If you use the software to build a website, that may constitute a
copyright violation if the proprietary license does not allow you
"API" access, sold at a higher premium. "Modification" of software
includes creating "combined works" - which are created by linking your
code to the copyrighted code.

Linking means interacting with the program in the same way it
interacts with itself.

  Currently Aiki sites must make their code available by hand to comply
  with the license.

  I bet that most Aiki sites are out of compliance with the license.
  This is a SERIOUS problem.
