oh yeah, i already contributed to that bug doing some tests on 
newer kernel/grsecurity patches.

     workingaround this is pretty simple:

paxctl -cm /path/to/clamd

     0.96.2 already have a patch to deal with some processes limitations 
introduced by PaX (which, by the way, also happens with SELinux). 
Running 0.96.2 probably will eliminate the problem, as clamav will 
detect PaX and disable the needed stuff to avoid being killed by the 
kernel. Also running a pretty recent kernel/grsecurity patch will 
eliminate the problem too, even on clamav versions before 0.96.2.
