In your third <zip>, you ask the task to update the archive (i.e. add files not already present and replace those older than those in the basedir) and at the same time want it to fail if it wants to do more than just adding? I feel this is stretching the duplicate="fail" more than a bit - the resulting archive wouldn't contain duplicates, it would only contain the latest version of "foo".
