They won't view it as a bug, but yes, I suppose in your case, you could see it as such. It's only a bug if the behavior is not what they desire it to be. We have used a plastic shield to keep fingers away from the System Bar and disabled the action bar in our kiosk apps, perhaps you can discuss limitations of the platform with your client -- Apple won't let you mess with their Big Button, either ;)
