This is flat out wrong. Duany had no part in the Deal that was made. 
Duany had no part in the Plan that was conceived to fit the Deal.

Duany was hired to develope design standards and act as a mediator 
between the City and Asbury Partners when the public asked for 
changes to the plan.

In the public record Duany specifically acknowledges that the process 
being enployed was "planning by contract". (The MOU/contract was the 
basis or the land-use/planning)

That, in and of itself, flys in the face of normal practice where a 
plan is developed first and then a contract is entered into the 
impliment the plan.
