If there is a legal issue with copying the colours from MS icons then don't copy their exact colours, use a (possibly only very slightly) different set of colours. I have not seen any mention of any legal issues anyway. The official documentation only refers to changing the icons in line with the new brand, it does not mention the need for colour codes.
