Acording to OD no bug at all.
In the first case you have the context menu of the chart object.
In the second case the chart itself is not yet activated and thus you'll get the
context menu of the embedded OLE object that contains the chart.
If you instead double click the OLE object (activate the chart again) you will
get the same context menu as in the first case.
