Just imagine that the merged cells were horizontally merged. Then OOo would have to draw not a rectangle but a more complex border. THAT would look strange. Moreover I don't know how merged cells are handled internally, but it looks as only the topmost/leftmost cell is the "anchor cell" - the one that is included in any such selections. Imho this is an acceptable behaviour, although not perfect. I'll leave it to others to decided what to do. I adjusted the issue type accordingly.
