbed the other two men on his information. "His
statement clearly establishes that they were not only known to each
other but also the members of the same group, the facts which were not
in the knowledge of the investigating agency," observed the court.

Defence's main argument was on the point of identification of the
accused, asserting that the same be discarded. The court, however,
rejected the argument saying that the names of the accused, who are
unknown to the survivor, do not matter as they are identified by
physical appearances. And in this case, the survivor was made to
listen to the conversations of the accused to identify them.

 When the court convicted the men of gang rape, additional public
prosecutor A T Ansari sought severe punishment, saying they did not
deserve any leniency. It also mattered how the society perceives the
quantum of punishment awarded to such perverts.

 "The prosecutor, a blind girl has given a consistent, coherent,
creditworthy and intrinsically reliable narration of the incident,"
the court observed. It also said that instead of helping her, the
accused convinced her to accompany them and then raped her. "It is
required to impose a substantive and stern sentence that would be
commensurate with the gravity of the offence," said the court while
sentencing all three men to life term imprisonment.
