For the Indonesian readers: Please forgive me for using English
language, but my Indonesian is still very poor.
I decided in 2003 to prepare becoming a wireless Internet Service
Provider because the high prices and bad quality of service and
reliability of existing local providers frustrated me when accessing
the Internet.
My surveys indicated that it would be possible to provide world
class services below current market prices while still operating a
very profitable business.
We have an exclusive franchise agreement since May 2004 with PT.
Pasifik Lintas, holder of a national ISP license.
Such franchises are common practice in Indonesia and are
regulated by ABJJI, the offcial semi-governmental ISP organization.
When police swept our office on Oct. 23, 2004, we were not yet
operating but still preparing ISP operations.
We are now being indicted at Denpasar district court to have
operated ISP business without license according to law no. 36 from
1999.
We are also charged for having used vSat equipment without type
approval from DirJen PosTel.
We purchased this equipment in September 2004 from PT. Telemedia,
a Jakarta based vSat distributor.
My wife Sang Ayu is direktur utama of our local cv. Candi
Internet and I have a work permit as manager for business development.
Sang Ayu is the only suspect in this "case". And she does not
even know how to send eMail.
Our partner PLB, the equipment provider PT Telemedia and myself,
we are all considered witnesses for Sang Ayu's "crimes" !
This case most likely started because a local Balinese ISP gave
some money to someone inside ResKrim Bali, asking the favor to give
our company as much trouble as possible.
I guess the police expected to find just one more of the many
local unlicensed providers, intended to terrorize us as long as our
competitor paid for it and get money again from us later in exchange
for not threatening us anymore.
It all went wrong for them from the beginning on Saturday,
October 23, 2004, as we immediately presented a photocopy of our
partner's ISP license and our exclusive franchise agreement and Surat
Penunjukan from PT. Pasifik Lintas Buana.
Next one of the police officers shouted at our partner over the
phone, our partner complained with director Heru from ABJJI, director
Heru complained with Jen. Dai Bachtiar and Jen. Dai Bachtiar then
supposedly contacted Kapolda Bali Mangku Pastika.
Detik was informed by someone in Jakarta, reported about
the "illegal police sweeping" and next Monday, Oct. 25, REsKrim
Bali's "Cyber Crime Squad" was really angry with us for "blowing up
the case in Jakarta".
"Police did not want to loose their face" as they say here, and
probably they were under pressure from Kapolda and needed to find
anything against us to prove their sweeping and confiscation
justified after all.
On Nov. 5, 2004, police had the guts to ask us to pay Rp. 100
million to them for closing the "investigations", and some days
before the result of talks between ... Bali and Judith Lubis,
director of AWARI, was that Judith Lubis asked us to pay her Rp 70
million for the police and Rp. 70 million for her help and our
problem would be solved.
On March 17, the case was already with prosecutor I.B. Wiswantanu
(Kejaksaan Tinggi Bali). Wiswantanu successfully blackmailed my wife
Sang Ayu during an "interview" (no BAP was done) in March to pay him
on the spot Rp. 4 million, else he would arrest her immediately.
When police PR started a TV plus newspaper campaign defaming us
as illegal and already shut down ISP on April 10, I decided that
enough was enough and reported this case to Erry Hardjapamekas,
commissioner of KPK.
On April 26, 2005, KPK decided officially to start investigations
and asked Kapolda Bali to start internal investigations based on our
report to KPK.
Since then we are being hunted down and terrorized by the very
people we reported.
Sang Ayu is in prison since June 15 and and supposed to stay at
least another 60 days!
And I have been warned many times police will jail me because of
my KPK report and Internet publishing

I just talked with my wife Sang Ayu Made Karnasih.
She told me she was infomed by prison authorities today that
the court sentenced her to stay another 60 days in jail !
What is this all about?
We are charged to operate ISP business without license from
DitJen PosTel.
It's a bad joke!
We never operated yet and we did not need a license because we
have a franchise agreement with PT. Pasifik Lintas Buana, holder of a
national license!
Sang Ayu is Direktur Utama of our CV. but I am the only one
responsible and knowledgable about our business!
I have a work permit as Director for Business Development.
Sang Ayu is the only suspect of this "case" and I am considered
a "witness" against my own wife.
Can you all be quiet when an honest Balinese woman and mother
is treated like this only to press a foreigner !
On June 15 presiding judge Nyoman Karma sentenced her to 30
days in Kerobokan prison for "ignoring court summons letters" without
checking evidence for delivering any legal court summons letters
ever.
Today the same judge I Nyoman Karma decided to imprison my wife
for another 60 days allegedly because of the legal maximum term of
punishment according to indicted violations of Telecommunications law
No. 36 from 1999.
The bail (security) to get her released was set by judge Nyoman
Karma at Rp. 250 million Rupiah.
Her Balinese family and I already signed for the security of
250 million Rupiah on June 17.
The court refused to release Sang Ayu and until today the court
did not give any reason for this refusal.
Our lawyer says the judges are still checking the signed bail
application (a standard form). What are they really checking ?
Then I was told by our lawyer Azhari last week Sang Ayu would
be released from prison if I pay 100 million Rupiah cash to the court!
I was at the court on Friday, June 8, presenting the money to
pay.
But I was refused a guarantee that and when my wife would be
released if I paid the money to the court, so I refused payment.
I don't know what to do or what to say!
How can this be?
Where is the law, where is justice ?
In my wallet only ?
How can Indonesia expect to attract foreign investors if there
is no legal security ?
From here I can see only greed, abuse, fear and a wall of
silence!
So Sang Ayu must tell our daughter:
My daughter dear, I am a prisoner
Don't be ashamed to tell my crime
The crime of honesty, legality humanity and not lying under
pressure
And only silence is shame

The 4th court session was held today.
The court rejected our lawyers exception from June 21.
The court also refused to release Sang Ayu from prison.
The presiding judge Nyoman Karma told lawyer Azhari outside of
the court room that they would consider to release Sang Ayu only if
the bail of Rp. 250 million is paid to the court in cash!
Azhari told me that the court will not confirm this in the
court room and they will not sign any confirmation about this.
We have to pay the money (250 million), the court secretary
will inform the judges the money was received and then they shall
consider releasing Sang Ayu.
I do not have this amount of cash money and I am afraid nobody
will give me a credit if I can not even show a letter from the court
that my wife shall be released if the money is paid.
Our lawyer received copies of the prosecution files at court
today (!!!).
The first Surat Pangilan from Jaksa is dated April 25 and the
session was scheduled for April 26, same as your official beginning
of investigation.
This Surat Pangilan was never given to anybody and the court
only argued that the suspect did not need worry about legality of the
process, but just appear at court when she knows already there is a
session.
(Remember that prosecutor Suhadi called our lawyer by phone on
the eve of April 25, requesting him to come to court without ever
receiving any documents next day. Azhari refused and also was not
even on Bali).
Today, for the first time there were no journalists present at
the court.
They all left just after prosecutor Suhadi talked to them and
just before our session started.
Indonesian, at least Balinese media are too scared to report
about our case other than casual statements about my wife being
arrested and our case being the first ISP case in Indonesian court.
Some of my friends here are angry with me because I "fight the
system" and "it's all my own fault" anyway that I make myself so many
enemies.
Others accuse me of fighting against wings of windmills like
famous Don Quichotte. Truth is my enemies are not illusions!
We all know there is a lot of corruption here, but some people
are really trying to fight it.
My own government -German embassy and foreign ministry-
recommends ...!
(The German Embassy Jakarta warned me recently to publish
certain statements)
So far wherever I send email I encounter a wall of silence.
There are rare exceptions.
Where is the law ?
What are they doing to us ?
Everyone afraid of police and prosecution on Bali, even the
journalists ?
Nobody seem to have balls here, that's why my wife is in jail
and I am supposed to witness against my own wife !
The same persons we reported to KPK started the hunt soon as
you started telling them about our report.
Confidential investigations ?
I am an honest and hard working person with a strong sense for
social responsibility and justice.
If I corrupted police last year as they requested .. or if I
corrupted prosecutor .. in January 2005 as he requested Rp. 50
million, there would be no case against us. Or would there ?
Who are our enemies who started paying police ?
Our company must be the ISP here who did not bribe police, as
we are the only one ever prosecuted and the first ISP in Indonesia
ever brought to court for operating without license from DirJen
PosTel.
And unlike most ISPs here on Bali, we were and are as legal as
possible.
